D’Souza was deprived of his seniority whilst being promoted to the post of Head Clerk and was also victimized and harassed by posting him in Store and Maintenance Section vide order No. MMC/Adm/1-4(5)/88-89/925 dated 13th June, 1988, is legal and justified. If so, to what relief the above workman is entitled?” 2. On receipt of the dispute a case was registered under Ref. No. IT/50/90 and registered AD notices were issued to the parties. Pursuant to appearance before the Court, Party I filed the claim statement at Exb. 4 and Party II filed the written statement at Exb. 8. Subsequently vide orders dated 24-1-01 and 10-4-01 Party II (A) and Party II (B) came to be added as parties to this proceedings and who then filed the written statements at Exb.10 and Exb.13 respectively. 3. In the claim statement it is in short the case of Party I that the workman Shri Michael D’Souza is working with Party II as Head Clerk in Stores and Maintenance Section; that initially he was appointed as Steno-typist in the grade of UDC and was confirmed in service by order dated 12-6-81. It is stated that in the meeting held on 27-7-77 Party II OFFICIAL GAZETTE — GOVT. OF GOA SERIES II No. 31 took the decision regarding promotion of UDC namely the workmen Shri Vasant Naik and Smt. Carmelina Lobo as Head Clerk and also of filling of the post of Accountant by promotion of UDC/ /Cashier Shri Premanand Naik. It is stated that Party I workman apprehending that the promotion would be made by favouritism and not according to the Recruitment Rules, made representation to Party II who by reply dated 25-7-77 assured the workman that the promotion would be made as per the existing Recruitment Rules. It is stated that as per the Recruitment Rules the post of the Head Clerk is to be filled by promotions of UDC/Jr. Stenographers having at least three years standing in the grade as specified in column 11 of the schedule. It is stated that in violation of the Recruitment Rules Party II promoted some unqualified and ineligible UDC as Head Clerk. It is stated that Smt. Carmelina Lobo who did not satisfy the minimum qualification for the post of LDC was placed at Sr. No. 3 in the seniority list of the UDC, which is ipso-facto illegal and void. It is stated that even Shri Vasant Naik, the UDC/Store Keeper was not eligible for promotion as Head Clerk as he did not qualify for the said post as per the Recruitment Rules and hence his promotion as Head Clerk is ipso-facto invalid. It is stated that even the promotion of Shri Premanand Naik to the post of Accountant is invalid as he did not satisfy the minimum qualification as required under the Recruitment Rules. It is stated that Par ty II circulated a seniority list of its staff on 31-3-90 as per which the seniority list of the Head Clerks, the name of Party I workman figured at Sr. No. 3. It is the case of Party I workman that the persons shown at Sr. Nos. 1 and 2 were not eligible for inclusion of their names in the seniority list of Head Clerks and hence their names ought to be deleted and his name ought to have figured at Sr. No. 1 with appointment dated as on 31-8-77. It is stated that Party I workman made several representations to Party II bringing to its notice the irregularities committed in promotion of the Head Clerk and other appointments but Party II did not reply and on the contrary harassed Party I workman by transferring him from one place to another very often. It is stated that during the period from 1-2-85 to 13-6-88 Party I workman was transferred at five different places as against the normal practice of transferring an employee only after he has worked at a place continuously for three years. It is therefore the case of Party I that the workman is entitled to be placed at Sr. No.1 in the seniority list of Head Clerks with his appointment date as 31-8-77 besides other reliefs as claimed in the statement of claim. 30TH OCTOBER, 2014 4. In the written statement Patty II has raised the preliminary objection that the reference is bad-in-law as the dispute raised is an individual dispute and not an industrial dispute. It is also the case of Party II that the promotions to the post were made following the proper procedure and the Recruitment Rules framed from time to time. Party II has denied of committing any irregularities whilst filling up the post of Head Clerks and stated that Party I workman was promoted in the year 1985 when a fresh post was created and he was asked to look after the ministerial work in the municipal garage. Party II has denied that Party I workman was transferred from place to place by way of harassment has stated that he was transferred to the Admn. Section as per his own request. Party II has therefore denied that Party I workman is entitled to any relief claimed by him. 5. In the written statement by Party II (A) it is his case that the reference is not maintainable as there is no industrial dispute between him and the Party I workman. It is also the defence of this party that the dispute raised by Party I workman is in his individual capacity and not by his union and therefore is not covered under Section 2 (a) of the Act. It is further his defence that Party I workman has not raised any charter of demand on him challenging his appointment to the post of Head Clerk or to the seniority list and therefore this reference is incompetent. This party has otherwise denied the case setup by Party I in the claim statement. It is further the defence of this party that by award dated 9-4-95 his promotion to the post of Head Clerk was regularized with effect from 31-8-77 and was also granted other reliefs however Party I has not challenged this award. Thus, amongst above and other grounds this party has prayed to reject the reference. 6. In the written statement by Party II (B) it is in short her case that the reference is not maintainable as there is no industrial dispute between Party I workman and her. It is also her defense that the purported dispute is raised by Party I workman in his individual capacity and not by his union and therefore is not covered under Section 2 (a) of the Act. It is further her defense that Party I workman has not raised any charter of demands on her either with regard to challenge to her appointment to the post of Head Clerk or to the seniority list and therefore present reference is not competent and requires to be dismissed. This party has otherwise denied the case setup by Party I workman though she has admitted that the council in its meeting on 27-7-77 had taken a decision for filling up posts of Head Clerk by promotion. She has further admitted 707 OFFICIAL GAZETTE — GOVT. OF GOA SERIES II No. 31 that the Recruitment Rules were published in the Official Gazette dated 18-11-75 and has stated that she would rely on them for their true meaning and contents. It is also her defense that her appointment to the post of LDC is a valid appointment in accordance with the rules then in force of the time of her appointment. Thus amongst above and other grounds, this party has prayed to reject the reference. 7. In the course of further proceedings and more particularly when the matter reached the stage of final arguments, the matter was settled by filing consent terms between Party I workman and Party II. In the application filed incorporating therein the consent terms at Exb. 59, it is mentioned by Party I workman and Party II that, Party I has submitted a settlement proposal to Party II vide letter dated 29-05-07 by willing to accept reduction in the period of claim and claim from 1-1-79 instead of from August, 1977 and Party II by resolution No. 111/07 dated 28-12-07 has unanimously resolved to compromise the dispute and to grant ex-post facto sanction for the promotion of Party I workman to the post of Head Clerk from retrospective effect i.e. from 1-1-79 to 31-1-85 with all monetary benefits and it was also further resolved to request the Director of Municipal Administration, Panaji to accord ex-post facto sanction and approval as per Section 322 of Goa Municipalities Act, 1968 for the post of Head Clerk from retrospective effect i.e. from 1-1-79 to 31-1-85 to regularize and accommodate Party I workman to the post of Head Clerk so that the case may be amicably settled. It is also stated in this application that Party II accordingly submitted a proposal in alternative for obtaining sanction for either creation of a post of Head Clerk in the Council for a limited period with retrospective effect from 1-1-79 to 31-1-85 with the then pay scale of Rs. 425-700 or alternatively for revival of earlier sanctioned post of Recovery Officer in the pay scale of Rs. 425-700 created and approved by the office of Director of Municipal Administration. It is also stated that Government of Goa has approved the amicable settlement to amicably resolve the matter before this Cour t and that the Director of Urban Development, Government of Goa by letter dated 19-9-13 has conveyed the Government approval for amicable settlement to resolve this dispute. It is stated that the Director of Urban Development by order dated 10-12-13, has conveyed ex-post facto sanction for creation of the post of Head Clerk in Mormugao Municipal Council with retrospective effect for a limited period from 1-1-1979 to 31-1-1985 in the pay scale of Rs. 425-700 plus other allowances in exercise of powers u/s 322 read with Section 73 (1) of the Goa Municipalities Act, 1968 708 30TH OCTOBER, 2014 and also granted ex-post facto sanction to promote Party I workman to the post of the Head Clerk with retrospective effect from 1-1-1979 to 31-1-1985 with all applicable benefits. The consent terms incorporated in the above application, read as under: (a) It shall be deemed that Shri Michael D’Souza was promoted to the post of Head Clerk with effect from 01-01-1979 in the then pay scale of Rs. 425-700 and his such promotion and appointment shall stand regularized with retrospective effect from the said date. In view of the said promotion with effect from 01-01-1979, Shri Michael D’Souza shall be accordingly entitled to all monetary and other consequential benefits in view of the said promotion with effect from 01-01-1979 after adjustments of all pay and other benefits already drawn by him on the erstwhile posts he was holding in the Municipal Council during the period with effect from 01-01-1979 to 31-01-1985. (b) In view of what is agreed above, the account shall be taken up and settled within 90 days from the date of these consent terms and Shri Michael D’Souza shall be paid as per his entitlement immediately upon taking up his accounts within the said period of 90 days. (c) As regards the parties other than Party I and Party II, i.e. Party II A, Shri Vasant Naik, Party II B, Smt. Carmela Lobo and Party II C, Shri Premanand Naik, the present settlement as between Party I and Party II shall not in any manner affect the rights, benefits and entitlements of the said other parties. (d) As the said other parties, viz. Party II A, Party II B, Party II C have already retired from the services, neither their office records nor the salary, payments and retirement or other benefits received by them shall in any manner be affected, altered or changed on account of the present settlement of disputes between Party I and Party II. (e) Party I withdraws whatsoever claims, allegations or disputes as against Party II A, Party II B and Party II C as the present settlement shall not affect them in any manner. Upon receipt of the dispute, it was registered as Ref. No. IT/2/14 and registered AD notices were issued to both the parties. Pursuant to service of notice, Party II appeared through Adv. Shri P. Agarwal but Party I did not appear. Due to absence of Party I matter was adjourned by giving opportunity to Party I to appear and file the claim statement. Despite this on the next date of hearing Party I did not appear and as such fresh notice under registered AD post was issued to Party I. Records reveal that Party I was served with this notice but did not appear before the court. Ld. Advocate for Party II stated that as no claim statement has been filed by Party I, the question of Party II filing any written statement does not arise and prayed to pass an award accordingly. 3. Since Party I has not filed the claim statement, there is no material before this court towards adjudication of the dispute referred by the Appropriate Government. Reliance is placed on the judgment in the case of Baldev Singh v/s The Judge, Central Government Industrial Tribunal 709 OFFICIAL GAZETTE — GOVT. OF GOA SERIES II No. 31 30TH OCTOBER, 2014 & Labour Court & ors 2007 II CLR 685 in which by referring to the judgment in the case of Virendra Bhandri v/s Rajasthan State Road Corporation Ltd., & ors (2002) 9 SCC it is observed as under: “ ..... a reference of certain Industrial Dispute was made to the Industrial Tribunal-cum-Labour Court. The workman did not appear before the Tribunal, therefore, Tribunal held that there remains no Industrial Dispute. However, subsequently, the Appropriate Government again referred the dispute to the Tribunal on the same question and on this occasion, the Tribunal adjudicated the matter and made an award. The High Court held that the finding recorded by the Tribunal in the first reference amounted to an “award” and, therefore, second reference was incompetent. The Honourable Apex Court held that all that was stated was that the parties concerned had not appeared before the Tribunal and in such an event, the Tribunal should have noted its inability to record the finding on the issue referred to it, not that the dispute itself does not exist. When there is no adjudication of the matter on merits, it cannot be said that the industrial dispute does not exist. If the industrial dispute still exists as is opined by the Government, such a matter can be referred under Section 10 of the I.D. Act, as Industrial Disputes are preferred to the Labour Court or the “Industrial Tribunal for maintenance of industrial peace and not merely for adjudication of the dispute between two private parties. Therefore, it was permissible for the Government to have made the second reference. …”. 4. Since in the instant case, the dispute raised by the Party I before the conciliation officer has not been proved by Party I before the court by filing claim statement or by adducing evidence, there is no adjudication of the dispute before this court and therefore as observed in the judgment cited supra, this court is unable to record any finding on the reference forwarded to it. 5.
