The benefits given to you by this warranty are in addition to the other rights and remedies you as a consumer have under law in relation to the goods and services to which this warranty relates. 1 Terms and Conditions of our agreement Commonly used words or expressions The following words have a specific meaning in these Terms and Conditions: Terms and Conditions Your Toyota Extra Care Extended Factory Warranty agreement consists of two parts: Approved repair means a repair or replacement authorised by the Toyota Extra Care Administrator. –– The warranty certificate; Authorised Repairer means a repairer recommended or approved by the Toyota Extra Care Administrator. –– This Terms and Conditions booklet. Authorised Toyota Dealer means a Dealer appointed by Toyota to sell for and on behalf of Toyota, new Toyota vehicles. This Terms and Conditions booklet sets out the terms, conditions and limitations that apply to your Toyota Extra Care Extended Factory Warranty. Please read this document carefully so that you understand what is covered and what is not covered. If you do not understand which items are covered or not covered, please contact us – our contact details are printed on page 6 of this booklet. Dealer statutory warranty means the warranty required by law to be provided by the Dealer at the time you purchased the vehicle. Extended warranty period means the period described in the section titled “Your warranty period” on page 3. Fails, failed or failure means the inability of any covered component to satisfactorily perform its intended function, but excludes reduction in operating performance due to wear and tear consistent with its age and distance travelled. Note that your Toyota Extra Care Extended Factory Warranty agreement is an important document and you should keep it in a safe and accessible place. All pages are numbered, and if any pages are missing you should contact us for a replacement. Helpful Benefits means the additional benefits under this warranty, which are described in the section titled “Helpful Benefits” on page 4. Market value means our determination of the value of your vehicle immediately prior to the event that leads to a claim under this warranty. Our determination will take into account such things as your vehicle’s age, condition and kilometres travelled. The privacy of your personal information The personal information you have provided in relation to your Toyota Extra Care Extended Factory Warranty, and other personal information provided by you in connection with the administration of your warranty, is collected by Toyota Finance on TMCA’s behalf for purposes related to the provision and administration of your warranty and for associated planning, product development and research purposes. Owner’s documentation means the owner’s manual and warranty and service book provided by Toyota in relation to the vehicle. Repair, replace or replacement means to make good, to acceptable working condition, using parts of a like kind and quality. Parts used to repair your vehicle may be genuine new or guaranteed reconditioned. Where genuine parts are not available in Australia or where non-genuine parts have been fitted after purchase, replacement parts will be of a similar type and quality to those used in your vehicle, taking into account its age and distance travelled. TMCA and Toyota Finance may provide your information to their related companies, the Dealer named in the contract or to third parties engaged by Toyota Finance in connection with the purposes referred to above. Selling Dealer means the Authorised Toyota Dealer who sold you the vehicle and this warranty. Toyota component means any component or part of the vehicle including components authorised and marketed by Toyota as accessories, provided such accessories are fitted at the time the vehicle first entered service as a new vehicle and includes any Toyota Genuine Accessories fitted after vehicle delivery, but within the Toyota new vehicle warranty period. TMCA and Toyota Finance may also use your information for marketing purposes. If at any time you no longer wish to receive marketing material from TMCA or Toyota Finance, please contact us by calling Toyota Finance Customer Service on 137 200 or writing to us at PO Box 1354, Macquarie Centre NSW 2113. PO Box 1354, Macquarie Centre NSW 2113. Toyota new vehicle warranty means the vehicle warranty set out in the owner’s documentation supplied with the vehicle. Vehicle means the vehicle manufactured and/or marketed by Toyota and described in the warranty certificate. Warranty or Toyota Extra Care Extended Factory Warranty means this warranty contract consisting of the warranty certificate and these Terms and Conditions. We, Our, Us or Toyota means Toyota Motor Corporation Australia Limited ABN 64 009 686 097. You or Your means you, the purchaser of the vehicle and any subsequent person to whom this warranty is transferred in these Terms and Conditions. 2 Your obligations under this warranty Your warranty period This warranty is designed to replace or repair any Toyota components defective in material or workmanship which fail under normal operation and use during the extended warranty period. Your warranty will apply for defects that arise during the warranty period specified in your warranty certificate. The warranty will commence the later of: It is a condition of this warranty that your vehicle must be maintained to the manufacturer’s recommendations by an Authorised Toyota Dealer or licensed motor vehicle repairer. These servicing requirements are outlined within your owner’s documentation. 1. the date of issue as stated in the warranty certificate; or 2. the date that the Dealer statutory warranty expires; or You should keep evidence of how and where your vehicle has been serviced, as it will help to minimise any delay in processing your claim. 3. the date that the Toyota new vehicle warranty expires. Please note that if your vehicle is inadequately maintained we may refuse your claim. 1. the date the term in months shown on your warranty certificate has elapsed from the date the warranty commenced; or The warranty will end the earlier of: Approval for warranty repairs 2. when the vehicle has travelled the distance since new, as noted on your warranty certificate. All repairs made under this warranty require the express approval of the Toyota Extra Care Administrator, who can be contacted on the number printed on page 6 of this booklet. Apart from selling and issuing this warranty, your Selling Dealer is not authorised to act as the agent for us or the Toyota Extra Care Administrator or to bind any party to any arrangement with you. What your warranty covers We warrant that within the extended warranty period we will repair or replace free of charge any Toyota component found to be defective in material or workmanship under normal operation and use in Australia, with the exception of any item listed under “What this warranty does not cover” on page 4. If your vehicle fails and needs to be repaired outside the Toyota Extra Care Administrator’s normal office hours and cannot be approved before repairs are carried out, you must contact the Administrator as soon as possible after they re-open if you want to claim for the repairs under this warranty. 3 3. Consumable items Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. We will pay to replace any consumable items if they require replacement due to the failure of any other Toyota component covered by this warranty. Toyota Genuine Parts Every Toyota Genuine Part is designed and constructed to original manufacturer’s specifications for maximum performance, longevity and perfect fit. Under this warranty all Toyota Genuine Parts are warranted for the balance of the Toyota new vehicle warranty or carry a 12 month unlimited kilometre Toyota warranty, whichever is the greater. The benefits given to you by this warranty are in addition to the other rights and remedies you as a consumer have under law in relation to the goods and services to which this warranty relates. What we pay Any Toyota Genuine Parts, fitted during the Toyota new vehicle warranty are covered under this warranty for the extended warranty period. If we approve your claim, we may choose, at our option, to pay the reasonable cost of either repairing or replacing those Toyota components. Replacement parts will be of a similar type and quality to the other Toyota components of your vehicle, taking into account its age, condition and distance travelled. What this warranty does not cover This warranty does not cover the following items: The most we will pay under this warranty for repairing or replacing Toyota components during the extended warranty period is limited to the market value of the vehicle as at the date of repair. –– consumable items that have a limited working life, such as those recommended for regular replacement within the owner’s documentation, including but not limited to: Helpful Benefits –batteries; – Your warranty also provides you with a number of other helpful benefits to ease the inconvenience of a failure: –tyres; – –– filters; –– hoses; or 1. Towing expenses –– brake pads and linings, We will pay for the reasonable costs you incur in towing your vehicle to the nearest Authorised Toyota Dealer or licensed repairer should towing be required for the purpose of carrying out an approved repair. –– unless these items are found to be defective in materials or workmanship or fail in circumstances referred to in clause 3 of “Helpful Benefits” on this page. You must also ask the Authorised Toyota Dealer or licensed repairer to tell the Toyota Extra Care Administrator if you had your vehicle towed, so that they can authorise your claim for towing expenses. –– the costs of normal maintenance or service. This includes adjustments to your vehicle that are part of the scheduled servicing recommended by Toyota as described in the owner’s documentation; –– any vehicle adjustments or replacements necessary to maintain roadworthiness, insurance or registration, unless they result from defective Toyota components or faulty workmanship in Toyota components; The most we will pay for such towing expenses during the extended warranty period is $500 (inc. GST). 2. Quality guarantee If your vehicle suffers a failure during the extended warranty period, then any authorised repairs made under this warranty will be covered for the remaining extended warranty period. –– superficial damage, such as cosmetic or surface corrosion from stone chips or scratches in the paint; –– any consequential loss, expense, damage or liability, including loss of time or convenience, or a reduction in the value of your vehicle; 4 –– (or anyone using your vehicle or acting with your consent) intentionally damage your vehicle causing component failure; –– repairs to or replacement of components (including Toyota components) while they are covered by any other warranty or guarantee, including: –– Toyota new vehicle warranty; –– do not follow the requirements for “Claiming under this warranty” on this page; –– Toyota recall campaigns; or –– fail to provide us with accurate information; or –– a repairer’s warranty or guarantee. –– make or attempt to make a fraudulent claim. –– Dealer statutory warranty; –– any Toyota component that fails outside the extended warranty period. Claiming under this warranty Your warranty does not cover parts that fail because: How to make a claim –– you have neglected to properly maintain and service your vehicle; As soon as possible after a failure that you feel might be covered by this warranty, you must: –– your vehicle has been fitted with non-genuine parts, not made or supplied by Toyota; –– take reasonable steps to prevent further damage to your vehicle; –– your vehicle has been modified from Toyota factory specifications (for example, conversion to LPG operation, addition of a turbocharger, or installation of oversize pistons or valves), unless the modifications are Toyota approved and installed; –– take your vehicle to the Selling Dealer or, if this is not possible, to the closest Authorised Toyota Dealer or licensed motor vehicle repairer. –– your vehicle is vandalised, abused, raced or used in any other competition; or Before any work is done to your vehicle, you must ask the Selling Dealer, Authorised Toyota Dealer or licensed motor vehicle repairer to read the Repairer instructions on the next page of this booklet and to contact the Toyota Extra Care Administrator for claim authorisation. –– of corrosion, electrolysis or rust. A claim form can be obtained by: Your warranty does not cover the failure of any Toyota components where your vehicle is being used or has been used in circumstances other than normal operating conditions, for example: –– downloading one from toyotaextracare.com.au; –– of acts of nature (for example, bushfire, earthquake, thunderstorm, hail, flood); –– emailing tec.admin@toyota.com.au; or –– calling 137 200. –– as a rental vehicle, except where use as a rental vehicle has only occurred prior to the extended warranty period; The expense associated with making a claim under this warranty is not covered by this warranty. This means that you must bear the expense of making a claim, including contacting the Administrator. –– as a taxi; What you must not do –– as a driving school vehicle; Do not have your vehicle repaired, nor authorise repairs, unless we have expressly approved repairs by the Authorised Repairer. –– as a courier vehicle or for mail delivery; –– as a police, security or emergency vehicle; or Additional Terms and Conditions –– on mining sites. When we may refuse a claim Cancelling your warranty You may cancel your warranty at any time by writing to the Toyota Extra Care Administrator requesting cancellation. Your warranty is designed to protect you against Toyota components which fail under normal operation and use. Accordingly we may refuse a claim if you: We may also cancel your warranty where you have not fully complied with the Terms and Conditions of the warranty. –– fail to service your vehicle in accordance with your service requirements set out on page 3 of this document; –– fail to take reasonable care to protect and maintain your vehicle; 5 Transferability Once repairs are completed, the Authorised Repairer must forward a tax invoice to the address below for payment. Tax invoices must be addressed to the Toyota Extra Care Administrator and include the following information: Only you are entitled to make a claim or receive a benefit from your warranty. At the sole discretion of the Toyota Extra Care Administrator, we may permit you to transfer your warranty upon sale of the vehicle to the purchaser. The warranty cannot be transferred if you sell your vehicle to or through a motor Dealer or trader. This does not affect your rights or entitlements otherwise available at law. 1. Toyota Extra Care authorisation number; 2. Vehicle registration number; 3. Customer’s name in full (include ABN if a company); 4. Odometer reading; A transfer form can be obtained by: 5. Copies of any sublet repair invoice (when requested); –– emailing tec.admin@toyota.com.au; or 7. Name, address and ABN of the Authorised Repairer; and –– calling 137 200. 8. Date of issue.
