And, I have two words for you – “Well done!” Working together in an economy that, according to some, rivals the Great Depression, you have survived, and in many ways thrived. You have given unselfishly of your time and energy through committees, task forces, events, Ambassadorship and Board positions. One of the Chamber’s new programs this year is Business Boot Camp, the newest addition to the Economic Gardening program, which began in September 2009 with 12 businesses. Graduates gave rave reviews of this program and the Chamber is excited to be offering it again in September 2010 (see page 19). The Castle Rock Stars Young Professionals group is moving right along with great networking and innovative ideas. The Chamber continues to offer several networking opportunities for its members through Business Over Breakfast and Business After Hours events, which are always great for making new contacts and building business relationships. The Chamber continues to promote the community with its numerous local events and is also emphasizing the wide variety of things to see and do in the community through marketing and branding of local attractions and recreation to tourists. Many family-friendly activities rounded out the Showcase. In its third year, the vehicle exhibit, Touch-a-Truck, featured antique, commercial and public vehicles for kids and adults to explore. New this year at Touch-a-Truck was a climbing wall and a Fun Bus with fitness activities for kids. Demonstrations by the Castle Rock Fire Departments and the Castle Rock n’ Rollers roller skating derby league; strolling mascots such as the Chick-fil-A cow, Douglas County Libraries’ dog, Yogi Bear from Yogi Bear’s Park, Allstate’s bear and Sports Clips’ giant referee, were a few of the many special entertainment venues. Vendor judging, decided by volunteer Showcase judges included Best of Show – Henry and Robinson, attorneys at law; Best Promotion of a Business – Everything Alpaca; Best 21st Century Connection – Douglas County Libraries; Most Friendly Business – CertaPro Painters and Most Creative/Coordinated Booth – Black-eyed Pea. Some of the essential criteria for being recognized are the length of time a business has supported the Chamber – ten consecutive years or longer - through its membership, participation and sponsorship. Something the Castle Rock Bank has in “spades”. The Castle Rock Bank has been a stalwart supporter of the Chamber since 1983, the same year that Thomas J. Miller moved from La Junta, Colorado where he was also heavily involved with that chamber. Mr. Miller, a graduate of the University of Northern Colorado, has been responsible for the successful management of Castle Rock Bank for the past 26 years, contributing in immeasurable ways to this Chamber and the community. In 1988, Tom also founded what is currently known as the Castle Rock Chamber Ambassadors. Originally called the Chamber Rockers, this group remains an essential part of Chamber activity; composed of business owners who volunteer their time mentoring new business members and serving in various capacities for the Chamber. Miller, CEO and Chairman of the Castle Rock Bank Board since 2001, believes Castle Rock Bank has been successful partly because of its involvement in the community such as hosting the Taste of Castle Rock, the pancake breakfast at the Douglas County Fair, participating in the 4-H Junior Livestock Sale and serving as a major sponsor of Starlighting, a favorite community tradition organized by the Chamber. He said the bank has also been successful because it caters to the needs of local residents. Looking to the future, Miller says the bank plans to improve service to its customers by adding other branches in the Castle Rock area. Land has been purchased just south of the King Soopers grocery store on Ridge Road in Founders Village. No definite timetable has been set for construction of the Founders Village branch. “Right now we are just … trying to do everything we can to better serve our customers,” Miller said. That sums up the why Castle Rock Bank, its leadership and staff have earned recognition as an outstanding business in Castle Rock. Ruben Estrada, Founder of Estrada Strategies, a business development company, stated, “Even in the toughest economy Mike has made an amazing impact on the Metro Denver small business community, and that is the primary reason we are recognizing Mike with this award. Last year alone, Mike Tafoya coached, trained and monitored over 200 businesses in several venues. Mike is the official trainer for the Small Business Administration (SBA) e200 business training and leadership program. The e200 program is the flagship training program for SBA nationally, and Mike Tafoya has championed this effort in the Denver Market place. Along with all of Mike’s programs, this program is designed for established business owners with a minimum of 5 employees who are committed to growing their businesses. After working with CoWest Insurance Group for several years as a minority owner, she became the principal owner by purchasing it from its founder six years ago. Since that time Laurie has grown the business significantly, making the company one of the largest independent agencies in the State. Laurie was voted the 2007 Insurance Person of the Year by the Professional Independent Insurance Agents of Colorado, and later was asked to serve on its prestigious board. Council also amended the ordinance to allow one sign per business. In other words, in buildings or areas where there is more than one business, more than one sandwich board sign can be displayed. Several business owners spoke before Council, touting the many benefits of sandwich board signage to their businesses, including the freestanding signs help to bring their businesses into the line of site of those passing by. Because the ordinance was approved on emergency adoption, the sign code changes are immediately in effect. Ryan Reilly appointed Mayor; Chip Wilson, Mayor Pro Tem Two new Town Council members were sworn in at the April 13 Castle Rock Town Council meeting. Once installed, the seven-member Council elected Ryan Reilly to serve as Mayor and Chip Wilson as Mayor Pro Tem. Both are one-year terms. Reilly first was elected in 2005, most recently serving as Mayor Pro Tem. He represents District 3, which includes Red Hawk and parts of The Meadows, where he and his family reside. Originally from Yonkers, New York and raised in Ridgewood, New Jersey, Reilly moved to Castle Rock in 2002. He works as an independent software developer. Wilson represents District 4, which includes downtown and Castle Rock North. He first was elected to Town Council in 2008. Born and raised in Massachusetts, Wilson moved with the Army to Colorado in 1988. Currently, he is a manager for United Airlines. His wife is a third-generation Castle Rock resident and Wilson and his family resides just outside of the Craig and Gould neighborhood. The two new Council members are Brian Logan, District 2, and Clark Hammelman, District 6. They replace Mayor Randy Reed and Councilman Douglas Lehnen, respectively, who both were ineligible to run due to term limits. Public Invited to May 5th Centennial Airport Noise Roundtable In an effort to gather as much input from the public as possible the Centennial Airport/Community Noise Roundtable (CACNR) will hold a public hearing to identify and discuss aircraft-related noise issues. The meeting is on May 5, 2010 at 7:00 p.m. at the Ramada Hotel and Suites adjacent to the Air Traffic Control Tower at 7770 S Peoria St, Englewood, CO 80112. The purpose of this public hearing is to determine if the Centennial Airport Community Noise Roundtable has addressed all community concerns regarding noise at Centennial Airport. Light-timing changes improve travel on Plum Creek Parkway Drivers traveling on Plum Creek Parkway should experience fewer delays now that traffic lights along the stretch have been retimed to account for new road segments and a redesigned interchange. The Town aims to update traffic signal timings every three years to adjust for population increases or when a significant roadway improvement is made. In this case, Plum Creek Parkway was expanded to both the east and west last year as part of the Southeast and Southwest Arterial Connection Road projects. During the construction, the parkway’s interchange with Interstate 25 also was redesigned to a standard diamond interchange. The improvements changed traffic volumes and distribution patterns in the area. Education reform groups and environmental coalitions have made great strides in making Colorado a model state. Unfortunately, that is not the case for business groups. The business community has seen several pieces of legislation that stifles growths, increases reporting mandates, and makes business in Colorado less attainable for both small and big companies. Early in the legislative session businesses watched helpful tax credits disappear as one method to help balance the state’s budget. Although many hoped this would be the end to the unfriendly environment to business in the state several bills were introduced that added “salt to the wound”. RENT CONTROL/HOMEOWNER ISSUES Several bills dealing with rent control and landlord/tenant relationships have seen support from Democratic leadership in the Senate, making it a priority for their platform leading into election season. Rep. Kagan, D - Denver and Sen. Boyd, D – Lakewood, sponsors for HB 1017 have the bill close to the finish line, this would allow for voluntary agreements between a county and developers to enter into an affordable housing agreement. Those opposed to the bill claim that voluntary agreements are currently allowed and places additional and unnecessary pressure on private developers. SB 185 (Senate President Shaffer, D- Boulder and Rep. Merrifield, D – Colorado Springs) makes modifications to Residential Warranty of Habitability to favor the renters. Should the bill pass, a written notice is no longer required before the breach of warranty. Republicans speaking against the bill say that it tips the scales too far in favor of the tenant- in what is already a renter friendly system. Furthermore, the bill allows for county courts and small claims courts to provide injunctive relief related to a breach of contract. This could likely cause a substantial backlog in the court system. ENTERPRISE ZONE This legislative session has seen an increased focus on enterprise zones- as to whether they work appropriately, if they are abused by businesses and whether recertification is needed. HB 1200 (Rep. Hullinghorst, D- Boulder- Sen. Heath, D- Boulder) caps the amount one can receive under an enterprise zone to $250,000 for years 2011, 2012 and 2013. This bill is still in Finance committee and votes are close, but will likely pass to the floor. Rep. Judd, D – Denver, hopes to eliminate several of the tax credits that exist under enterprise zones under HB 1396. Those tax credits include the job training credit, new business facility credits, investment tax credits and many more. This bill has yet to be acted on in its first committee. Almost all of the testimony has been in opposition to this bill but Rep. Judd sits as the chair of Finance, where the bill is assigned. Democrats will face a tough decision as to whether or not they will kill his bill, in his committee. HB 1107 (Rep. Fischer, D- Fort Collins and Sen. M Carroll, D- Aurora) makes modifications to the existing Urban Renewal Authority (URA) statutes. Under this legislation, waiting for the Governor’s signature, it prohibits agricultural land to be within a URA except under a few exceptions. This bill will impact land development companies as they look for additional land that would loosely qualify as “agricultural land”. INCREASED MANDATES HB 1269 (Rep. Levy, D- Boulder and Sen. Carroll, D- Aurora) allows for a plaintiff in an employment discrimination case to receive compensatory 16 and punitive damages plus the additional compensation under current law including front pay, back pay, reinstatement, plus other mechanisms for equitable relief. This means that more cases will likely go to jury trial rather than a settlement, increases cost for all. HB 1012 by Representative Pace,D -Pueblo and Sen. Morgan Carroll, DAurora came from last year’s discussion regarding Pinnacol Assurance. The bill essentially limits the ability for an employer to use surveillance under worker’s compensation claims. This legislation could like impact insurance companies significantly causing the cost of worker’s compensation to increase drastically. Also, related to the Pinnacol Assurance is HB 1009 which adds 2 members to the board and they must represent non-management levels. As a likely precursor to a construction defect, HB 1162, Retainange Construction Contracts, Rep Soper, D- Adams County, prohibits retaining more than 5% of payments that are due to a contractor until half of the project is done. A managing contracting firm would be required to deposit retainange into an interest bearing account that a sub-contractor could access through in arbitration through a court order, should the contractor fail to make payment. MORE TO COME…… Although less than one month left in session there looms several bills that could impact businesses in a very negative way. Rep. Peniston, D- Westminster is bringing a bill that will establish a pay equity commission within the Department of Labor and Employment. The Commission would be charged with educating employers in the state about issues around pay inequalities, encouraging equal pay, implementing equal pay best practices, studying other states that have achieved pay equity as well as many other tasks on this issue. House Majority Leader Weissmann, D- Louisville, is currently working on legislation, although not yet introduced, that would over the course of 10 years repeal most of the current income tax credits and sales and use tax exemptions. Some of the tax credits that are at risk of being eliminated include: Instream Flow Incentive, sales and storage use for construction and building materials, the child care tax credit, conservation easement tax credit, job growth incentive tax credit and many more. Construction defect legislation could be moved forward this session or possibly next, assuming Democrats maintain control which would place construction companies, business groups and several stakeholders at increased risk for unequal liability. With 29 days left in the legislative session business coalitions are strategically looking as to where they can be most effective as well as prioritize those bills that will cause the most determent to their organization and business. Groups consistently distribute fact sheets, relay compelling stories of small businesses down-sizing, and convey that legislation will force Colorado’s economy into a downward spiral with little to no traction from legislators. We ask that the business community speak-up and let their leaders know how anit-business bills impact them and their employees. Text-A-Tip (students can text anonymous tips to alert officers to potential issues in the schools) began from this program last March and other agencies are modeling it. Steering Committee Planner: Lt. Kevin Duffy (Leadership Douglas County Class of 2009) Did you know that Castle Rock’s Chief Lane is the longest serving police chief in the state of Colorado? Or that traffic ticket revenue does not automatically go back to the agency who wrote the ticket? For instance, CHP ticket revenue goes towards highway maintenance. These are just two of the many things that the Leadership Douglas County class learned on Law Enforcement Day. On Wednesday, April 7th, the current class met at the Douglas County Sheriff’s Office and heard, once again, about the reoccurring theme of collaboration. The day began with a welcome by several leaders in the law enforcement field (including Sheriff Weaver, Chief Lane from Castle Rock and Chief Hasler from Lone Tree) who all agreed that with budget reductions and cost saving measures, collaboration between organizations, volunteers and the community is the best it has ever been. The leaders reinforced the idea of partnerships, including partnerships between law enforcement agencies as well as partnerships between law enforcement and citizens. The day would not be complete without demonstrations given by the K-9 Team and the various hands-on activities. One activity which proved very insightful to see just how hard it can be to anticipate actions of potential criminals was a simulated full-scale interactive video. Reactions to the scenarios were a matter of life and death. This simulation exercise is one of many hands on exercises that officers utilize for training. “This day was both eye-opening (the jail tour), gratifying (the vision and dedication of our local law enforcement), inspiring (the commitment of the volunteers), and finally and most of all - a lot of fun (the K-9 demo, and Range Shooting.) Amendment 20 was passed in 2000 allowing persons to possess and use marijuana to treat some medical conditions without fear of criminal prosecution. Between June 1, 2001 and August 31, 2009, there were 14,377 state registry cardholders with only 27 applications denied. By January 1, 2010, there were 30,000 cardholders!
