Herein The News & Record is defined as the “Publisher.” The
REGIONAL ADVERTISING Rates set forth herein do not apply to
national or local advertisers, but rather to advertisers located within
NC, SC, GA, WV, TN, Washington, DC or VA. See page 4 for definition
of Regional Advertisers.
a. Notwithstanding anything contained herein, Publisher may, at any
time, including with regard to advertising placed by contract, condition the placement of advertising on Publisher’s collection of a
cash-in-advance payment for the full amount of such advertising
prior to scheduling any advertisement(s) for publication. Any advertiser or agency submitting advertising for placement on open
account credit, which shall include advertising placed subject to a
contract not payable in full, in advance, must be accompanied by
a completed News & Record credit application. Any credit request
must be approved by the Publisher before any advertisement will
be scheduled for publication. If credit is extended by Publisher,
the subsequent placement of advertising by advertiser and/or
agency constitutes such advertiser and/or agency’s agreement
to Publisher’s credit terms and conditions, which shall include,
but not be limited to, the following: unless otherwise specified
by Publisher, bills are generated on the first of each month for
previous month’s charges and payment shall be due on or before
the 25th day of the month referred to as “Billing Date” on the
statement for such charges. Bills are due upon receipt and are
considered accurate unless notification is received no later than
30 days following the date of the statement. In case of billing
disputes, extensions of time for payment of disputed amount only,
may be allowed. You will, however, be responsible for all other
outstanding balances in full by the 25th of the month following
the date of statement. Should legal action be required to collect
any past-due balance, the advertiser and/or agency shall pay all
costs including attorney’s fees.
b. There shall be added to any charges, amounts equal to any taxes,
however designated, levied or based on such charges or on the
publication of advertisements, including state and local privilege,
or excise taxes based on gross revenue, and any taxes or amount
in lieu thereof paid or payable by Publisher in respect of foregoing, exclusive however, of any taxes based on net income.
c. Each insertion order is not considered accepted by the Publisher
until approval is given for that insertion order by the Publisher’s
credit office. No advertisement shall be considered accepted by
Publisher until published. Any advertisement is subject upon
submission to all applicable Contract & Copy Regulations (see
page 10).

Record and any of its publication.
While most services are free, there are reasonable charges for original art
and logo designs. Contact your account executive for more information.
Photography
The News & Record’s Special Sections department can arrange photo
shoots for advertisers at reasonable rates. Costs include studio or
location, scanning and processing. Contact your account executive for

REGIONAL ADVERTISING
Region advertising rates apply to ads placed by any business located
outside the News & Record’s primary circulation area, within NC, SC,
GA, WV, TN, Washington DC or VA; ads placed over multiple retail signatures, unless all such retailers are under common ownership and are
located within the primary circulation area; and ads in which no legal
signatures appear, such ads having been placed by regional manufacturers, wholesalers, and/or distributors who do not sell directly to the public. Rates are net to publication.
The biggest shopping days of the year are a perfect time to advertise. On
these dates we deliver to every carrier home delivery subscriber regardless of subscription type.
Sunday rates and preprint quantities apply.

CONTRACT & COPY REGULATIONS
a. All advertisements must include the name of the advertiser.
b. News style ads must be marked “advertisement” in not less
than 6 point type and enclosed in a border. Type styles adopted for news heads
are not used in advertisements. These ads must be pre-approved.
c. Political advertisements for candidates for local public office are
eligible for the retail contract rates but may not earn discounts under any other
advertiser’s contract. All political ads are accepted on a cash in advance basis only.
Political advertisements must be marked “Paid Political Advertisement” at the
bottom of the ad. Each political advertisement must be signed by the sponsoring
individual or organization and name of designated representative placing advertising. Documentation for copy must be in 24 hours in advance of deadlines. For
additional details on political advertising please ask your account executive for a
copy of our “Standards of Acceptability.”
d. All property rights, including any copyright interest in advertisements
produced for an advertiser by Publisher, using art work and/or typography furnished or arranged by the Publisher, shall be the sole property of Publisher. No
such advertisement or any part thereof may be reproduced without the prior written consent of the Publisher.
e. Publisher reserves the right to edit, revise or reject any advertising.
The foregoing notwithstanding, Advertiser has full responsibility for the legality of
the items and/or services advertised and the advertisement thereof, and Advertiser
has full responsibility for the legality of the content of the Advertising. Advertiser
shall indemnify and save harmless Publisher or its affiliates against any loss,
damage, cost and expense (including without limitation, attorney’s fees) which
Publisher and its affiliates may incur, or become libel for, by reason of any and all
claims or actions for libel, violation of any right of privacy, plagiarism, copyright
infringement, illegality of items and/or services advertised, illegality of the content
of the Advertising, and any and all other claims of any kind or nature in connection with advertising matter published pursuant to this Agreement.
f. No allowance will be made for advertisements appearing in other
than requested positions.
g. Neither Publisher nor its affiliates shall be liable in the event any act
of God, the public enemy or government authority, labor dispute, war (whether or
not declared), international or domestic terrorism, civil disobedience, riot, failure
of equipment or systems of Publisher or its suppliers, or other occurrences beyond
its control shall in any way restrict or prevent the distribution of its newspapers or
the publication of the Advertising. Neither Publisher nor its affiliates shall be liable
by reason of any error in connection with any advertisement (including, without
limitation) typographical errors, failures to publish Advertising on desired dates
or in desired locations, omissions or additions to advertisements; provided, however, that Publisher shall be obligated to adjust or rebate pro rata the charge on
any advertisement or any portion of an advertisement which has been materially
affected by any error of Publisher; and provided, further, however, that Publisher’s
obligation with respect to such adjustments or rebates shall not apply to more
than one incorrect insertion of such advertisement unless and until Publisher is
notified of the error at least 24 hours prior to repetition of the insertion. Advertiser
must notify Publisher of any errors occurring when they appear, and any adjustments to the charge on any Advertising will not be honored beyond thirty (30)
days of the previous month’s billing. In no event shall Publisher or its affiliates be
liable to Advertiser for lost sales, profits or any special, incidental, indirect, consequential or punitive damages through its actions, inaction or neglect because
of any matters arising out of or in connection with the Agreement, regardless of
whether a claim is made under tort, contract or other theory of law.
h. The agreements, conditions, rates and regulations set forth herein
or in the written advertising contract between Publisher and Advertiser constitute the entire agreement between Advertiser and Publisher. In order to insure
the accuracy of all space reservations, all verbal reservations must be confirmed
in writing by the day of the actual space deadline, or within 24 hours. Publisher
is not responsible for any error in scheduling if no written confirmation is
received.
i. Ad Format Limitations
Upside down ads, art or type generally not permitted unless there is a creative
theme that is logical for readers. In any case, the logo and majority of the type
must be upright. Sideways Ads are allowed only as complete Full Page ads and
Double Trucks.
j. Original Advertising Materials Damaged or Misplaced
The Publisher will be responsible for said graphics only to the extent of replacement from original negative. Advertisers who submit one-of-a-kind material do
so at their own risk.
k. Advertiser’s Proof Correction Obligation
When advertisers request a proof, it is their ultimate responsibility to call in corrections if needed. However, the News & Record will reasonably seek to get a
release of the advertiser’s proof. Once the advertiser releases the proof, any copy
errors the advertiser failed to identify will not be rebated. Camera ready materials provided by the advertiser with errors will not be rebated.
l. Proofs
If ad copy is received by the copy deadline a proof can be e-mailed or faxed for
customer approval. Any corrections must be sent back to the newspaper by the
correction deadline. Corrections cannot be made after the correction deadline.
m. Coupon Ads
The use of coupons in advertisements is encouraged, and care is taken to position the coupon ads to avoid printing coupons back-to-back. Due to press limitations and emergency make-up changes, however, it is possible that coupons may
print back-to-back. No rebates or make-goods will be allowed in any event.
n. Other Conditions and Regulations
Advertisers and/or their Advertising Agencies must notify Publishers of any
errors when they appear, as per item “h”. Any adjustments will not be honored
beyond 30 days following the date of statement.
o. Kill Orders/Composition Changes
A charge will be made for ads killed (either orally or in writing) after the final
make-up deadline. This charge will equal 50% of the reserved space at the
advertiser’s applicable rate. Composition changes requested after proof correction deadlines are not guaranteed and will be subject to a charge equal to 50%
of the reserved space at the advertisers applicable rate. Camera-ready, same-size
substitute ads received after final make-up deadline are accepted at no extra
charge, however are not guaranteed.
p. Late Ad Reservations
Late ads accepted only in emergency situations and when production capacity
can handle the late ad. No proofs on late ads, and no rebates will be granted
due to production errors.
q. Credit Cards
Credit cards are not accepted as a form of payment for advertising that has
already run. For payment of statements we accept cash, check and ECP/ACH.
