If any such incident is reported, the agency shall be held fully responsible for its consequences. The agency shall be liable to take action against erring personnel. 5. The personnel of the Housekeeping services agency shall not make any sort of noise including shouting of slogans etc. or take part in any type of agitation in the IGM, Hyderabad#s premises. 6. The Housekeeping services agency shall be fully responsible for making good any losses, sustained by IGM, Hyderabad by way of theft/burglary, fire damages of any kind to the premises or any other mischievous deed on the part of its employees. 7. The personnel of the Housekeeping services agency shall not enter into any unlawful activity within the IGM, Hyderabad#s premises and shall have good moral character. 8. The IGM, Hyderabad shall reserve the right to impose cash penalty on the housekeeping services agency and deduct such amounts from its monthly bill and/or security deposit in case the IGM is put to any financial loss of any nature whatsoever, directly or indirectly by any of the housekeeping services agency#s personnel. In the event of deduction from security deposit, the housekeeping agency shall deposit further amount to keep the amount of security deposit at the prescribed level or cash penalty can be given additionally to keep the security deposit intact. 9. The housekeeping agency shall be fully responsible for payment of (not less than minimum wages), P.F. contributions, Bonus or any other benefits under various Labour Laws/Acts applicable to him and or the personnel employed by him. In case the agency fails to discharge any of his legal obligations, the IGM, Hyderabad shall deduct such sums as making to the total legal liability, from the agency#s monthly bills and/or security deposit and discharge the liability on behalf of the agency. In such an event the agency should deposit further amount so as to keep the amount of security deposit at the prescribed level. The Contractor shall make available the details of E.P.F. deductions and remittances both employer and employee contributions. The Annual Provident Fund statements duly obtained from the Provident Fund office shall be issued to workmen/ persons deployed. 10. I.G.Mint, Hyderabad shall not entertain to continue in this tender any manpower deployed through previous contractor due to security reasons. 11. The agency shall comply with all Labour laws and other laws/statutory regulations applicable to it and/or the personnel to be employed by it but not limited to the Minimum Wages Act, Contract Labour (Regulation and Abolition) Act, Payment of Wages Act, Employees Provident Fund and Miscellaneous Provisions Act, 1952, ESI Act, Payment of Bonus Act etc. from time to time and take such steps as may be deemed necessary in this regard. On award of the contract, IGM, Hyderabad shall issue Form V as per Contract. Labour (Regulation and Abolition) Act, 1970 to the successful tenderer, who in turn shall obtain a licence from the Labour Commissioner, in respect of personnel deployed for IGM, Hyderabad within one month from the date of issue of Form V, failing which the contract shall be liable to be terminated by IGM, Hyderabad. 12. The Housekeeping services agency shall get the antecedent of its personnel verified by the Police and the certificate to that effect should be submitted before their deployment at the IGM, Hyderabad. The agency shall also submit the names, present and permanent residential addresses and two copies of their passport size photographs to IGM, Hyderabad. 13. Since Mint is an Industrial Establishment and requires handling of heavy material in day to day works, the Contractor should prefer to deploy maximum male members. 14. The housekeeping services agency shall have his staff examined and medically checked prior to their deployment. Any person found medically unfit shall not be deployed. Regd. The working hours of the Mint in the General Shift shall be 09.00 AM to 06.30 PM with half an hour lunch break from 1.00. PM to 01.30 PM. However, the working hours of the labours engaged will be 8 hours per day with half an hour lunch break. The working hours will be decided by Mint management as per the convenience of factory and may be changed at the discretion of the Mint from time to time. In case of urgency/ emergency, the labour can be deployed beyond normal duty hours, which shall be compensated through compensatory leave. 16. The required strength of workers under various categories is indicative only. However the deployment shall be as per actual requirement to be decided in consultation with the contractor and any increase/decrease in the actual deployed strength shall increase/reduce the payment to be made proportionately. 17. The contractor shall maintain all necessary registers and display notices as per mandatory requirement under the law of land. 18. In case of labour disputes for non-payment of minimum wages to the workers or any other disputes, the payment due to the contractor can be withheld till settlement of the disputes by the Mint or on the orders of the court of law. 19. The contractor shall be responsible for all injuries and accidents to persons employed by him. The workmen shall be insured against personal accidents arising out of and during the course of their duties. . 20. In the event of injury, illness or mis-happening to any worker, the Mint will not be liable to pay any compensation, whatsoever other than the monthly bills for the services rendered The insurance cover shall include the liability under the workmen#s Compensation Act. 21. The contractor shall have to engage the required number of workers and in case required number is not available on any day, the contract amount will be reduced proportionately, from the monthly payment. 22. The contractor shall in no case pay its employees less than the minimum mandatory rates per month in accordance with the Minimum Wages fixed by RLC (Central) Hyderabad and a record of that should be kept in a register, which may be made available for examination to the Institute/ Govt. agencies/ authorities as and when demanded. 23. The contractor shall not appoint any sub company/agency to carry out any obligation under the contract. If the Contractor does so, the contract shall stand terminated without notice and the security deposit shall stand forfeited. 24. The contractor shall maintain a daily attendance register including the number and names of the workers engaged in the campus/premises for works as per scope of the contract. 25. The contractor shall maintain a complaint book, which should be made available in his Camp Office. 26. The contractor shall abide by labour laws including ESIC PF, Income Tax, Service Tax or any other extra taxes levied by the Government), and all other obligations that enjoin in such cases and are not essentially enumerated and defined herein, though any such onus shall be the exclusive responsibility of the contractor and it shall not involve the Mint in any way whatsoever. Compliance of these provisions shall be ensured at the time of making monthly payments. Monthly payment by 7th of the following month as per the wages act. 27. If the contractor wants to rescind the contract voluntarily or otherwise, he is required to give a notice of at least 60 days failing which the amount of security deposit including any other dues will be recovered from him for making alternate arrangement till the new contract is assigned to the other party. 28. The Contractor should engage the labours aged between 18 # 45 years old. They should also provide proof of age if required for, for verification of Mint authorities. However, the persons engaged should be healthy and strong enough to carry out the labour jobs and should not suffer from any hereditary and chronic diseases including skin Regd. I.G.Mint can reject anybody if he is found to be physically not suitable to carryout the labour jobs. 29. If the contractor repeatedly violates the terms and conditions of the contract or fails to supply required number of skilled/unskilled laborers despite the Institute having served him proper notices, the contract shall be liable to be terminated and Performance security so deposited shall be forfeited. 30. The contractor shall have certificate from Income Tax Officer of tax exemption otherwise income tax at the rate as applicable as per Income Tax Rules shall be deducted at source. OTHER CONDITIONS OF CONTRACT: 1. Cleanliness will be the essence of the contract. 2. The housekeeping services agency shall ensure getting proper licence/permission from the concerned authorities wherever applicable. The contractor must fulfill all conditions required and Labour Contract Employment Act. 3. The engagement of labourers is purely on daily wage basis and there is no scope of absorbing the labourers in the Mint. Mint has got every right either increase or decrease the strength of labourers as per Mint requirement. 4. Mint will not issue any Service Certificates etc. for the services rendered by the individual labourers. 5. The Successful bidder is responsible for the safety of employees during the course of work and transit. The successful bidder should follow all the laws, rules and regulations of State and Central Government and obtain the required license from the Competent Authorities wherever necessary. Any lapse in this regard, the Contractor shall be responsible. Police Verification of all the workers must be submitted before resuming the contract. 6. The contractor shall be governed by the laws of India and interpretations in accordance with such laws. Mint is not responsible for any dispute of Labour, and the Labourers so provided shall not be in any way be the employees of Mint. 7. The Successful bidder shall depute one supervisor daily to co-ordinate in carrying out the jobs and liaison with Mint management. The Mint Management will assign jobs to be done on daily basis to the Supervisor and he should arrange for carrying out the jobs. The Supervisor should maintain a register showing the jobs carried out by his staff every day. He should also record the quantity and details of loading/ unloading and materials handling jobs and obtain the signature of concerned Mint Officer. 8. The General Manager, India Govt. Mint, Cherlapally, Hyderabad reserves the right to short close full or part of above jobs giving 30 days advance notice of short closure of contract without assigning any reason. His decision will be final and binding on the tenderer and no correspondence will be entertained in this regard. 9. If the services of the contractor are found not satisfactory, the General Manager, will have the right to terminate the contract without assigning any reasons whatsoever at any time. 10. In case of conduct of a persons employed by service provider is found to objectionable or for security reasons the management will remove the employee with immediate effect and expected to provide a proper replacement within a week time. 11.
