We will start insuring your pedalcycle when you cross the start line of the event and the insurance cover will end when you cross the finish line or at the time that you withdraw or abscond from the event. We will only insure one pedalcycle per contestant. Exclusions 1. This policy excludes damage or loss or any claim directly or indirectly caused by or related to or in consequence of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), terrorism, civil war, mutiny, insurrection, rebellion, revolution, military or usurped power. 2. We will not pay (a) a claim for anything other than the pedalcycle that you are using to compete in the Joberg2C 2015 event. (b) for any attachments or adaptations to your pedalcycle that did not come standard with the pedalcycle when purchased new. (c) more than R50 000 in total for loss of or damage to any one pedalcycle. (d) more than R15 000 for damage to or loss of wheels in the aggregate for the insured period. (e) for loss of or damage to tyres. (f) more than R500 000 in total for any loss or damage from one cause or occurrence regardless of how many pedalcycles are damaged from that cause or by that occurrence. The claim payout will then be split proportionately amongst the claimants. (g) a claim for damage caused by latent defects or metal fatigue or manufacturing defect whether the manufacturer accepts responsibility or not. 1 YOUR PEDALCYCLE INSURANCE Cover given YOUR PEDALCYCLE INSURANCE (h) for damage to your pedalcycle while it is being transported if it is not appropriately packed. (i) for theft of your pedalcycle if it is left unattended outside of the designated storage area. (j) a claim if it is found to be fraudulent or if you or anyone on your behalf uses fraudulent means or devices to benefit under this policy or if the loss is because of a deliberate act on your part or if you helped anyone else to cause the loss. (k) a claim because your pedalcycle has been legally taken away from you or confiscated. (l) a claim for any consequential loss or any liability that you might incur including as a result of any contract you have entered into with any person. (m) your claim unless we are advised of the incident giving rise to the claim as soon as practicably possible but at least within 3 hours of your completing the stage of the event in which the loss or damage occurred. Provisions 1. Insurable Interest At the time of an occurrence that results in a claim you must be able to prove ownership, or possession in terms of a credit or a hire purchase agreement, of the pedalcycle that you are claiming for, or we will not pay your claim. 2. Other insurance If you can claim for the same loss that you are claiming for under this policy from any other insurance policy, then you must claim under that policy and you will have no claim against this policy. 2 When you accept this policy you will be giving us your personal information that may be protected by data protection legislation, including but not only, the Protection of Personal Information Act, 2013 (“POPI”). We will take all reasonable steps to protect your personal information. You authorise us to (a) process your personal information to (i) communicate information to you that you ask us for. (ii) provide you with insurance services. (iii) verify the information you have given us against any source or database. (iv) compile non-personal statistical information about you. (b) transmit your personal information to any affiliate, subsidiary or re-insurer so that we can provide insurance services to you and to enable us to further our legitimate interests including statistical analysis, re-insurance and credit control. (c) transmit your personal information to any third party service provider, that we may appoint to perform functions relating to your policy on our behalf. You acknowledge that this consent clause will remain in force even after your policy has lapsed. 4.Jurisdiction This policy is subject to the laws and statutes that apply in the Republic of South Africa and we will only abide by judgments first delivered by or obtained from a court of competent jurisdiction in the Republic of South Africa. 3 YOUR PEDALCYCLE INSURANCE 3. A complaint can only arise if: • Infiniti Insurance Limited or its representative contravened or failed to comply with a provision of the Act and as a result you have or are likely to suffer financial prejudice. • Infiniti Insurance Limited or its representative wilfully or negligently rendered a financial service which caused or is likely to cause financial prejudice. • Infiniti Insurance Limited or its representative treated you unfairly. How do you lodge a complaint? Inform Infiniti Insurance Limited in writing that you have a complaint and if possible complete their Client Complaint Form. 5 DISCLOSURE NOTICE Complaints: DISCLOSURE NOTICE What happens after this? • Infiniti Insurance Limited has 3 weeks to acknowledge receipt of the complaint if we cannot resolve the complaint in that period. • Infiniti Insurance Limited must resolve the complaint within 6 weeks. What other rights do you have? If after 6 weeks Infiniti Insurance Limited has not resolved the complaint or the complaint has not been resolved to your satisfaction you may approach the FAIS Ombud within 6 months of the resolution by Infiniti Insurance Limited.
