Clarifications REPUBLIC OF KENYA MINISTRY OF TRANSPORT AND INFRASTRUCTURE STATE DEPARTMENT FOR INFRASTRUCTURE ROADS 10, 000 PROGRAMME: THE DEVELOPMENT OF 10,000KM OF ROADS SUPPORTING PRIMARY GROWTH SECTORS THROUGH CONTRACTOR FACILITATED FINANCING MECHANISM (PHASE I - 2000KM) REQUEST FOR EXPRESSION OF INTEREST (EOI) FOR CONSULTANCY SERVICES FOR THE INDEPENDENT ENGINEER. TENDER NO: MOTI/2/2014-15 1. The Government of the Republic of Kenya through the Ministry of Transport and Infrastructure represented by the Kenya National Highways Authority (KeNHA), Kenya Rural Roads Authority (KeRRA), and the Kenya Urban Roads Authority (KURA) being state corporations established under the Kenya Roads Act, 2007 has identified approximately 10,000 km of roads support the primary growth sectors of Commerce, Tourism, Agriculture Rural Production, and Extractive Industries to be upgraded and paved. The Programme is divided into three (3) phases as tabulated below: Financial Year Target/Annuity Output of roads (Km) FY 2014/15 FY 2015/16 FY 2016/17 Total 2,000 3,000 5,000 10,000 The procurement of a Project Company to Finance, Design, Build, Maintain and Transfer of the project roads under phase I packaged in Forty Five (45) Lots is in progress. 2. Broadly the scope of works will include upgrading to paved standards of gravel and earth roads and rehabilitation/reconstruction of existing paved roads including bridges, culverts, road intersections, drains, etc. The approach under this programme will be based on the Finance-Design-Build-Maintain and Transfer Contract Framework over a 10-year period. 3. The Road Authorities therefore seek to procure consultancy services of a consulting engineering firm with the capability (Qualification and experience) to assist the parties in the management of the implementation of the Project Agreement between the Authorities and the Project Company (Private Party) for the project under a Public Private Partnership (PPP) framework for Phase I. 4. The consultancy services to be provided by the Independent Engineer shall involve monitoring compliance with the terms of the Project Agreement by the parties to the contract during the concession period. 5. The Authorities, being authorized agents of the Government of the Republic of Kenya now invite eligible consulting firms to indicate their interest in providing the above services. 6. Interested firms must provide information indicating that they are qualified to perform the services (Description of similar assignments, availability of relevant knowledge and skills among staff, knowledge in Project Finance etc.). Consultants may associate to enhance their qualifications. 7. Eligibility criteria, establishment of the short-list and the selection procedure shall be in accordance with the Public Private Partnership (PPP) Act, 2013 (download from this URL: http://www.pppunit.go.ke/news/view/public-private-partneship-act-2013) 8. Association with local firms will be an added advantage during evaluation of proposals. International firms are therefore encouraged to form Joint Ventures, and Associations with local firms. 9.
