Explanatory Note
The County Council is required to provide a minimum of 28 days’ notice for all key decisions to
be taken by the County Council, the Cabinet, the Cabinet Members and by officers under their
delegated powers. The Forward Plan also provides information on all forthcoming key decisions
over the following four-month period. Key decisions to be taken in the current month are also
listed in font colour blue.
The Forward Plan is updated monthly and is available 28 days before the beginning of each
month on the County Council’s website www.westsussex.gov.uk. It is also available from County
Hall in Chichester, from all Help Points and the main libraries in Bognor Regis, Crawley, Haywards
Heath, Horsham and Worthing
Key decisions are those which:
 Involve expenditure or savings of £500,000 or more (except decisions taken by the
Executive Director of Corporate Resources and Services under delegated powers in
connection with treasury management)


The Performance Framework sets out the goals set in the Future West
Sussex Vision.
The Budget Book details the County Council's revenue budget, the
nature of its expenditure and income, its medium term financial
strategy and its capital programme.
The Cabinet (and full Council)
The Cabinet on 27 January 2015 will consider the draft Performance
Framework, Revenue Budget and Capital Programme for 2015/16.
County Council will consider and approve the final Revenue Budget and
Capital Programme for 2015/16 on 13 February 2015.

Decision
Proposed extension of the Think Family Programme from 2015
to 2020
In February 2013 the Cabinet Members for Children & Families and
Finance & Resources took a decision to approve the model for
extending the Think Family Programme to be delivered in 2013 – 2015
and that £11million of funding be allocated from the Early Intervention
Reserve to deliver the programme over that period.
An extension from April 2015 to March 2016 for the next phase of the
Troubled Families Initiative within the original budget is now
requested, along with the agreement to participate in principle in the
National Troubled Families Programme until March 2020.

Further extension of a Service and funding agreement between
West Sussex County Council and Sussex Partnership Foundation
Trust for the provision of a Child and Adolescent Mental Health
Service (CAMHS) to 31 October 2015 and to commence any
required procurement of a new service to take effect from 1
November 2015
In March 2014 a decision was taken to extend the funding agreement
between the County Council and Sussex Partnership Foundation Trust
for CAMHS until the end of the 2014/15 financial year and to
commence a procurement process for a new contract(s) to begin from
1 April 2015 (decision reference CH26(13/14)).
Another extension, for a further 6 months until 31 October 2015, is
requested because more time is required to analyse the results of the
comprehensive needs assessment that was undertaken to evaluate
revised requirements for a young person’s emotional health and
wellbeing service in West Sussex, take due account of this and redesign
services. The contract between West Sussex County Council and
Sussex Partnership Foundation Trust is one element of the emotional
wellbeing and mental health support available to young people.
However, the review and redesign process currently in train is
considering the totality of the service model hence the time needed. An
options appraisal will also be undertaken with a view to the redesign or
reprocurement (either partially or totally) and any required
procurement will be undertaken for the new service from November
2015.
The Cabinet Member will be requested to approve the extension of the
funding agreement to 31 October 2015 and the commencement of any
required procurement of a new service from 1 November 2015.

A full need assessment is currently being undertaken, which consults
with service users, parents and professionals. A briefing for County
Councillors took place in November 2013 and June 2014 and a Scrutiny
Task and Finish Group has been set up to scrutinise the current
provision and plans for the future delivery of Children’s and Young
People’s Emotional Wellbeing and Mental Health Services, which
includes CAMHS. The Cabinet Members for Finance and for Community
Wellbeing will be consulted.

Anti-Bullying Strategy
Bullying is an important topic for the County Council and there is a
commitment to review the 2008-2011 Strategy and to gain the status
this important topic warrants across wider services. There is an
impressive array of work being delivered by the County Council in
relation to Anti-Bullying and support for people across West Sussex is
good. There is, however, a need for improved co-ordination of
resources, strategic guidance and joined up collaboration of this work
between the Children’s and Learning Service as well as other County
Council Services. A decision therefore is required to approve and
implement the new Strategy.

West Sussex County Council Code of Conduct in Respect of
Penalty Notices for Parents of Truants (Anti-Social Behaviour
Act 2003)
Sections 444A and 444B of the Education Act 1996 enable local
authorities, senior staff in schools and police officers to issue penalty
notices to the parents of children whose level of attendance at school is
unacceptable.
The West Sussex County Council Code of Conduct ensures that the
powers are applied consistently and fairly across West Sussex and are
administered effectively.
If the penalty notice is not paid in full by the end of the 28 day period,
and the notice has not been withdrawn, the Local Authority will
prosecute for the school attendance offence. The prosecution will not
be for non-payment of the notice. The prosecution will follow the usual
procedures for any prosecution of parents over irregular attendance
under section 444 of the Education Act 1996.
It is proposed that the Code of Conduct is amended to allow the County
Council to consider issuing a caution for the non-payment of the
penalty notice rather than solely using prosecution. Also it is proposed
that in circumstances where parents are given 15 schools days in which
to improve the situation to an acceptable standard this is removed.
Schools will warn all parents of pupils within their establishments that
Penalty Notices will be sought for unauthorised absence. This warning
can be stated in school attendance policies, newsletters etc. Prior to
submitting a request to Education Welfare for consideration of a
Penalty Notice the school will write to the parent to notifying them of
this course of action.

West Sussex Scheme for Financing Schools and Formula Review
2015/16
As a result of the government’s review of 2015/16 formula changes
made under School Funding Reform, further changes will be made to
school funding arrangements in 2015/16. The changes will affect the
distribution of funding to primary and secondary schools. There will
also be changes funding arrangements for pupils with high needs
educated in special schools or alternative provision.
There is a protection mechanism that will apply for 2015/16 to support
schools in managing changes to their budgets.
Formal consultation on the proposed changes to the formula for primary
and secondary schools and changes to high needs funding
arrangements will take place through governing bodies and the
statutory Schools Forum.
Some local Members serve on school governing bodies and others may
receive representations from schools in their local communities.
The Cabinet Members will be asked to approve the funding formula for
schools for 2015/16.

To form a pool for local business rates provided that the arrangement
would result in a reasonable financial gain as assessed from the
business rate information provided by the District and Boroughs.
Under the Business Rate Retention System of funding local authorities
can seek to be designated as a ‘pool’, which means multiple authorities
can be treated as a single entity for their tariff, top-ups, levies and
safety net payment calculations required under the business rate
funding system.
Under a pool, the levy rate (i.e. the payment back to Government)
incurred for strong local growth in business rates may be reduced, and
hence there is potential for more business rates to be kept locally. The
Pool would involve the County and several of the District/Borough
authorities within West Sussex.

Approval to submit a business case to Coast to Capital Local
Enterprise Partnership for the Lyminster Bypass Scheme
In July 2013, the Cabinet Member for Highways and Transport approved
the County Council’s Strategic Transport Investment Programme (STIP)
to identify and develop strategic (i.e. larger than local) transport projects
which are needed to support sustainable economic growth in the County.
The Lyminster Bypass scheme was identified in the STIP as a priority
requiring investment by the County Council. Following this decision, the
Coast to Capital Transport Body (LTB) has allocated £3m to the scheme
subject to the submission of an acceptable business case and resources
have been allocated to progress the design, environmental impact
assessment and preparation of a transport business case for the scheme.
Following the completion of preliminary designs and EIA, a
recommendation will be made to the Cabinet Member for Highways and
Transport for approval to:
Submit a business case for the scheme to the Coast to Capital Local
Enterprise Partnership. Following this the County Council will submit a
planning application for the scheme and Undertake land acquisition for
the scheme.

Approval of the submission draft Shoreham Harbour Joint Area
Action Plan
The Shoreham Harbour Joint Area Action Plan (JAAP) is being prepared
jointly by the County Council, Adur District Council and Brighton &
Hove City Council for an area which stretches from the Adur Ferry
Bridge in the west through to Hove Lagoon (in Brighton & Hove) in the
east. Once adopted, the JAAP will provide planning policies against
which applications for development in Shoreham Harbour will be
assessed to deliver local aspirations for regeneration.
The submission draft JAAP envisages a wide ranging regeneration
focussed on four development areas which will lead to creation of
1,450 new homes, new employment floorspace, a consolidated port,
improved flood defences, transport infrastructure, public spaces, and
community and leisure facilities.
The key issue for the County Council as the Mineral Planning
Authority/Waste Planning Authority is the presence of active mineral
wharves and waste management facilities in the area covered by the
submission draft JAAP which are currently safeguarded by policy 40 of
the Minerals Local Plan 2003 and policy W2 of the West Sussex Waste
Local Plan April 2014. The approach to wharf safeguarding will need to
be based on expected future demand. Therefore this links to the
production of a new Minerals Local Plan which is programmed to be
published for consultation in 2015.
The Cabinet Member for Highways and Transport will be asked to
recommend the submission draft Shoreham Harbour Joint Area Action
Plan to be approved by full council. Once approved, the submission
draft JAAP will be published in early 2015 for a period of
representations before being submitted to the Secretary of State for
examination.

Decision to approve the approach to spending the £2.5M
Superfast Extension Programme funding
The funding comprises £1.25M of central government grant matched
by £1.25M of WSCC funds. The funding is to improve access to
superfast broadband in West Sussex, value for money will be key. The
decision will also be seeking delegated authority for any legal
agreement that may be required.
West Sussex County Council has previously committed £6.26m
towards its Better Connected project in partnership with BDUK
(Broadband Delivery UK, the government department responsible for
broadband policy) and BT. This has been matched by central
government funds of £6.26m. The project builds on the continuing
commercial deployment of better, faster broadband in the county and
means that by spring 2016 more than 90% of properties in West
Sussex will have access to NGA superfast fibre-based broadband
infrastructure of a minimum of 24Mbps. All properties in the areas
which are eligible for funding through the project should be able to
access basic broadband speeds of a minimum of 2Mbps.
The Superfast Extension Programme is a £250m central government
fund to increase the availability of superfast broadband to 95% of the
UK by 2017. On Tuesday 25 February 2014 central government
announced allocations for all Local Authorities; West Sussex was
allocated an additional £0.86m towards reaching the target of 95%
coverage with the requirement that the funding must be matched by
local or European public monies.
Subsequent to this West Sussex requested an additional 0.39M grant
funding (making a total request of £1.25M) which was agreed by
BDUK; This was matched by the Cabinet; total funding for the
Superfast Extension Programme is therefore £2.5M.

Support Services Outsource Contract Additional Service
In June 2012 the County Council signed a 10 year contract with Capita
for the provision of Support Services. As part of the contract there
was an expectation that further Support Services from across the
organisation could be considered for inclusion in the contract. This
decision relates to the potential transfer of the County Council’s
Income and Banking function as an additional service and the
Executive Director of Residents Services entering into a contractual
agreement with Capita, within the scope of the original Official Journal
of the European Union (OJEU) notice. The Income and Banking Team
ensures that the income received by the County Council is processed
correctly and accurately and that debts are recovered and processed
promptly within agreed procedures, along with providing a quality
service relating to all banking activities of the County Council. The
decision will be informed by the outcome of the review process as set
out in the Cabinet Member Key Decision report (link).
