WILDY’S BOOK NEWS
Volume 19
Issue 12 Published Monthly
Dec 2014/Jan 2015
Everyone here at Wildy’s would like to wish all our customers the very best for 2015.
2015 marks twenty years of publishing the Book News. It began as a black & white A4
xeroxed newsletter in 1995. It has been in its present format since 2004. The idea for the
Book News arose out of a discussion about producing a catalogue. At the time other law
booksellers were producing expensive annual catalogues. We decided that it would be
much more useful for customers to have a monthly listing rather than a large catalogue of
what was published last year. We like to think that history has proved us right.
The last year has proved challenging for most businesses but especially for the book trade.
We like to think that we are fortunate in being in a highly specialized sector. The expertise
of our staff and the extensive stockholding of titles in our two shops give us an advantage
over our competitors. To this should be added the continuing support of our major
suppliers who understand and appreciate our business.
One of the major developments in 2014 has been the expansion of our subscriptions team.
The demise of a major subscription agent late in the year had everyone scrambling to
handle the increased volume of work. Our team have coped exceptionally well and our list
of UK and international customers has grown considerably.

Another major development in our business has been the electronic side. Increasingly
we are handling online provision of legal information on behalf of the likes of ICLR
and Kluwer. Additionally we now offer ebooks through our website and have a monthly
column in the Book News where Graham Norfolk discusses these publications.
While on the subject of electronic publishing, we should mention our website. We
would like to acknowledge the hard work put in by the team which keeps it up to date.
Most bookselling websites rely on feeds from large data handling companies for their
information. We maintain our own database which allows us to have the most accurate
and up to date information available. The website has become an industry standard
amongst law librarians and lawyers everywhere.
Service is a major part of the value-added component to our business. Everything we do
is predicated on this and everyone is aware that it is service which differentiates us from
all the rest. Once again we were pleased to win the BIALL Supplier of The Year Award in
2014.
We are very proud of the work of our staff. Aside from the new developments this year
there are other groups worthy of mention. To begin with there are our book shop staff,
who are the bedrock of the business and contribute to the running of everything. Also
there are our sales representatives and account managers who visit law firms and libraries
thoughout the country and overseas.
The final group to mention are the publishing and marketing team. This includes a number
of freelance editors and indexers. We have done a mini-catalogue of all the books we have
published this year at the back of this issue of the Book News.

First published in 1868, this title is a must-have purchase for

the premier publication on sale of goods and is frequently cited in
court due to its depth and coverage.

As it is the start of the year I think it would be good to recap on what has been happening
with eBooks at Wildys over the past 12 months and to have a look at what is in store for
2015.
In January 2014 we launched our extended range offering immediate downloads for
eBooks from such publishers as Oxford University Press, Informa, Hart, Cambridge
University Press, John Wiley, Ashgate, Routledge, the Law Society and many more.
Nothing makes me happier than seeing a sale of an eBook going through at 10pm on a
Sunday night to someone in Croydon. It’s great that we can offer our UK customers this
instant access to the information they need when they need it.
2014 saw the sales of the eBooks of key Sweet & Maxwell titles flourish. The sales of
the White Book and Archbold are growing year on year. These annual titles seem be
dominate the market with Sweet & Maxwell. I have been wondering why this growth
hasn’t transferred over to the other Sweet & Maxwell practitioner works. Is there
trepidation in buying a Chitty on Contracts as an eBook with the knowledge that you
will be replacing your iPad next year? If so, there shouldn’t be – the ProView App stores
all of your eBooks so you will be able to get straight back into your library from any new
device.
DECEMBER 2014/JANUARY 2015 29
December is always the busiest month of the year in legal bookselling and it is easy to
miss some of the important titles that have just been published. Private client lawyers will
be pleased, and maybe slightly alarmed, that new editions of Lewin, Snell and William
on Wills have all arrived in the same month!
This year we are looking to extend our eBook range further. There are a number of large
legal publishers we are currently talking to and we hope to make further announcements
soon. 2015 also brings new EU legislation with regards to VAT on eBooks cutting out
some of the loopholes that our competitors have been able to exploit. For EU business
customers that can provide a VAT number there will be no change to the prices that we
currently charge. This year we will also see the first looseleafs published on LexisNexis’
Lexis Note format. I honestly believe this could be a game changer. I will provide further
details as soon as I have them.
As always we are here to help. We are not a faceless multinational that offer no support or
advice. If you have any questions then feel free to pick up the phone and ask me directly.
Wishing you all the best for 2015!
Regards,
Graham

THE REVIVAL OF PRIVATE PROPERTY
AND ITS LIMITS IN POST-MAO CHINA
XU Ting
Law in East Asia Series
Price: £65.00
ISBN: 9780854901333
Extent:245 pp
Binding:Hardback
This monograph examines the nature and significance of the re-emergence of
private property in rapidly changing post-Mao China. In examining this issue, the
study explores a key dichotomy in Chinese law, that is, ‘public versus private’,
and examines the manner in which the Chinese define ownership. The study
stresses the importance of lack of clarity in the boundaries between the public and
the private in property rights. While there is a limited move towards the recognition of private property in real estate in contemporary China, this analysis also
shows that ownership in the law, and ownership as understood and practised socially, often diverge significantly. ‘Modern’ conceptions and theories of property
rights emerged in the context of nation-building from the late Qing onwards, and
unitary and exclusive property rights were considered as ‘badges’ of modernity.
This analysis of the nature and the social and political implications of re-emerging
private property rights provides important insights for our understanding of the
changing nature of modern China.

VEXATIOUS LITIGANTS AND
CIVIL RESTRAINT ORDERS
A Practitioner’s Handbook
Maurice Rifat and David Giles
Price: £49.00
ISBN: 9780854900855
Extent:226 pp
Binding:Hardback
Vexatious Litigants and Civil Restraint Orders is a detailed and practical work on this
growing area of procedure and law. Aimed at lawyers, judges and civil court litigants
generally, it provides a ‘one-stop’ guide and explanation of the law relating to the court’s
jurisdiction to control vexatious and/or unmeritorious court claims and applications.
The book explains the historical origins of and responses to vexatious litigation, it analyses the legislation and rules designed to meet this threat in the modern era, principally
under the civil restraint order provisions of the Civil Procedure Rules and section 42 of
the Senior Courts Act 1981. The relevant case law explaining and developing the court’s
jurisdiction and powers under the legislation and rules, case management strategies for
preventing and controlling the worst excesses of obsessive litigants, how parties, facing actual or threatened restrictions on their right of access to the courts, can resist and
respond to such applications and orders, and the deficiencies, weakness and limitations of
the current rules regime relating to vexatious litigants and litigation are examined.
The book also deals with how the tribunals system and family courts have developed their
own rules and procedures to combat abuses of process perpetrated by vexatious litigants.
Finally, the book traces, through cases studies, the evolution of parties from the early
stages of their litigious careers into fully developed vexatious litigants.
Vexatious Litigants and Civil Restraint Orders guides the court, the practitioner and selfrepresenting litigants around the law and rules, with particular detail given as to the type
and procedure of applications that are provided for under the Senior Courts Act and in the
civil restraint order regime, and appeals and judicial review against restraint orders that
are made.
David Giles was called to the bar by Lincoln’s Inn in 1988 and practices from 1 Gray’s
Inn Square. Maurice Rifat is a barrister, practising from 1 Gray’s Inn Square.

Foreword by Adrian Leppard, Commissioner, City of London Police
As computer technology has advanced – and along with it the development of the internet
– the utility and benefits that they have brought with them have made them indispensible
to modern society. With the ever increasing reliance on such technology and its pervasiveness in personal and professional life, it was inevitable that it should come to be used in
ways which society has decided are contrary to the public interest and therefore worthy of
disapprobation and criminal sanction. To this end, Parliament has found itself having to
legislate in order to criminalise certain acts involving computer technology which did not
exist prior to the development of the technology. On the other side of the law, the courts
have found themselves having to redefine the application of pre-existing criminal law in
order to accommodate and incorporate the novel ways in which computer technology can
be used to commit criminal offences.
This book is the first book to tackle the fast growing topic of cyber crime and covers a
wide range of topics from electronic fraud, cyber stalking, online theft and intellectual
property to more involved topics like malicious communications and the rules of evidence
relating to cyber crimes and computers.
Through the use of detailed case studies, examples and statutory extracts the reader is
able to understand all aspects of cyber crime and computer crime. Cyber Crime: Law and
Practice provides a practical, easy-to- follow guide for practitioners in the field, as well as
those in law enforcement and academia.
Matthew Richardson is a specialist in electronic and hi-tech law, serving the first ever
injunction via twitter, and obtaining several ground-breaking hi-tech orders since then. He
is an Alderman of the City of London, Justice of Peace in Central London and a barrister

PASOLINI’S ITALIAN PREMONITIONS:
Same-Sex Unions and the Law in Comparative Perspectives
Maria Frederica Moscati
JCL Studies in Comparative Law No. 8
Price: £65.00
ISBN: 9780854901357
Extent:332 pp
Binding:Hardback
This book considers legal, procedural, and social aspects of the development of the phenomena of same-sex unions and their disputes across a broad range of jurisdictions over
the past three decades. It offers a comparative analysis within the discourses of family
law, anchoring that analysis in an empirical account of relevant developments, and the
controversies surrounding them, in Italy. The study focuses on Italy as a revealing casestudy of the issues, because it is a jurisdiction where the arguments for and against legal
recognition of same-sex unions have been put forward within a particularly close relationship between legal developments, culture, social values (including religion) and political
interests. From that empirical focus, the book proceeds to a comparative study, analysing
effects and consequences of same-sex unions and disputes in other selected jurisdictions,
and showing the manner in which law and society, including religion, have influenced
each other in this area.
The study argues that legal recognition of same-sex unions is not a manifestation of tolerance but rather is a development within society and its law depending on several cultural
factors. It emphasises that same-sex unions have long been part of family law in many cultures around the world. Despite their importance, the sometimes long-established accounts
of same-sex unions and disputes have been an almost completely neglected area of study
in comparative family law. The reason for such neglect of practices and discourses lies
mainly in the methodology used in comparative family law.
In order to reach these conclusions, and underpinning the comparative aspects of the
study, this book draws upon not only legal, but also anthropological analysis of social
values, religious attitudes, and law regarding same-sex unions and disputes.
The book is intended as contribution to the study of comparative legal studies and access
to justice and by considering legal and social developments in the Italian legal culture it
also fills a gap in the literature by offering a detailed analysis of legal and social developments of issues and debates related to the rights of same-sex couples in Italy.

FURTHER WEIRD CASES
Comic and Bizarre Cases from Courtrooms
around the World
Gary Slapper
Price: £11.95
ISBN: 9780854901340
Extent:178 pp
Binding:Hardback
This book, the third in a series, provides another instalment of extraordinary cases from
around the world. Based on the author’s popular Times Online column, Further Weird
Cases draws on cases and stories from many countries, including the UK, USA, Canada,
Australia, New Zealand, Germany, Mexico, Italy, Japan, Romania, and China and contains
a great variety of shockingly strange and entertaining courtroom dramas.
The cases featured in Further Weird Cases are those that truly stand out as odd, even
among all the unusual dramas that challenge the courts: a man from Florida who had his
hand bitten of by an alligator who was then convicted of “illegally feeding an alligator”; a
man imprisoned for 50 years for sealing a packet of pork ribs; two men in Italy who broke
the law by dying in a place where it was illegal to die; the case in Scotland that collapsed
when a dog due to give evidence died before the trial; a case in Brazil in which an election
candidate had tried to gain votes by including a free sample of cocaine with each election
leaflet; a case determining whether it is theft for a shopper to go to the ‘free sample’ counter of meat in a supermarket, fill two bags with the samples, and exit; and what happened
to the defendant who urinated in the judge’s waste paper bin. These further weird cases
are organised in themed chapters related to topics such as, sex and love, food and drink,
unusual punishments, pets and animals, and driving.
This book is a highly entertaining read for anyone who enjoys reading about the more
bizarre aspects of human life that fetch up in the law courts at the beginning of the 21st
century.

University, London. He is a Visiting Professor of Law at the Chinese University of Hong
Kong, and The Open University, UK. He is Law columnist for The Times online, and

TEACHING LEGAL HISTORY:
Comparative Perspectives
Robert M. Jarvis (editor)
JCL Studies in Comparative Law No. 9
Price: £65.00
ISBN: 9780854901456
Extent:310 pp
Binding:Hardback
Sixty-four leading legal historians ruminate on their own approaches to teaching legal history in nearly a third of the American law schools: what they teach, why they teach as they
do, how they structure their courses, and what they expect their students and themselves
to take away from the study of legal history. The diversity of approaches to the teaching
of legal history as demonstrated in this collection is impressive and fascinating, and at the
same time quixotic, unsystematic, not integrated into the law curriculum, and not comprehensive or thorough.
The contributions are full of inspiration, creative imagination and resourcefulness, selfcriticism, insight, and a shared conviction of the importance of a knowledge of legal history for the future of the law teacher and the legal practitioner. They address: legal history
in the law school curriculum; legal history and the common law tradition; legal history
and the United States Constitution; challenges of the legal history course; finding one’s
voice as a legal history lecturer; teaching aids; locating and using legal history sources;
local sources of legal history; legal history and the public, business community, and
government; legal history and civil rights, the African-American experience, and women;
transnational legal history; English legal history, Hispanic legal history; legal history and
the American legal profession, judges, and the development of legal skills.
Robert M. Jarvis is Professor of Law at the Nova Southeastern University Shepard Broad
Law Center. He received a B.A. from Northwestern University, the J.D. from the University of Pennsylvania; and the LL.M. from New York University.

COURT AND BOWLED:
Tales of Cricket and the Law
James Wilson
Price: £19.99
ISBN: 9780854901401
Extent:368 pp
Binding:Hardback
‘In summertime village cricket is the delight of everyone’ the English judge Lord Denning
famously wrote, in a case brought by someone who clearly disagreed with him.
The case was but one example of how the game of cricket cannot always avoid the law.
Neighbours or passers-by get hit by stray cricket balls, protesters interrupt matches, players get into fights or take drugs, and not a few involved with the game sue each other for
libel.
This book looks at a number of stories where cricket or cricketers gave rise to a legal dispute. It begins with a short history of cricket as it appears in the early law reports, including the case from 1598 which contains the very first known use of the word “cricket”. It
then turns to individual cases from Victorian times to the present day.
Some of the disputes have been of fundamental importance to the game itself. The ruling
in Bolton v Stone affected village and indeed impromptu cricketers everywhere, while if
Kerry Packer had lost his High Court action in 1978, his cricket revolution would have
been over before a ball had been bowled.
Other cases raise issues going well beyond the boundary ropes: Basil D’Oliveira’s omission by England from a tour of South Africa, for example, ended up being considered in
the highest echelons of power in both countries.
All of the stories demonstrate something common to both cricket matches and court cases:
behind the intrigue, entertainment and amusement of both there are real people and real
human stories, with all the usual human emotions and fallibility.
The book will be of interest not only to cricket fans or lawyers but anyone interested in
tales of high (and low) human drama and great ethical, moral and legal dilemmas.
James worked in commercial litigation in New Zealand and in London before joining
LexisNexis and is the author of Cases, Causes and Controversies: Fifty Tales from the
Law (Wildy, Simmonds & Hill Publishing) as well as numerous law journal articles.

LEASEHOLD ENFRANCHISEMENT
LAW AND PRACTICE
Piers Harrison and David Lonsdale
Price: £95.00
ISBN: 9780854900657
Extent:374 pp
Binding:Hardback
This practical book is written with the busy practitioner in mind, explaining the
law in clear and simple terms and concentrating heavily on procedure. The procedural chapters make up the greater part of the book and are designed to ensure that
the practitioner drafts notices without mistakes and understands the critical time
limits.
Leasehold Enfranchisement contains checklists of mistakes to be avoided in the
preparation of notices and clear guidance on procedure post service of the notice.
The book enables the reader to find essential information easily.
Fully up to date with the new procedural rules, Leasehold Enfranchisement
includes the latest forms published by the First-tier Tribunal. It is accessible and
practical, providing guidance on filling in notices, and checklists of common mistakes to be avoided. The authors provide plenty of detail on how to accomplish
the main task for a solicitor in this area. The book also tackles valuation in a way
that a non-valuer can understand so that the solicitor understands the valuation
exercise.
Piers’ property practice covers all areas of property law and clients include property development
companies, local authorities, government agencies and private companies and individuals. He is an
editor of Landlord and Tenant Review. He has a particular interest in enfranchisement but his practice encompasses all areas of the law of real property. He is author of Service Charges & Management (3rd ed) and Megarry’s Manual of the Law of Real Property (9th ed).
David Lonsdale has over twenty years’ advocacy and advisory experience at all levels up to the
Court of Appeal, including specialist tribunals such as the First Tier Tribunal. David’s areas of particular specialisation are leasehold enfranchisement, restrictive covenants and forfeiture of commercial leases, but he accepts instructions across the range of Property law disputes as well as appearing
and advising on cases in related fields such as professional negligence and insolvency. David is
instructed by client companies with an international presence as well as local authorities, managing
agents and individuals.

LEGAL CONSCIOUSNESS

Vladimir A. Tomsinov
Studies in Russian & East European Law Series
Price: £65.00
ISBN: 9780854901463
Extent:402 pp
Binding:Hardback
Ivan Aleksandrovich Il’in (1883-1954) has become in post-Soviet Russia one of
the most eminent legal philosophers of the twentieth century. This volume brings
to an international readership for the first time what is perhaps the most impassioned and prescient work by a Russian jurist in support of the rule of law.
Il’in has heretofore been accessible only to those who have a command of Russian, German, or, exceptionally French, and even then primarily in circles where
Russian émigré literature circulated. Originally written and in galley proofs
between 1916 and 1919, the final work on legal consciousness was not published
until 1956 in Germany and only in the 1990s in Russia, where it has generated
considerable impact. Il’in’s most original and influential contribution to legal
theory, this long-awaited English translation will inform discussions of legal consciousness for decades to come.
Il’in’s monograph is accompanied by one of his early and influential articles on
concepts of law and power and by essays devoted to Il’in and the rule of law; the
origin and transformations of the concept of legal consciousness, and the origins
of Il’in’s treatise on legal consciousness, a glossary of key legal terms, and a bibliography of works by or devoted to Il’in.

A Practical Guide to Mediation
and Litigation 6th ed
Patricia Pearl and Christopher Dodd
Price: £19.99
ISBN: 9780854901425
Extent:332 pp
Binding:Paperback
Legal professionals rarely receive any formal training or guidance on how to run a small
claims case in the county court, while litigants in person often have to conduct such cases
without legal representation. A lack of understanding of the rules frequently leads to
confusion and mistakes, which in turn adds to expense and causes delay. The sixth edition
of this well-established book includes everything which a professional advisor or one off
court user needs to be confident and successful with pursuing or defending a claim allocated to the small claims track in the county court.
Small Claims in the County Court has been updated to take into account a large number of
changes in procedure and rules over the last two years, including the increase in jurisdiction to £10,000, the introduction of the single county court and new rules and terminology
concerning enforcement.
The authors demystify a process which can be overwhelming to court users. The book
includes summaries of key rules and procedures and more detailed text follows. There
are checklists to guide users through key stages of a court case and answers to frequently
asked questions. The glossary is an invaluable tool for any court user who is unfamiliar
with legal jargon. The authors have added all necessary case and rule citations and there
is a full index. Key court rules plus up to date court fees are reproduced at the back of the
book.
Written by authors with experience as a solicitor and a barrister but also with over 20
years combined experience as judges, this popular title will prove invaluable for busy
practitioners and litigants in person alike, equipping them with the latest know-how on
avoiding errors and making the most of the procedures that are available.

The law and procedure relating to sexual offences is notoriously complex. Since the advent of the
Sexual Offences Act 2003, the law (both as to the offences and as to sentencing) changes depending
on when the offence was committed, the age of the parties involved and the nature of the act committed.
This new edition of the Sexual Offences Handbook has been updated to reflect the latest law,
practice and procedure in all cases involving historic and recent sexual offences, providing a stepby-step approach from the perspectives of both prosecution and the defence. Written by practitioners and academics with extensive experience of researching, preparing and presenting such trials,
this practical and accessible work will prove an invaluable reference for those working within this
specialised area of criminal law.
Felicity Gerry QC specialises in high profile, serious and complex fatal, sexual and violent offences.
She is regularly approached to speak on international issues including human trafficking, FGM and
rape in conflict zones. Felicity is described in the Legal 500 as a ‘fearless and effective advocate’
and ‘an expert in the field of sexual offences’. She has appeared on all major television and radio
networks and writes regularly for the broadsheet and legal press. She holds a research post at
Charles Darwin University and has a column in Criminal Law and Justice Weekly.

CASE HANDLING
An Illustrated View from the Bench
HH Nicholas Chambers QC
Price: £10.00
ISBN: 9780854901470
Extent:55 pp
Binding:
Paperback in colour
‘Experience of all sorts at the Bar and on the Bench has led to the thought that a
few timely words could avoid a lot of grief as well perhaps bringing a smile or
two from the pictures.’
At the Bar Nick Chambers did a great variety of cases ranging from the miners’
respiratory claims to the Kuwait Airways litigation. On the Bench his job was
to manage and try cases as the Mercantile Judge for Wales and Chester and
then for Wales as well as sitting in London in the Commercial Court and other
jurisdictions. He was a member of the Civil Procedure Rule Committee at the
time of the introduction of the Woolf reforms. He now practices as an arbitrator
and mediator from Brick Court Chambers.
The Chambers family’s involvement with watercolours goes back to 1779 with
an ancestor’s sketches during the Siege of Gibraltar. Since then each generation
has made its own contribution including scenes from Mumbai in the V&A and
the first illustrations of the rules of rugby football done at the school in 1845.
Illustrations and texts from Nick’s book Missed Moments in Legal History hang in
the Rolls Building. The pictures in Case Handling pay a further happy tribute to
his past.
This book, with its pithy advice and attractive illustrations, makes taking the
serious medicine of case handling a pleasure both for the recently qualified and
anyone else with an interest in making dispute resolution work.

inheritance by will and by intestacy, acquiring an inheritance, protection of estate
property, division of the estate and expenses, defense of inheritance rights, and

THE LEGAL REGIME OF CHINESE
OVERSEAS INVESTMENT
by
Chenyang XIE
JCL Studies in Comparative Law No. 11
Price: £65.00
ISBN: 9780854901531
Extent:290 pp
Binding:Hardback
China has become the first socialist legal system to acquire an interest and the capacity to
invest significantly beyond its own borders and abandon the policies of economic autarchy that approaches to socialist economic planning seemed to impose upon predecessor
socialist legal systems. In this pathbreaking study, Dr. Chenyang XIE examines how the
Chinese legal system regulates – usually by default rather than design – Chinese investor behavior with respect to outward investment opportunities and/or priorities. He offers
intelligent and perceptive critiques of legal rules, institutions, systems, and administrative
practices, providing suggestions for potential reform or adjustments of these.
Drawing upon the Chinese tradition of codification, the author has prepared a draft Code
of Overseas Investment Law, together with Commentary to explain why each formulation is desirable and necessary. In his view, Chinese overseas investment relations are a
“legal laboratory” for shaping a constructive legal regime to encourage and regulate such
investment. His bold, subtle, and nuanced strategy embodies reservations about the extent
to which in a planned economy the State should assume investment risks rather than the
non-State sector.
Subjects covered include the Chinese macro policies and concepts of overseas investment, information services, investment promotion, approvals, authorizations, and filings,
financial support, foreign exchange regulation, insurance, taxation, and supervision Stateowned assets abroad. The draft Code of Overseas Investment Law is the first of its kind
for any legal system.
Chenyang XIE received his LL.M. and S.J.D. degrees at the Pennsylvania State University. He has many years of experience with legal aspects of inward and outward Chinese
investment flows as a senior legal advisor employed by The Tiens Group in China.

This study offers the reader an in-depth analysis of the role of law in China’s impressive
post-Mao economic transformation, contextualizing the Chinese experience in law and
development theory and its application to China. The book makes a substantial contribution to discourses on the very important issue of the nature of the Chinese land system
in the transformation from state-planning to the market. It is an on-going debate as to
whether demarcated and secure property rights are essential for sustainable economic
development. In addition, land is an extremely important issue in China, especially in
terms of the role of state and the manner in which the state is dealing with land ownership
and other rights in times of change. The book examines the hybrid dynamic of Chinese
land law, the multi-layered stakeholders involved, and the varied and divergent incentives
for exploiting land. The evolution of mainland China’s land system has been shaped by
various political and social forces, and the book highlights key aspects of the nature of the
law and how complicated the law in action can be in transitional socio-economic systems
such as that of China. The book also offers an evaluation of western mainstream theories
of property rights and their relevance for understanding the place of land rights in Chinese
society.
Dr Yixian Zhao, LLB, LLM and JSD (City University of Hong Kong), is a lecturer in
law at Shantou University, and her current research interests are focused on issues of law
and development, including in BRICS (that is, the Brazil, Russia, India, China and South
Africa grouping of developing states), and on law and society matters. She has been a
research associate and postdoctoral fellow at the School of Law, CityU Hong Kong. She
at present teaches Jurisprudence, Law and Development, Sociology of Law and Land

Handbook for Magistrates 06/11/2012 15:52 Page 1
This new edition reflects the many changes introduced over recent years. These
include revisions to the procedure for applying to become a magistrate and the
training requirements; the introduction of the Criminal Procedure Rules, case
management and other measures to reduce delay; the landmark Courts Act 2003;
amendments to the Bail Act 1976; and wholesale revision of the approach to
sentencing.
The authors, one a deputy justices’ clerk, the other a serving magistrate, bring
two different, but equally important, areas of experience and expertise to the
work and explain complicated concepts in a straightforward manner, keeping legal
jargon to a minimum.
“… a welcome addition to the list of appropriate books for magistrates and prospective
magistrates. It is aimed not only at newly appointed members of the bench, but will also
be of considerable interest and assistance to those with more experience … there is a
great deal of support for magistrates in this handbook. It will also be of interest to other
court users including legal advisers and probations staff. This is a thorough and carefully
researched work.” From a review of a previous edition in The Magistrate
“Magistrates old, new and prospective will gain much from this book … The authors
have succeeded in providing a wide-ranging account of the work of lay magistrates. A
lucid explanation of a magistrate’s work and duties is found in this book. The text is
written with the non-lawyer in mind.” From a review of a previous edition in
New Law Journal
“[the book] will be appreciated both by serving and prospective magistrates and, indeed,
anyone with an interest in this hugely important feature of the administration of justice
in England and Wales.” From the foreword by the Rt Hon. Lord Judge, Lord
Chief Justice of England and Wales

Wildy’s Handbook for Magistrates Robert J. Allan & Pauline M. Callow
Wildy’s Handbook for Magistrates (previously published as Blackstone’s
Handbook for Magistrates) is a readable and comprehensive account of the work
of magistrates in England and Wales. It examines how magistrates are appointed;
what they are empowered to do; how their courts are organised and operated;
the kinds of matters they deal with – crimes such as theft and assault, traffic
offences and issues concerning children and families; how they go about assessing
evidence and deciding what to accept as true; how they decide whether
defendants should be released on bail or kept in custody; the sentences they may
impose and how they endeavour to make the punishment fit the crime. The book
also looks at how legal aid works, a subject of continuing public and political
concern. Last, but not least, it gives a flavour of what life as a magistrate is really
like, touching on the pressures, responsibilities and rewards of the work.

COMPARATIVE ASPECTS
Leading authorities explore the successes and shortcomings of the
1980 Hague Convention on the Civil Aspects of International
Child Abduction in the thirty years that have elapsed since that
Convention entered into force. Special attention is given to
national legislation implementing the Convention and to judicial
practice applying Convention and legislative provisions. The
Convention continues to attract ratifications, and lawyers from
many countries will find the thoughtful articles contained in this
volume helpful in understanding comparative approaches to this
increasingly important domain of international legal cooperation.
THE EDITOR
Robert E. Rains is Emeritus Professor of Law at the Dickinson
School of Law, Pennsylvania State University. His career as a
family law specialist spans the decades in which the Hague
Abduction Convention has been in force.
