Questions prior to the auction on 3 May 2015 should be sent to Craigellachie Village Council at: jane@craig515.plus.com Terms and Conditions Definitions • ‘Hammer price’ – the £ price at which a lot is knocked down [sold] by the auctioneer to the Buyer at the fall of the hammer. • ‘Lot’ – any item or items consigned with a view to sale at the auction. • ‘Organisers’ – Craigellachie Village Council [CVC] and their appointed auctioneers. • ‘Seller’ – the person who offers the lot for sale • Buyer – the person who makes the final bid as determined by the auctioneer or the auctioneer’s clerk. Conditions 1. The Seller is responsible for the lot description and authenticity. The Organisers reserve the right to change obvious errors or omissions. 2. The Seller warrants that he is the true owner of his lots or that he is duly authorised by the true owner to place the lots for sale. 3. The Seller and the Buyer confirm that they are over 18 years of age. 4. Sellers are limited to a maximum of 6 lots unless otherwise agreed by the organisers. 5. The Seller gives the Organisers absolute right to photograph and illustrate the Lots and to use these photographs and illustrations as the Organisers see fit, for the purpose of the auction. 6. Registration forms must be completed and returned to a representative of CVC or to ‘J Tweedie, Cuil Sith, Brickfield Court, Craigellachie no later than 17th April in order to be catalogued. 7. The Lots are to be deposited at the Craigellachie Village Hall on 18th April, between 10am & 4pm. This is at the risk of the seller. 8. The Seller shall indemnify both the Organisers and the Buyer separately, against all payments, costs, expenses, demands, or any loss or damage whatsoever and wheresoever incurred by either of them in respect of any breach of these Conditions by the Seller. 9. The Organisers will act in good faith at all times. 10. The Seller may stipulate a reserve price in pounds sterling. The auctioneer will action this reserve with a 10% discretion if necessary. If no reserve is agreed at the time of consignment all items will be sold, without reserve, at best on the day. 11. The Seller authorises the Organisers to deduct from the hammer price a commission at the stated rate of 10% of each lot. The Buyer will also be charged 10% of the hammer price. 12. Buyer registration forms will be available from members of CVC before the auction or on the day of the auction at the Village Hall. Bids can be registered before the auction via these channels or by emailing ‘jane@craig515.plus.com’. 13. Payment by cash [£ sterling], credit or debit card. If the Buyer fails to provide the Organisers with payment in full within 7 calendar days of the auction the sale will be declared null and void. Any postal / packing costs will be at the cost of the Buyer. 14. Sellers will be notified of any unsold lots within 21 days of the auction. An admin fee of £2 per lot will be payable when picking up unsold items. These can be collected from J Tweedie, Cuil Sith, Craigellachie. 15. Any item that remains uncollected by 30th June 2015 will become the property of CVC. 16. Wherever possible the Organisers will make payment to Sellers before 5th June 2015 Donated Items These bottles have kindly been donated as detailed in the below columns. All proceeds from the sale of these bottles will be used for benefit of Craigellachie Village Council e.g. upkeep of the hall, playing fields, tennis courts, grass cutting etc. We would like to thank all who have donated bottles, which makes a huge difference to our fundraising.
