Medicaid Rules for Long Term Care Part 2 of 4 Spousal Impoverishment Rules There are special rules that apply to couples and prevent the healthy spouse from being impoverished due to a lack of assets or income. Regardless of who owns them, all assets are considered jointly owned by the couple. Generally speaking, assets are totaled, then split in half and a healthy spouse at home keeps his or her half and the Medicaid applicant must spend down his or her half until it is less than $2,000. This money need not be spent on care but can be spent on any legitimate purchase. One of the rules addressing the stay-at-home spouse’s needs is called the Community Spouse Resource Allowance (CSRA).. Community Spouse Resource Allowance (CSRA) The CSRA is calculated from the spousal one-half share of the assets and equals the greater of the state minimum resource allowance ($31,290.00 for 2013) or one-half of the couples’ total countable assets held either jointly or separately. So the stay-at-home spouse should be able to retain at least $31,290.00, plus other noncountable assets such as the family home. But if the CSRA is greater than the federal maximum community spouse resource allowance (or $115,920.00 for 2013), then the institutionalized spouse will not be Medicaid-eligible until the community spouse (the one in the nursing home) has to spend down her/his share to $115,920 for 2013). Community Spouse Monthly Income Allowance (CSMIA) Incomes are not considered jointly owned and do not have to be split in half. If Jim has $3,000 a month in income and Bonnie has $800 a month, and Jim applies for Medicaid, then Jim’s entire $3,000 will go towards his care and Bonnie will presumably be left impoverished with only $800 a month. The reverse is also true if Bonnie needs the care. Jim can keep his $3,000 and the state must make up the difference between Bonnie’s $800 and the cost of the nursing home. If Jim is applying for Medicaid, and in order to avoid complete impoverishment of Bonnie (she only has $800 a month) the state will transfer enough of Jim’s income to bring Bonnie’s personal needs income up to a level somewhere close to one-half of their joint incomes, consistent with annual regulatory revisions. This arithmetical process is called the Community Spouse Monthly Income Impoverishment Allowance (CSMIA). A full explanation of the process is beyond the scope of this article.
