Amy E. Hutchens, JD, CCEP, President, CLEAResources, LLC Many companies have been subject to potentially alarming “visits” from a representative from a federal or state agency (i.e., U.S. Immigrations and Customs Enforcement, FBI, etc.). This program will provide tips on how to prepare for this event, and will provide practical details on how to avoid particular compliance pitfalls. Recently, government agencies have stepped up the pace of investigations in many areas (EEOC, wage and hour laws, and immigration, among others). The best way to be prepared for that “knock on the door” is to do the necessary preparation work ahead of time. Attendees will develop insight into how to respond when a government agent appears at the door and how to train staff to react to government inquires calmly, and in a manner that will not put the company in legal jeopardy. Beckman, JD, Vice President of Claims, ISMIE Mutual Insurance Company J. Kent Mathewson, JD, Partner, Donohue Brown Mathewson & Smyth LLC More than one MPL carrier or other insurer may become involved in a lawsuit. The big issues are cooperation, the rights and obligations of the various parties and insurers, and the overall strategy. This session will discuss several scenarios for collaboration among MPL and other insurance companies. One example: an insured has both first-dollar coverage from a hospital and private coverage for an MPL claim (i.e., both are primary coverage). Another example: a “hybrid” claim from a patient injured during an office visit; the loss could be MPL or general liability/slip and fall. Participants will gain insight into how to work with “other” insurers on a claim, including excess insurers, risk retention groups, captives, and self-insureds, as well as the best approaches for collaborating with other MPL insurers when appropriate. 11:15 a.m.–12:15 p.m. 12:15–1:30 p.m. Breach Response and Other IT Headaches: You Need Answers to These 10 Questions Networking Luncheon Steve Martinez, Managing Director, Stroz Friedberg Attendees will leave this session with answers—actionable items—that can immediately improve their company’s position when the inevitable “event” occurs. The presenters will adress several problem scenarios involving information technology, including: What can I do now to prepare for a data breach or other IT event? What aspects of my IT operation should I be most concerned about? What can I do now so that my company is seen in the best possible light, given the virtual inevitability of a breach event or other IT headache? What mistakes have others made that my company can avoid? At the conclusion of this session, participants will be able to take back to their companies one or more specific proposals to prepare the companies for an IT event and also to perform an accurate assessment of their own readiness for an IT event and, on that basis, address any shortcomings in their current operations. Sponsored by Duane Morris 1:30–2:45 p.m. Reinsurers: What’s Shaping Their World and What Worries Them Todd Mockler, Managing Director, Guy Carpenter What current issues are most troubling to reinsurers? Is there anything dire enough to keep them up at night? Attendees will be provided an in-depth look at the answers to these questions, and, more generally, learn about the outlook for the MPL reinsurance market. They will get an informed prediction for where rates for MPL reinsurance are headed. The speaker will explore the new reinsurance products and coverages now on the market, and discuss whether MPL companies should be learning about them, and perhaps purchasing them. At the conclusion of this session, participants will be able to take back to their companies new knowledge and fresh insights on the current status of the MPL reinsurance market. In addition, attendees will develop the knowledge necessary to take a fresh look at their reinsurance program, and conduct an informed evaluation of the current options now available in the market. 2014 FALL Corporate Counsel Brochure_Layout 1 10/3/14 10:33 AM Page 6 8:30–9:45 a.m. Alternative Risk Mechanisms–Recent Developments in the Industry Past Attendee 6:30–9:00 p.m. ECO/XPL and the Mega-Verdict: Is This the New Normal? Dinner Is the “mega-verdict” a real phenomenon—an emerging trend? Is severity in big MPL awards really changing? Attendees will find out what their companies can do to identify and head off these verdicts, instead of capitulating and writing a big check every time. They will learn what these cases have in common, and how to spot one up front, before the jury returns a verdict. Participants also find out the particular steps your company can take to mitigate the risk of a mega-verdict risk. Perhaps reinsurance isn’t the only answer. Learn about the other alternatives. At the conclusion of this session, participants will have gained important insights into the challenges associated with mega-verdicts. They will know what steps they can take to recognize claims that may be linked with this risk and how to reduce it. They will also be armed with new strategies for dealing effectively with the exposure to mega-verdicts. 4:00–4:15 p.m. Refreshment Break 4:15–5:30 p.m. Topical Group Discussion Moderator: Devin O’Brien, JD, Senior Counsel, The Doctors Company This session is dedicated to a wide range of possible issues—whatever topics are of greatest concern to the room’s attendees. They may include, for example, updates on what is happening with tort reform in the various states, recent experience with some generally obscure insurance laws, or specific cases or legal issues that may serve as precedents or be of special interest to other attendees, because of their potential impact. This session format will be a perfect springboard for some interesting discussion and debate. Paid Guests Welcome Friday, October 17, 2014 8:00–8:30 a.m. Breakfast “ 2:45–4:00 p.m. Dominica C. Finally, the speaker will provide predictions on what the near-term future holds in store for ARMs. Attendees of this session will gain further understanding of the role ARMs are playing in the MPL market, and how those roles will affect their companies going forward. At the conclusion of this session attendees will also be able to assess what, if any, changes their companies may need to make to address changes in the insurance environment resulting from ARMs. 9:45–10:00 a.m. For many professionals, trying to balance career and personal goals can be a daunting challenge. Some find themselves in some respects unsatisfied with their current life’s path, some wonder if there is more to be had from life, and still others just wish they could somehow do a better job in blending the multiple aspects of their lives into a coherent and focused whole. In this session, attendees will begin an exciting transformation: it will help them focus, and at the same time maximize, their effectiveness in the multiple areas of life. Participants will learn a proven approach to creating value from the time that is available to them, and uncover insights about themselves that may be propelling them forward—or holding them back.
