HASTINGS CENTURY SOUTH ASSOCIATION RULES AND REGULATIONS PARKING- UNIT OWNERS: Our Documents provide for parking only in the two spaces directly in front of your garage. DO NOT PARK IN THE TURNAROUND AREAS. Vehicles inappropriately parked may be ticketed and/or towed at owners expense. A speed limit of 15 Mph is posted. GARAGE PARKING: No Owner, tenant, occupant or other Person may keep or store any trailers or major recreational equipment, including but not limited to, camper trailers, pickup campers, rnotorized self-propelled motor homes, boats or boat trailers, on any portion of the community. Owners, tenants and occupants may not store or permit the storage of anything in the garage portion of a Unit which prevents use of the garage portion of the Unit for storage of the Owner's, tenant's or occupant's personal automobile. Garage doors must be kept shut during the day. This is to keep a uniform appearance and to help pipes in the winter not freeze. This will also help prevent mice or other rodents from entering your garage. DRIVEWAYS: Normal Expectations: Asphalt driveways should maintain proper drainage, with no excessive standing water 48 hours after normal rainfall. Asphalt will dent or perforate during hot weather, and the color will fade due to weather exposure. The asphalt installed on your driveway is very comparable to that of roadway surfaces. Homeowner Care: Do exercise care with bicycle kickstand, chairs, ladders, car jacks, and even high-heeled shoes. Any sharp projection will cause indentation, especially on hot days. DO NOT turn the wheels when the car is parked in the driveway. DO NOT spill gas, oil, antifreeze, turpentine, or any petroleum products on the asphalt, these substances can cause the material to disintegrate. GARBAGE REMOVAL Garbage cans and recycling containers are not to be kept outside. You have been supplied a garbage can and a recycling container. AII garbage must be placed in the garbage container. If the association is charged extra for pickup at a unit it will be billed back to you. Recycling containers should be used for recycling materials only. The garbage contractor will not take anything from the recycling bins. AII containers should be returned to your garage the same day as pickup. Large items (refrigerators, furniture, mattresses, etc.), requiring special pickup are the responsibility of the homeowner. Recycling: The City of Hastings and the Association encourage recycling. Currently the city recycles glass, metal cans, plastic bottles and paper products, such as newspapers and cardboard boxes. They do not accept Styrofoam, shiny paper and loose cardboard, such as that from pizza boxes. GARBAGE DISPOSAL USEAGE: Please avoid putting the following items down your disposal: Peeled foods, oatmeal, rice, grease, cereal, bones, celery and eggshells. Please dispose of these items in your garbage. Please follow this guideline when you use your disposal: Turn water on. Run Garbage disposal. Deposit small amounts of table scraps into garbage disposal. Run Garbage disposal an additional 30 seconds. Shut off Garbage disposal. Run water 1 to 2 minutes after shutting off garbage disposal. These measures should be followed so that the drain lines do not before plugged and cause problems in your unit. WINDOW WASHING POLICY: Homeowners are responsible for exterior and interior cleaning. LAWN WATERING: The lawns are sprinkled. lf you notice a sprinkler head broken or an area not getting water, please notify Community Manager. Do not drive on the sprinkler heads. SpringlFall Homeowner Maintenance on Garage faucet: When freezing temperatures occur, manual draining of outside faucets must be done to prevent freezing of the faucet and possibie damage. Fall: 1. Turn on water in garage..it is now running. 2. Go upstairs above water heater and shut off the garage hose bib shut-off valve. 3. Open bleeder valve on the side of shut-off valve (small screw type plug). This will let air in the line. 4. Return to the garage and turn the goid backflow preventer counter-clockwise to drain out any excess water. 5. After water has drained out re-tighten backflow preventer and shut off faucet. The garage faucet is now winterized. Sprinq: 1. Go upstairs and make sure bleeder valve on the side of the hose bib shut off valve is tight (VERY IMPORTANT) 2. Turn on hose bib valve slowly and make sure water isn't leaking out of bleeder valve. 3. Go downstairs and turn on water. The garage faucet is now ready for summer. SNOW REMOVAL: Our maintenance agreement provides for snow removal only for significant snowfalis of one and 1/2 inches or more or where there is drifting snow. The contract also includes shoveling each owner's sidewalk plus the area around the mailboxes. Owners are asked to avoid parking in the driveways during the period when the snowplows are removing snow. If a car is parked in a driveway the plow will not be able to plow around it. During times when there has been a large amount of snow, the service will make one pass in the driveways and then come back to complete further snow removal. The snow contract does not automaticaily allow for sanding steps, sidewalks, or similar icy conditions except those arising out of an ice storm. if there is an ice storm, the company will be contacted. Absolutely no parking is allowed in the turnaround area during the winter months. Vehicles will be towed without notice at the owner's expense. If you leave during the winter months and are leaving a vehicle outside, please notify management of vehicle make and license number. NOISE & DISTURBANCE One's right to peace and quiet is guaranteed by civil law, making it unnecessary to establish rules against its disturbance. Disturbing the peace, as defined by law, is not restricted to late hours, but occurs whenever unreasonable or excessive noise is generated. If your right to peace and quiet is being interfered with, you are best advised, if attempts to reason with the creator of the disturbance have faíled, to call the police dectly. Management should be notified of such disturbance. ARCHITECTURAL CONTROL OBJECTIVE: The extensive townhouse developments both old and new in the Twin City area have made competition for prospective buyers very keen. As a development ages, it's appeal must be maintained in order to meet the competition and appreciate the property value. For this reason, townhouse developments always have restrictive covenants associated with the home deed as agreed to by the purchaser. These restrictions always deal with the entire development property, that is, the exterior home structure and property outside the home. These covenants are the basis for formulating rules dealing with the common grounds and home exteriors. The Board of Directors has the responsibility for enforcing these covenants. The objective of the Board and these rules is to preserve the appearance of the overall area and the appreciation of property. The ultimate beauty of the area will be attained by the blending of natural terrain, building materials and building design. It is possible that changes made by one or more homeowners would not only alter the appearance of the overall area, but also lower the value of individual properties. The Board recognizes the fact that appreciation of property and the continuing attractiveness of the area cannot be attained solely through their efforts. These objectives can only be reached through the cooperation and participation of each homeowner. Any requests for alterations, additions or replacements to your home's exterior, garage exterior, deck, patio or common grounds are to be addressed to the Architectural Review Committee appointed by the Board per instructions under approval procedure. The following regulations governing architectural changes within the Hastings Century South Association have been approved by the Board of Directors of the Hastings Century South Association. Request for alteration: Please submit to the Architectural Review Committee or the Board of Directors a completed ARC application outlining the change you would like to make. It is advised that if possible, changes are sketched to facilitate explanation of plans for change. The alteration request will be taken under consideration, and a written answer will be given to the unit owner. HASTINGS CENTURY SOUTH ASSOCIATION ARCHITECTURAL CHANGE GUIDELINES Additions, alterations and replacements: 1. Changes to the common ground area by an individual homeowner are not permitted without the approval of the Board. Common ground is defined for purposes of architectural control as all land in the development and the exteriors of individual homes. 2. Nothing is to be stored on the patio that is visible from the common grounds with the exception of non-collapsible, properly maintained outdoor furniture. 3. One flag of not more than 3' x 5' in size may be displayed in an aluminum bracket attached to post trim only on the exterior of the home. Nothing can be attached to the vinyl siding. Restoration of area must occur which item is removed. 4. Board approval of birdhouses, birdfeeders or birdbaths is required for placement. 5. Shade umbrellas, shades, awnings, exterior door or window coverings, tents and screen houses shall not be attached to the exterior of the home, garage or deck. 6. Energy saving devices, which can be seen, from the exterior of the unit may be installed only with the approval of the Board. 7. Swing sets, playbars, basketball backboards and volleyball, badminton, etc. nets shall not be allowed other than on a temporary basis for a special event to last no more than 24 hours. Prior approval and notification to the Board must be received. Small inflatable swimming or wading pools may be used if put away immediately after use. 8. Antennas, weathervanes, pennants, insignia, emblems or namesigns shall not be attached to the home, garage, and patio or placed on the property. 9. No "'for sale" or "for rent" signs, advertising or other displays shall be maintained or permitted on any part of the Common lnterest Community except by the Board; except with written permission of "for-sale" or "for rent" signs. 10. Clotheslines shall not be attached to the exterior of the home, garage or patio. 11. "No soliciting" signs are allowed on the property. 12. Outdoor fireplaces, barbecue grilis, barbecue-cooking structures shall not be permanently attached to the patio or to the exterior of the home or garage or to the common grounds. Gas barbecues must have the proper permits and be in compliance with the city regulations and permanent installation must be approved by the Board. Any wood-burning devices must be used 15 feet from the building. 13. Satellite dishes must be pre-approved by the Board of Directors prior to installation. 14. Standard full view storm doors are permitted, however, Board approval must be obtained first through the ARC application procedure. PARKING AND VEHICLES: 1. Turnaround areas at the end of the drive only can be used for parking by short-term visitors and the guests of residents. Garages and the two parking spots immediately in front of each garage are to be the prime parking area for the resident's own vehicles or their guests. Vehicles parked in violation of these rules may be towed without notice at the owner’s expense. 2. Car washing is permitted on blacktop driveway surfaces only. 3. Major auto repair outside the garage is not permitted. It is the responsibility of the homeowner to promptly clean up outside of the garage after minor auto repair or other like projects. 4. No inoperable car or other vehicles shall be left outside of garages for more than 24 hours. 5. No owner may keep or store any trailers or major recreational equipment, including but not limited to, camper trailers, pick-up campers, motorized self-propelled motor homes, boats or boat trailers, on any portion of the common grounds. 6. Garage doors are to be closed except when a person is working in or around the garage or when a vehicle is entering or exiting. HOUSE PETS: 1. Domestic pets are permitted on the common grounds only when under direct control of a responsible person. Pets must be kept in compliance with the animal control laws of The City of Hastings. 2. Under no circumstances will a pet's containment area be outside of the home. 3. No unattended tethering of pets to or on common ground. 4. The owner is responsible for cleaning up after pets (IMMEDIATELY). 5. Pets must not be allowed to damage bushes, sod, trees or any other plantings or garden beds. The homeowner ís responsible for repaíring any such damage within 15 days, or it will be done by the Association and the homeowner will be assessed for the cost plus 10% or $30.00 whichever is greater. 6. Complaints about pets creating a nuisance should be submitted to Community Development. 7. Pets must be walked in the buffer zone area between the townhouse and the cornfield on the non-sodden side. Pets must reach this area using the street, not the neighbors grass. 8. Tethering of pets or leashing is not allowed. PICTURE HANGING: Your buildings contain fire sprinkler systems. Please keep this in mind when hanging anything within the unit. Use a stud finder to locate the studs before hanging anything. Then, after locating, do not use a large nail to hang items or a screw gun. if you cannot locate the studs DO NOT hang in that area. The sprinkler system is under at Ieast 80 pounds of PSI and if punctured, will cause a great deal of water damage. .
