AN OPEN LETTER TO THE GOVERNORS OF ST BEES SCHOOL

"We aim for continued provision of education
on St Bees School site under a new. more
transparent governing body which is engaged
with the local community."
Save St Bees School Campaign,
St. Bees,
Cumbria.
AN OPEN LETTER TO THE GOVERNORS OF ST BEES SCHOOL
On March 13th 2015 you announced your intention to close St Bees School with
the loss of around 150 jobs, with 300 children having to seek their education
elsewhere at unacceptably short notice and with no impact assessment on the
local and wider community.
You also took this action under a cloak of secrecy - without consulting with staff,
a legal requirement under the Employment Act, without consulting with the
charity’s stakeholders, contrary to Charities Commission Guidance 2010,
without attempting any effective fundraising and without proper consideration
of credible attempts to keep the school open, again contrary to the Charities
Commission Guidance 2010 where closure is noted as being the last resort.
The School’s objectives include "other associated activities for the benefit of the
community". As of today you still have not formally notified representatives of
the Community such as the Parish Council Committee, Local or County councils
or the former MP of your decision to close nor have you consulted with them.
Instead what you did was mislead stakeholders and the Rescue Team in terms of
the timing of the EGM, in respect of your comments about the finances and the
markets and in not giving access to vital information to the Rescue Team as you
indicated you would do. Instead it seems that your efforts were to ignore or
delay the rescue attempts, not only by the Rescue Team but also several other
options including a free school, Keswick merger and international schools.
Whilst the Rescue Team and others were finding a way to keep the school open,
you were hastily terminating contracts of employment and supply and rushing to
sign over the pupils to other schools, making rescue harder.
You did not undertake any impact assessment of the consequences of your
actions on others. As a direct result you have motivated parents, alumni and
members of the community to demand your resignation and to complain to the
regulator, the Charities Commission. The Charities Commission have
consequently launched an investigation into your actions, actions which have
severely damaged the school's reputation and damaged the wider reputation of
charities as consultative bodies.
We now demand the board of Governors resign with immediate effect.
This letter is accompanied by a petition, which supports our demand for your
resignations, signed by over 1,000 people representing parents, alumni, pupils
and the wider community.
Quite simply, as Governors you have lost the trust and confidence placed in you
"We aim for continued provision of education
on St Bees School site under a new. more
transparent governing body which is engaged
with the local community."
Save St Bees School Campaign,
St. Bees,
Cumbria.
by the school's stakeholders and your position has become untenable.
In addition, in the interest of openness and transparency, we would request you
answer the following questions:
Firstly, why there was no serious consideration given by the board to the options
for keeping the school open, especially given the Rescue Team and the Society of
Old St Beghians managing to secure a £2m funding package?
Secondly, even though it was apparent from the 2013 accounts that the school
was making losses, why did you continue to increase the level of bursaries and
invest in facilities and infrastructure instead of reducing overheads and
undertaking effective fundraising?
Thirdly, how much is the closure of the school costing? Considering the cost of
the termination of employment contracts, enhanced severances for employees to
waive their rights, the costs of advisors including a consultant brought in
specifically to close the school, the employment of a PR company and lawyers
fees to sue a parent for using a publicly available photograph on his Facebook
site in support of the school. The significant financial loss you have created will
damage the charity severely.
We are now demanding a new set of Governors are installed in order to give full
and fair consideration of the future of St Bees School. This new board will engage
with all stakeholders to find a way of keeping the school open and retaining its
future as a centre for education excellence - whatever form that may take.
Your behaviour has been shameful; reminiscent of some sort of 'secret society'.
We suggest that in order to retain some semblance of dignity, as a Board, you
resign with immediate effect and let others who are more engaged with
stakeholders take your place.
Save St Bees School Campaign and over 1000 others.

It no longer appears that the Governors of this school have been dealing with
anyone in good faith. The attempts to undermine the negotiations and the halfhearted excuses regarding stability and ' for the good of the students' no longer
rings true.
They governors should resign immediately and allow individuals in which the
majority can have confidence in that negotiations are being held with integrity.

The decision to close the school, despite the money being available to retain
the school for a further year is outrageous. Risk is an issue, but parents are
able to make decisions based on their own circumstances as to whether they

There has been neglect since the year 2000. Senior managerial ructions were
stewarded with woeful inadequacy. Letters to the chair were unanswered. The
governors remained remote making little or no attempt to enter, spend time in,

few of the members of staff by name, visited infrequently, and were regarded
as a joke by the majority of my colleagues, because of their lack of interest in

unfit to decide what should happen at St Bees School. They decide to buy a
brand new minibus when a second hand one would have served just as well
when the school could ill afford it. Just one of the many bad decisions. Time to
resign and leave the future education of the pupils to people who actually care.

The Board of Governors have mismanaged the school's affairs to reach this
point. A dedicated and professionally minded rescue team has mobilised and
drawn up a short term plan, which could allow time for the development and
implementation of a long term solution. There is no guarantee of success, but
rejecting the plan gives only the option of failure. If the governors are not

It is clear that the governors considered no serious attempt to save the school.
Their announcement was timed to allow very little time for supporters to rally
and come up with the funds to keep the school afloat while options were
considered. Once word was out, stakeholders rushed to save the school -- and
they are unwilling to work with them. I attended the school for only one year as

offering a way forward subject to rescindment. What reason was there to say

I write as a former teacher at the school (2001-2009). The Governors have
demonstrated time and time again that they are not a fit and proper body to be
taking such decisions.
Others with more vision and dynamism deserve the chance to take the school
forward. The Rescue Team have made a compelling case and would
undoubtedly be capable of much more, given the opportunity.

As a parent of a pupil affected by the Governors single minded determination to
Kingdom
close the school in the face of well researched and credible alternative plans to
save the school I agree that the only way forward is for the chair and his
colleagues resign and allow a younger, able and more capable team take over.
The notice of closure can then be rescinded and a plan for recovery put in
place.

My husband and I are parents of a 4th Form student and we were fully
prepared to assume the "risk" associated with the Rescue Team's welldeveloped business plan. It appears that the governors were aware of the
problem for the past couple of years so why did they let new families like
ourselves enrol our children in Sept 2014? How is closing the school
immediately better for our son who will now encounter a major disruption to his
GCSE studies? Our children's well-being has NOT played a part in the
governors' decision; current parents were completely unaware of this situation
and their help/advice to overcome it was never solicited!

The school should definitely remain open with a new set of govenors who are
young, with business and legal experience who have the drive to make the
school work again. Windermere St Annes School had similar problems a few
years ago, and with a new chair of govenors and governing team they pulled
the school back from the brink to be a very successful school again. A new
Chair with endless drive and excellent business awareness is now required
urgently by St Bees

The Governors have not acted in the best interest of the pupils and staff
announcing this just weeks before the end of Easter term with few available
jobs left and now a very disrupted and hijacked revision time before public
exams begin at the start of May. At the very least they could have given the
well funded, well support Rescue Team the opportunity to develop a proper
way forward. We have lost all confidence in their leadership and
trustworthiness to represent and care for St Bees School.

1.This is has been handled in an unjust manner
2. There is a viable way ahead if the governors will take it by either resigning or
appointing members of the rescue team to the board alongside them. Spaces
exist on the board.
3. West Cumbria will suffer and there will be numerous knock on effects such
as reducing the attractiveness to those wishing to work in the area from

St Bees school year end accounts (a legal document) stated there the finances
were not expected to affect the medium or long term strategy of the school.
Less than a year later school closure announced due to dwindling pupil
numbers despite 7 months earlier it being stated that St Bees school was
"bucking the national trend" for falling pupil numbers. A full 32 page rescue
plan formulated in less than a month by key business personnel. Plan included
viable long term future for the school with support from many other parties.
Plan rejected by governors and letter sent to parents to reaffirm closure of
school during meeting between governors and rescue team. As trustees of the
charity they have completely failed their beneficiaries and not fulfilled legal
responsibilities.
