Terms and Conditions The 2015 Dayton Dragons VIP/Luxury Suite Raffle to benefit the 2015-2016 Northmont High School Color Guard/Winter Guard programs is conducted by the Northmont Band Boosters, a 501c3 non-profit organization under the laws of Ohio. The raffle is governed by the State of Ohio under section 2915.092 of the Ohio Revised Code. 1. The purchase price for one raffle ticket is $10.00 or 3 tickets for $25.00. A maximum of 400 raffle tickets will be sold. 2. Ticket entries can be purchased from a member, parent, or staff of the Northmont High School Color/Winter Guard. For your convenience you may also mail a check made payable to “Northmont Band Boosters” for the amount of the number of tickets you would like to purchase (enter “Dragons Raffle” and the # of tickets in the memo line) and mail it to Northmont Band Boosters, PO Box 42, Englewood, OH 45322 and we will complete the ticket(s) for you. Please remember to include your phone number and email address. Requests made via mail must be postmarked by midnight August 7, 2015 in order to be eligible for the drawing. 3. Tickets may be purchased with cash or check. Checks must be made out to the “Northmont Band Boosters” with “Dragons Raffle” entered on the memo line. If an entrant’s check is returned unpaid by the bank, the entry ticket(s) will be invalid unless a cash payment is received by the Northmont Band Boosters by 6:00 p.m. (Eastern Standard Time) Sunday, August 16, 2015, the official raffle deadline. Entrant will also be subject to all associated bank fees. 4. All entry purchases are final and non-refundable. 5. Entry purchases are not tax deductible as a charitable contribution. The IRS considers a raffle ticket to be a contribution from which you benefit. If you receive a benefit from making a donation, you can only deduct the amount of your donation that is greater than the value of the benefit you receive. The IRS explicitly prohibits deducting the cost of raffle tickets as a charitable contribution, presumably because it does not consider the cost of the ticket to be greater than its benefit. 6. Entrant will retain the original printed raffle ticket. The stub will be entered into the drawing and will be retained by the Northmont Band Boosters. 7. The winner of the raffle will be determined by random drawing at the Northmont Marching Band Annual Ice Cream Social on Sunday, August 16, 2015 at approximately 6:00 p.m. (Eastern Standard Time) at Centennial Park, 321 Union Blvd. Englewood, OH 45322. This information will also be announced on the Northmont Bands website at www.northmontband.org. Winner does not need to be present to win and will be contacted via the phone number and/or email address entered on the ticket stub. 8. The winner of the raffle is entitled to the following at the September 7, 2015 (Labor Day) Dayton Dragons vs. Lansing Lugnuts baseball game (game starts at 2:00 p.m.): One climate-controlled Dayton Dragons Luxury Suite (suite location shall be at the sole discretion of the Dayton Dragons organization) including 20 tickets to the game, a flat-screen TV, leather furniture, high top tables with bar stools, and a semi-private restroom. Approximate Retail Value: $995. Two VIP parking passes. Approximate Retail Value: (included with Luxury Suite). One voucher to choose one Meal Deal value menu item (serves 15 people). Approximate Retail Value: $349. Winner shall confer with the Dayton Dragons organization to make arrangements for food and any other details related thereto. 9. Winner will assume and be responsible for all gratuities, incidentals, and all other fees, and local, state, and federal taxes, including but not limited to all applicable sales, use, luxury, income, and special taxes associated with winning this raffle. The Northmont Band Boosters specifically disclaims all expressed or implied warranties, including without limitations warranties of merchantability. In addition, the Northmont Band Boosters is not responsible for any losses or injuries suffered as a result of accepting the prize. 10. Winners agree to comply with all IRS regulations regarding raffle winnings. The winner agrees to furnish the Northmont Band Booster Treasurer or Assistant Treasurer with his/her social security number, verify his/her identity, and sign all required IRS documents if necessary before claiming the prize. 11. The winner of the raffle must claim the prize within 7 days of the drawing. If the winner does not claim the prize within 7 days of the drawing, by responding to telephonic or written notice from the Northmont Band Boosters or otherwise, the prize will be forfeited and a new winner drawn. After the prize is claimed, winner must abide by any restrictions or regulations placed on the prize by the Dayton Dragon’s organization (e.g., rain out policy, age restrictions, etc.). 12. Purchasers of raffle tickets must legibly write their full names, addresses, email, and telephone numbers on each individual ticket stub. If the contact information on the ticket stub is deemed illegible, another ticket stub will be drawn. If more than one name is stated on a ticket stub, the first listed name shall be the Entrant. The Northmont Band Boosters shall, will and can have no obligation for payment or delivery of any prize to any person other than the Entrant. It is the sole responsibility of the Entrant to allocate any such prize among the participants in any multiple party entry. 13. Any drawing may be postponed due to weather or any state of emergency declared by the Mayor of Englewood, The Governor of Ohio, or the President of the United States. In such event, a new date, place and time for the drawing will be determined by the Northmont Band Boosters, which will be announced on the Northmont Bands’ website. 14. Purchasers of tickets, by participating in the raffle, release the Northmont Band Boosters, its directors, officers, members and agents from any and all liability, loss or claim arising out of any raffle prize, expressly waive any such claim and agree that the liability, if any, of the Northmont Band Boosters, its directors, officers, members and agents shall be limited to the raffle ticket price paid. The Northmont Band Boosters makes no express or implied warranty as to the raffle prize. 15. Any and all disputes, claims and controversies concerning this raffle shall be submitted to and resolved by binding arbitration, to be conducted under arbitration rules in the state of Ohio. 16. Prize is not redeemable for cash. 17. Raffle is void where prohibited. 18. Winner(s) agree to allow the Northmont Band Boosters to publish their names and photographs.
