AN OPEN LETTER TO THE GOVERNORS OF ST BEES SCHOOL On March 13th 2015 you announced your intention to close St Bees School with the loss of around 150 jobs, with 300 children having to seek their education elsewhere at unacceptably short notice and with no impact assessment on the local and wider community. You also took this action under a cloak of secrecy - without consulting with staff, a legal requirement under the Employment Act, without consulting with the charity’s stakeholders, contrary to Charities Commission Guidance 2010, without attempting any effective fundraising and without proper consideration of credible attempts to keep the school open, again contrary to the Charities Commission Guidance 2010 where closure is noted as being the last resort. The School’s objectives include "other associated activities for the benefit of the community". As of today you still have not formally notified representatives of the Community such as the Parish Council Committee, Local or County councils or the former MP of your decision to close nor have you consulted with them. Instead what you did was mislead stakeholders and the Rescue Team in terms of the timing of the EGM, in respect of your comments about the finances and the markets and in not giving access to vital information to the Rescue Team as you indicated you would do. Instead it seems that your efforts were to ignore or delay the rescue attempts, not only by the Rescue Team but also several other options including a free school, Keswick merger and international schools. Whilst the Rescue Team and others were finding a way to keep the school open, you were hastily terminating contracts of employment and supply and rushing to sign over the pupils to other schools, making rescue harder. You did not undertake any impact assessment of the consequences of your actions on others. As a direct result you have motivated parents, alumni and members of the community to demand your resignation and to complain to the regulator, the Charities Commission. The Charities Commission have consequently launched an investigation into your actions, actions which have severely damaged the school's reputation and damaged the wider reputation of charities as consultative bodies. We now demand the board of Governors resign with immediate effect. This letter is accompanied by a petition, which supports our demand for your resignations, signed by over 1,000 people representing parents, alumni, pupils and the wider community. In addition, in the interest of openness and transparency, we would request you answer the following questions: Firstly, why there was no serious consideration given by the board to the options for keeping the school open, especially given the Rescue Team and the Society of Old St Beghians managing to secure a £2m funding package? Secondly, even though it was apparent from the 2013 accounts that the school was making losses, why did you continue to increase the level of bursaries and invest in facilities and infrastructure instead of reducing overheads and undertaking effective fundraising? Thirdly, how much is the closure of the school costing? Considering the cost of the termination of employment contracts, enhanced severances for employees to waive their rights, the costs of advisors including a consultant brought in specifically to close the school, the employment of a PR company and lawyers fees to sue a parent for using a publicly available photograph on his Facebook site in support of the school. The significant financial loss you have created will damage the charity severely. We are now demanding a new set of Governors are installed in order to give full and fair consideration of the future of St Bees School. This new board will engage with all stakeholders to find a way of keeping the school open and retaining its future as a centre for education excellence - whatever form that may take. Your behaviour has been shameful; reminiscent of some sort of 'secret society'. We suggest that in order to retain some semblance of dignity, as a Board, you resign with immediate effect and let others who are more engaged with stakeholders take your place.
