Exhibitor Contract Terms A. Booth/Table Space 1. The Great Lakes Comic-Con will provide a 10’x10’ aisle booth area for exhibitor with (1) 8’ table, (1) chair and (2) badges. 10' x 10' corner booths will be provided with (2) 8’ tables, (1) chair and (2) badges. All booths are 10' x 10' with an 8' high curtained backdrop. Artist Alley tables are 8 feet in length, with (2) chairs and (2) badges, and five feet of space behind the table with no curtained backdrop. Please Note: Vendors are permitted to bring their own additional tables or chairs to the Comic-Con. However, vendors must ensure that the bottom/feet of the tables and chairs do not harm the floor of the venue. The floor of the Sports and Expo Center also serves as a running track and the soft/foamy floor can tear/puncture. Carpet strips under the feet of tables and chairs works well to protect the surface, as do pieces of thick cardboard. Additional tables and chairs can be rented for a small fee. Exhibitors must be sure that all noise levels from sound systems are kept to a minimum. The Great Lakes Comic-Con reserves the right to determine at what point that noise level constitutes interference with others and must be discontinued. No exhibit may block or interfere with other exhibits and may not exceed booth space or 8 feet in height. Any damage caused to the building or its furnishings by the Exhibitor is the sole responsibility of the Exhibitor. Exhibitor agrees to remain set up during all exhibit hours. No early breakdowns of exhibits are allowed without the prior consent of the show promoters. Exhibitors must stay within the boundaries of their exhibit space. Merchandise for Sale 1. 2. 3. 4. F. Exhibitor understands the payment policy and agrees to pay as per the terms of the application. There will be a $50.00 fee for checks returned unpaid. All deposits are non-refundable. Display Regulations 1. E. Vendors will be permitted to enter the venue starting at 12PM/Noon on Friday, October 17, 2014 for set-up. On Saturday, October 18, 2014, vendors may enter the venue starting at 8AM. Vendors must have all items removed from the facility by 9PM on Saturday, October 18, 2014. Payment for Space 1. D. Electrical services are available, but must be requested when booth/table space is reserved. There is an additional $10 charge for electrical drops, which is paid with your booth/table reservation. Refer to the reservation form for information. The Great Lakes Comic-Con reserves the right to change booth locations at the promoter’s discretion. Exhibitor will keep their booth/table area clean and is responsible for any damage. Exhibitor agrees to leave the area "broom clean" at the close of the show. Renting, Selling, or Subletting booth space is strictly prohibited. Exhibitor agrees that all merchandise for sale is legal and licensed. Bootleg merchandise is prohibited, and the promoter is not responsible, but will take action if necessary. ABSOLUTELY NO PORNOGRAPHY OR ADULT ONLY MATERIAL IS TO BE SOLD AT ANY TIME AT THE GREAT LAKES COMIC-CON. Any items found to be offensive MUST BE REMOVED from sale. The Great Lakes Comic-Con staff has final say on what is, or is not, acceptable. If you have an item that you believe someone may find to be questionable, please make sure to ask. Taxes and Licenses 1. 2. Exhibitors shall obtain any licenses, permits, identification numbers, or approvals under federal, state, or local law applicable to its activities at the event at its sole expense including the Michigan State sales tax. Exhibitor not holding a State of Michigan sales tax license agree to file a Concessionaire's Sales Tax Return within 3 days after the end of the show. 3. G. Damages & Losses 1. 2. 3. H. Macomb Community College provides overnight campus security, who patrol the parking lots, from 10:00pm Friday to 8:00am Saturday. The show promoters and Macomb Community College are not responsible for any theft or loss. Exhibitor is responsible for their own security during show hours. Cancellation 1. 2. I. Exhibitor understands that failure to file a Concessionaire's Sales Tax Return may result in a tax assessment against you by the Revenue Commissioner. No refunds will be given if exhibitor cancels. A transfer will be granted and payment will be applied to the next Great Lakes Comic-Con. Refunds will not be available due to Force Majeure (refer to I2). Liability and Force Majeure 1. Hold Harmless By signing agreement, you acknowledge that you have read, understand and agree to be bound by both the terms and conditions set on this application. You acknowledge that failure to abide by the rules may result in the loss of your Exhibitor privileges without recourse or refund. By agreeing to exhibit at The Great Lakes Comic-Con, the exhibitor agrees to protect, keep, and save the The Great Lakes Comic-Con promoter(s) and Macomb Community College forever harmless from any damage, loss, theft, cost, liability, act of god, terrorism or expense that arises from their exhibiting at this show. This agreement covers full setup, run of the show, and teardown. 2. Force Majeure In the event that Macomb Community College, or any part of the exhibit area thereof, is unavailable, whether for the entire event or a portion of the event, as a result of fire, flood, tempest, or another such cause, or as a result of governmental intervention, malicious damage, acts of wars, strike, labor disputes, riot, or agency which the promoters have no control, or should the promoters decide that because of any such cause it is necessary to cancel, postpone, or re-site the show, or reduce installation time, exhibit time, or move-out time, the Great Lakes Comic-Con, and its promoters, shall not be liable to indemnify or reimburse the Exhibitor in respect of any damage or loss, direct or indirect, arising as a result thereof.
