to take place at the Annual Meeting of
Unit Owners on April 14, 2015 at 7:00
p.m. at the Fiesta Room.

The vote is secret and only the owner
can cast a Ballot.

In order to comply with the Mirasol Ocean
Towers Condominium Documents, and under
the advice of our Association’s attorneys, we
have searched the Miami Dade County Public
Records in order to have copies of each unit
owner’s deed as recorded, showing current
ownership of our units.
If you have conveyed your ownership rights to a
Trust, corporation, heir, or other, please note that
ONLY those persons or entities will be able to
cast a vote in the upcoming April 14, 2015 elections for Board of Directors. If you were the recipient of one of our units as an inheritance, UNLESS the deed was transferred and recorded in
your name(s), you will be unable to cast a vote.
If you have any questions concerning this,
please feel free to contact our Management office prior to casting your ballot.
Any ballot found to contain the wrong ownership information, will be disqualified.

Emergency Stairs Violation Update
In a Board of Directors meeting held on Friday, March 6, 2015 a contractor was approved to remove and install new Emergency Fire Stairs. This
will address a serious City of Miami Beach code violation placed upon
the building in 2011. It is a serious violation as it is a life safety issue that
the previous two boards did not correct.
The winning bid was the lowest of 7 bids reviewed. The bids ranged from $157,280 to
$297,298 and were based on specifications
prepared by an engineering firm representing
the Association. It should be noted, that the
stairs will be built to meet the City of Miami
Beach code as well as the 40 year certification
requirements. The cost of the stairs will be
$157.280 plus the city of Miami Beach permit.
The company chosen to perform the work is
ED Steel Fabricator, Inc. (Formerly known as
Ebenezer Door & Iron Work Inc.). The company is currently working in several buildings in the cities of Miami Beach
and Miami. We have forwarded the approved proposal to our attorneys
to complete a contract that will properly protect the Association. It is estimated that the work will be completed in approximately 4 months from
the contract signing.

Escaleras de Emergencia
En una reunión de la Junta de Directiva efectuada el 6 de marzo de 2015
la Asociación aprobó una propuesta para remover e instalar nuevas escaleras de emergencia para remediar una seria violación del código de
la ciudad de Miami Beach la cual ocurrió en el año 2011. Se trata de
una grave violación ya que el estado de las escaleras pone en riesgo la
vida de nuestros dueños y residentes. Cabe subrayar que las dos juntas
anteriores no tomaron acción para solucionar las violaciones.
La propuesta ganadora fue la más baja de las siete (7) revisadas. Las
propuestas recibidas oscilaban entre $157,280 y $297,298. Estas propuestas fueron preparadas bajo las especificaciones preparadas por la
empresa de ingeniería que representa a la Asociación. Cabe señalar que
las escaleras se construirán en conformidad del código la Ciudad de
código de Miami Beach, así como los requisitos de certificación de los 40
años del edificio. El costo de las escaleras será de $157,280 más el costo del permiso de la ciudad de Miami Beach. La empresa elegida para
realizar el trabajo es ED Steel Fabricator, Inc. (anteriormente conocida
como Ebenezer Door & Iron Work Inc.). ED Steel Fabricators, Inc. ED
Steel está trabajando actualmente en varios edificios en las ciudades de

The court has found the claim of Pistorino & Alam Consulting Engineering to be fraudulent.
As you may be aware, this company was the engineering
firm hired by the previous Board (since 2011) to design
and manage the concrete restoration and window installation
projects, which to date remain incomplete, and have cost the
Association hundreds of thousands of dollars in payment to
Pistorino & Alam. Additionally, this same firm was hired
by that board to design and provide consulting services for
smaller projects, including the ADA ramp, whose plans are
not acceptable by the City of Miami Beach as designed and
must be redone even though the Association paid for them
in full.
It is great news that the Association has been vindicated in
pursuing this legal course. The court has found the claim
of the engineers to be fraudulent although it was Pistorino
& Alam that commenced the legal action against the Association. This board has saved over $115 thousand dollars
claimed to be owed to Pistorino & Alam. Further, we will
now be allowed to recover all monetary damages and legal fees paid to date on this. Remember that at the time Pistorino & Alam were terminated, the previous board mem-

bers informed the owners that this was a grievous mistake.
The judge’s ruling disagreed with this conclusion.
Since the Association dismissed Becker & Poliakoff as the
attorneys representing Mirasol Ocean Towers, and began to
work with The Barthet Group as general counsel, the Association has won hundreds of thousands of dollars which were
never expected to be recovered had Becker & Poliakoff remained. Again, the dismissal of this firm was looked as a
mistake by the previous board. The results of the Barthet
Group have also shown that this board made the right
choice when it came to changing the attorneys.

Como todos sabemos, esta empresa fue la firma de ingeniería
contratada por la Junta anterior (desde 2011) para diseñar y gestionar los proyectos de restauración de concreto y la instalación
de las ventanas, que hasta la fecha aún no han sido finalizadas,
y le han costado a la Asociación cientos de miles de dólares en
pago a Pistorino & Alam. Además, esta misma empresa fue contratada por esa junta para diseñar y proporcionar servicios de
consultoría para proyectos más pequeños, incluyendo la rampa
de ADA (incapacitados), cuyos planes no son aceptables por la
Ciudad de Miami Beach y el diseñado debe ser hecho de nuevo a
pesar de que la Asociación pagó por estos diseños por completo.
Es una gran noticia que la Asociación ha sido reivindicada
en la consecución de este curso legal. El tribunal ha estimado la reclamación de los ingenieros de ser fraudulenta,
aunque fue Pistorino & Alam fue el que inició la acción legal
contra de la Asociación. Esta directiva le ha ahorrado más
de $ 115,000 dólares que se le debían a Pistorino & Alam.
Además, ahora se nos permitirá recuperar todos los daños
y perjuicios monetarios y honorarios de abogados pagados
hasta la fecha. Recuerden que cuando se terminó el contrato
con Pistorino & Alam, los miembros de la directiva anterior
le informaron a los propietarios que esto se trataba de un
error grave. El veredicto del juez no estuvo de acuerdo con
esta conclusión.
Desde el momento que la Asociación puso fin al empleo de
Becker & Poliakoff como abogados representantes de Mirasol Ocean Towers, y comenzaron a trabajar con El Grupo
Barthet como consejero general, la Asociación ha ganado
cientos de miles de dólares que nunca se esperaban recuperar, si se hubieran mantenido los antiguos abogados. Una
vez más, el despido de Becker & Poliakoff fue percibido por
la junta anterior como un error. Los resultados del Grupo
Barthet también han demostrado que esta Junta Directiva
tomó la decisión correcta al cambiar de abogados.

Trash Chute Repairs
By the time you read this Newsletter repairs to our trash chute will have been
completed. We would like remind our residents that they bear the responsibility to
dispose of their household waste properly. Do not throw garbage down the chute
in open bags; make sure your trash is secured in closed garbage bags. Help us keep
our trash chute in good condition by not throwing heavy objects down the chute,
as this will damage its inner walls. The best prevention against pest infestation in
the common areas of our building is a clean and in good condition chute. Please
cooperate and let’s keep the fruit flies away.

Cabanas Update
The renovation of the cabanas is in progress. The
contractor found some of the concrete in deplorable
condition; all this concrete has been removed. Many
were full of live termites and dry rot. One cabana in
particular, had a wooden ceiling, that not only had
termites, but the leaks from the roof had the boards
rotted through. It’s a miracle that an electrical accident never occurred while changing the lightbulbs.
Speaking of electrical, electrical installations were
found faulty and illegal in some of the cabanas. A
good combination for starting a fire.
We would like to inform our owners that the sprinklers will not be working as water has been shut off
for the duration of the cabanas construction.

La renovación de las cabañas está en progreso.
El contratista encontró gran parte del concreto en
malas condiciones; todo este concreto ha sido removido. Muchas se encontraban llenas de comején y
podredumbre seca. Una cabaña en particular, tenía
un techo de madera que además de estar lleno de
comején tenia filtración de agua y había podrido el
cuadro eléctrico. Es un milagro que nunca tuvieran un accidente mientras cambiaban las bombillas
eléctricas.
Hablando de electricidad, algunas de las instalaciones se encontraban en mal estado y algunas eran
ilegales. Una buena combinación para comenzar un
fuego.
