Bev Fryer recognized as MSGA’s Ranching Woman of the Year
Sale season is about to come to a screeching halt for me! I
am down to the point where I only have one more bull sale
to attend at the end of April. Honestly, it doesn’t seem like
bull sale season should be over yet. I know that may sound
kind of strange to many of you as I have had numerous
people come up to me over the past couple of weeks and
ask me if I’m glad that sales are about over.
As good as the sale season has been and as nice as the
weather has been for traveling (for the most part), it feels like
sale season should keep going! Don’t take this completely
wrong as there is certainly a part of me that is relieved that
it is winding down, but this is one of the first years that I
never really counted down how many sales I had left in
the last couple of weeks of the sale season!
It is hard to wish that the sales would get over when you
step back and look at all of the sale results around Reporter
Country over the past three to four months. The sales have
been fantastic! I would venture to say that the majority of
the sales were $500 to $1,500 per head higher this spring
than they were last spring. There were also cases in which
the sales were $2,000 to $3,000 higher than last year!
Like I mentioned earlier, the weather was also extremely
nice, and I really did not have to drive on very many icy
roads at all! One thing is for certain... I did do a lot of
driving since the middle of January! In fact, I put 25,000
miles on my pickup since returning from the National
Western Stock Show!
The month of March is when it seems like I am away
from home the most. If I remember correctly, I believe I
was only home about eight nights, and I put in one stretch
where I was only home a couple of nights in two and a
half weeks! I guess it will come as no surprise to most of
you that my wife decided to go out to New York to see our
daughter during her spring break from college on March
11, as I was gone so much anyway. Well, to make a long
story short, she was only really planning to spend a week
or two out there and then come back. But she is still there!
I am planning on traveling out to New York immediately
when I get my last bull sale done and spend some time with
Machaela in New York. We are also planning on catching
up with Zack and his band and try to take in a few shows
as well. I have put on a lot of miles this spring, and it
looks like I am going to put on a lot more here in the next
couple of weeks!
By the time I return home from seeing the kids, it will
be time to put on the A.I. gloves and get to work. I know
many operations are full swing into the A.I. season, and I
know of quite a few operations that are already done with
A.I. and are getting ready to put the bulls out.
Like I said, I am really not excited that sale season is
coming to an end, but I will have plenty of things to keep
me busy... it will just be a different kind of busy!

water rights.
But careful analysis of the
Treaties, federal law, and
case law shows a number
of startling things:
- The Treaty of Hellgate
covered only two areas of
land... and both of them are
WEST of the Continental
Divide. The first area is the
lands ceded to the United
States in Article I of the
Treaty. The second area of
land is the Flathead Indian
Reservation, which was
reserved out of the lands
ceded to the United States.

right to fish and hunt -- in
common with the citizens of
the Territory -- was secured
only in those two areas.

granted outside of these two
areas of land.
- The Judith River Treaty
-- initially encompassing all
of the Blackfeet Territory
- specifically excluded by
name the Flathead Indians
(outlined in blue). Article V
of the Judith River Treaty, of
which the Flathead Nation
was a party, provided that
the Flathead (now CSKT”)
west of the Continental
Divide agreed to remain
on the western side of the
Divide and would not enter
the common hunting ground
established by the Treaty,
hunt, or disturb the game
when visiting the Blackfoot
Territory for trade or social
intercourse. The common
hunting ground for all the
Tribes -- in which NO tribe
was able to establish any
permanent residence -- was
more like a war zone with
no permanent Indian settlements.
- Finally, the red line
“subsistence area” of the
Flathead used by the Com-
pact Commission to frighten
Montanans into believing
there was an actual claim
to water in eastern Montana
by the CSKT just shows the
range in which they wandered. But the underlying
treaty law proves that the
Flathead were excluded
from eastern Montana.
But now that the legislature
has passed the Compact,
it has inadvertently given
credence to false claims.
So guess what, Eastern
Montana? It looks like the
door has been swung wide
open for other Tribes to now
claim water rights all over
the state because of what the
Flathead got in the CSKT
Compact. Don’t think that
will happen? Think again.

comes knocking on your

With the world’s food
consumption boom a decade
old, it behooves all people
who grow food to pay attention, including the livestock
business. Natural fish populations have been depleted,
and in 2012, farm-grown
fish accounted for a record
42.2% of global output, the
Wall Street Journal says.
That number was 13.4% in
1990 and 25.7% in 2000. A
full 56% of global shrimp
production now comes from
farms, mostly in Southeast
Asia and China. Oysters
are started in hatcheries and
then seeded in ocean beds.
Atlantic salmon fishing,
which only started in earnest in the mid-1980s, now
accounts for 99% of world
wide production, it said.
Here in the United States,
the animal industry has done
wonders in production at
all levels, but we are competitors with other forms of
protein, including fish. The
product fish is very much in
demand in many sizes, colors, and varieties. If they are
going to be growing these
on farms or in beds under
control, we in the livestock
business producing animal
protein from blood animals
had better pay attention
because we will see it the
competition right on our
doorstep before we know
it if we don’t pay attention!
I happen to be one of those
true believers in animal protein. The brain and nervous
system of a human being
need iron that comes especially from beef. Therefore,
animal protein will have
more need and more value
than we’re giving it now.
I’ve felt that for a long time.
So we better keep things
rolling along in favor of
red meat! I know that red
animal protein is the best
you can get, as I read and
study it, in the development
of the human brain and nerve
system. It’s the number one,
so let’s get after making sure
there’s going to be plenty of
that available in the future.
One last thing being talked
about an awful lot across
Reporter Country lately
is moisture. Much of the
area got a pretty good shot
the last week or two, and
there’s quite a lot of snow
in the high mountains for
summer water. It appears as
though the charts are showing a pretty good chance of
added moisture throughout
farmland America. We could
see a great, great year unfold.
It’s got all the earmarks.
This last storm in western
America will be bountiful
to people in farming and
livestock agriculture.

USFS backs away from groundwater grab
Western ranchers are taking a victory lap after the
U.S. Forest Service (USFS)
Deputy Chief Leslie Weldon
announced April 14 that
the agency is “not moving
forward” with a proposal
to impose unprecedented
regulations on water on and
near USFS land. The agency
owns 193 million acres of
forests and grasslands across
the West, but that doesn’t
mean it owns the water
on those acres, said cattle
rancher Brenda Richards
of Murphy, ID. Richards
is the President of Public
Lands Council (PLC), which
represents ranchers with
public land grazing rights
in the West.
According to PLC’s written comments, USFS was
attempting to control nearly
all waters found in a watershed - both surface and
subsurface - if that water
was thought to somehow
affect water on USFS land.
Neither statute nor case law
supported this effort, said
PLC. “The federal lands are
a ‘split estate,’ meaning that,
while the surface may be
owned by the government,
there are private owners of
the resources, like water,
minerals and forage,” said
Richards in an interview.
“With this proposal, USFS
was essentially telling us
that privately-owned water
rights on federal lands were
to be a thing of the past.
Here in the West, water is
our lifeblood. USFS is doing
the right thing by pulling this
directive back. It would have
crushed our industry and
many others.”
Although the news was
applauded by citizens across
the West, Weldon did indicate the gig’s not up: The
directive will likely spring
up again, after USFS engages in more “dialogue
with stakeholders.” If the
directive does rear its head
again, PLC and its coalition will be keeping a sharp
eye out for the untenable
characteristics of the first
proposed directive, Richards told Western Livestock
Journal (WLJ). “The agency
claimed ‘federally reserved
rights’ to regulate this water,
but they have no such right,”
said Richards. “The states
are still in charge of adjudicating water rights within
their borders-including on
national forests.”

Furthermore, Richards
pointed out, the proposed directive gave unprecedented
power to USFS personnel,
putting at jeopardy water
rights owners’ ability to use
their water. “Not only would
there have been massive new
regulatory hoops to jump
through in order to use your
water right; but also you
could have gone through all
that and then the ‘authorized
officer’ could just deny your
application anyway, if he
thought groundwater resources would be ‘compromised.’ Not every authorized
officer would have abused
this power, but you can bet
some of them would have.”
Richards also said the
proposal would have been
a constitutional taking of
private property, again, at
the whim of a forest-level officer. “Just consider this language from the directive,”
she said. “’When issuing or

uses...
Not only was USFS’ proposal a “direct assault” to
state primacy over water
rights allocations, Richards
told WLJ, but it was also
a death knell to multiple
uses on USFS land. Vague
language in the directive
would have made practically
all activities on USFS land
vulnerable to regulation,
litigation, and curtailment,
she said. For example, the
draft directive instructed
USFS personnel as follows:
“Prior to implementation
or approval of proposed projects, approvals, and authorizations, assess their potential
to affect the groundwater
resources of [National Forest System (NFS)] lands. If
there is a high probability for
substantial impact to NFS
groundwater resources, including its quality, quantity,
and timing, evaluate those
potential impacts... Require
that monitoring and mitigation is conducted, evaluated,
and reported...”
Richards noted that this
language put every activity
and decision on the forest at
risk, including the renewal of
grazing permits. She added
that other language in the
directive instructed USFS
employees to overlook state
law. For example, it directs
personnel to “assume a
hydrological connection
between groundwater and
surface water, regardless of
whether state law addresses
these water resources separately.” This assumption
of connectivity didn’t just
ignore state law; it would
have put practically any activity on the chopping block,
Richards told WLJ. “Is there
anything that happens on the
forest that doesn’t somehow
connect to surface water?”
she said. “Not likely. So
USFS would have been
openly inviting anti-grazing,
anti-use groups to use that
language to litigate any activity they didn’t like.”
Richards added that the
new monitoring and reporting requirements - albeit selfimposed by USFS - would
have put a strain on agency
resources. “In all likelihood,
they won’t be able to live up
to their own monitoring and
reporting directives. Those
same litigious groups would
have been circling in the air
just waiting for the agency
to fall behind so they could
sue again. It would have
been a lucrative business for

ever since as she and husband Ed have been operating large cattle ranches for
the past 40 years.
Early life and
marriage...
Bev grew up on a family
farm in Fishtail, Montana,
with her parents, Jake and
Agnes Schaff, and six siblings. There was plenty of
work to go around -- milking dairy cows, feeding
pigs, and taking care of
cattle, horses, sheep, and
the family’s hay ground and
custom farming operation.
This work surely instilled
a strong work ethic for
Bev and her siblings at an
early age.
Bev received a bachelor’s
degree in elementary education from Montana State
University. Through her college career, Bev continued a
heavy work schedule, as if
it was not a job, but rather
a way of life. Afterward,
she committed to teaching
grade school in a rural community until she realized her
time and efforts were more
important to her family by
helping on the ranch.
Ed and Bev married in
June of 1973, while he was
working as a cowboy on
the Flying D Ranch. Bev
worked at a laundry and
helped around the ranch.
They spent several weeks in
a tent camp, pushing cattle
near the forest boundary,
packing salt, and sawing
trails. From the very start,
Bev was heavily involved
in calving season, sorting
pairs, feeding calves, and
any other chores that needed
to be done. She pitched in
on brandings too and even
became a good roper.
Through the late 1970s, the
couple worked on ranches
in the region. Bev became
heavily involved in largescale AI projects, tasked
with heat detection, and she
pitched in for every task on
the ranch and taught children
at rural schools.
Starting a family...
As their two boys came
along, Bev brought them
along for the ride, rather
than letting them slow her
down. Last year’s Ranching Woman of the Year
recipient, Glenna Stucky,
is a longtime friend of the
Fryers, having known Bev

‘70s. One story Glenna
loves about Bev shares her
dedication to ranch work.
“When Bev was pregnant
with one of the boys, they
lived at the Home Ranch,
which was probably five
miles and several wire gates
from a county road on the
way to Bozeman. As one of
the boys was about to arrive,
Ed was driving Bev to town.
When they came to a gate,
he would ask, “Bev, are you
having a contraction? Can
you get the gate?” And she
always managed to get the
gates!”
Bev continued being a crucial part of operating ranches
where she and Ed worked in
Montana and Wyoming. Not
only did she hone her skills
in the calving shed, but Bev
also worked to develop early
individual identification
systems to track individual
animals; managed the budgets, payroll, and accounting
for multiple ranches; and
grew large gardens that fed
entire working crews on the
ranches.
As their boys, Jim and
David, grew up, Bev made
sure they were involved in
ranch work and several 4-H
activities. The family took
several market steers and
horses to the county and state
fairs, competed in shooting
sports, and worked in many
community events.
Move to Castle
Mountain...
In 1998, Ed and Bev moved
to White Sulphur Springs to
the Castle Mountain Ranch,
where Bev continued her
heavy involvement in operations of the ranch. Over
the past 17 years, Bev has
been the main calver for the
ranch, watching over 300
heifers each year, assisting
any new mothers or calves
who need help to get a good
start, and riding through the
mature cows several times
a day until turned out to a
larger pasture.
No starving, weak calf is
too hopeless for her to nurse
back to health. Bev will
send the newborns and their
mothers off, but only after
confirming a good match
with plenty of milk. She
always tells the men she expects to see the calves doing
well at branding. They know
she will recognize them,
with or without their tags.
Bev breaks all the baby
colts on the ranch to lead
and stand tied in the barn.
The guys may have to rope
a honky one for her once in
a while, but most of them
she gets by herself. Almost
all of the Castle Mountain
horses have had the benefit
of Bev’s first winter’s training and grain.
At Castle Mountain Ranch,
Bev manages a special
cow elk hunt, developed to
disburse and reduce a local
concentration of elk. She
takes all reservations on a
single day for around 150
hunters to spread over the
entire season. Bev meets 10
or 12 of those hunters at the
ranch office an hour before
sunrise every day during
the season, collects their
personal and vehicle identification, conducts a short
orientation, assigns maps
and hunting areas, and doles
out a few tips along the way.
Most hunters are amazed at
her detailed knowledge of
both the country and elk.
Most hunters have success,
with 50-75% of them getting
elk exactly where Bev says
they will be.
Taking care of friends
and community...
According to her husband
Ed, one of the things Bev
always does well is cook
for large groups of guests
and ranch crews with few
supplies and hardly an extra trip to town. She may
be short an ingredient, but
it never seems to matter
much as everyone will be
fed. Ed describes one such
event: “Years ago, after dark
one night before a big ship-

ping, Bev discovered I had
no lunch plans for the crew
the next day, in an area 50
miles out from any kind of
services. With a bit of bustling around, Bev had hot
stew and coffee for a dozen
of us, plus 25 truckers. All
this was prepared on a camp
stove, while she helped
weigh cattle on what turned
out to be a very squally day.”
For several years, Bev has
hosted prime rib Christmas
parties for 25 people at a
time and served up lunches
for the crew at brandings,
while pitching in herself, and
feeding a family of growing
boys and dealing with all
the challenges ranch life
may bring.
Through the years, Bev
has been heavily involved
in the local and state CattleWomen organizations. In
White Sulphur Springs,
she leads a group feeding
two-day breakfasts for over
1,000 attendees of the annual Red Ants Pants music
festival. However, Bev’s
love for sharing food, beef
in particular, does not stop at
the kitchen. She has worked
through CattleWomen to
participate in several beef
education programs and
has served terms as local
and state President. She has
participated in the National
Beef Cook-off several years
and works hard to help others learn the importance of
beef as part of a healthy diet.
Somehow, Bev also finds
time to participate in several
community events, including several local ranch rodeo
teams through the years.
Putting those ranch skills to
good use, Bev has contributed to winning teams and
helps to host a local ranch
rodeo for the past several
years.
Importance of family...
Family is incredibly important to Bev, as she has
raised her two sons and now
enjoys taking care of five
grandchildren. Both her sons
were raised as a big part of
the ranches where the family worked, and each now
works on cattle operations in
Montana. Bev makes sure to
nurture her extended family
with equal energy.
Jim’s wife Heather remembers wondering when she
first met Bev, “Where does
all this energy come from?”
and now Heather says she’s
never met a harder working
woman. Bev asked Heather
to help on a three-day project
once, and they worked every
day, non-stop. At the end,
Heather was exhausted, but
Bev, on the other hand, was
fine and even wanted to go
to the Hot Springs for a soak
at the end of the day.
Bev continually supports
her family as Ed’s right-hand
man for more than 40 years
of working together. She has
helped her family through
several projects, adventures,
long-distance moves, and
several newborn babies.
Bev’s mother is 93 years
old and still lives alone. Bev
frequently makes the trip to
Fishtail to help her mother
get to doctor appointments,
with spring and fall cleaning, and the occasional
exploration trip.
Bev Fryer is described time
and again by family and
friends as a true example of a
woman who is the backbone
of the ranching operation
and her family, a true positive role model in her communities, and a complete
inspiration to be around.
As a woman who exemplifies all the characteristics
of a person who makes a
truly positive contribution to ranching, Montana
Stockgrowers is proud to

year’s Ranching Woman of

conservation strategies to
limit total water withdrawals
from NFS lands deemed appropriate by the authorized
officer.’ With this kind of
authority put in the hands of a
sole government employee,
your ‘water right’ would be
almost completely useless.”
The draft directive even
proposed to somehow control water use on lands
adjacent to NFS lands.
“Evaluate all applications
for state water rights on NFS
lands and those on adjacent
lands with the potential to
affect NFS groundwater resources. Identify any injury
to NFS water rights and
groundwater resources in
applicable federal, state, and
local proceedings...” In other
words, water rights holders
using water that originated
on USFS land should be offlimits. This is significant in
that an estimated 50% of the
water in the West originates
on USFS land.
The Montana Suffolk
Breeders Association
(MSBA) was founded in
1981. The purpose of the
association is to foster,
promote, and develop the
Suffolk breed and the sheep
industry in general.
The MSBA is awarding
one $300 grant to be used
for the purchase of a Suffolk ewe lamb or yearling
ewe. This grant is for a male
or female youth between
the ages of 9 and 16 and a
resident of Montana. The

Redefining water
rights...
Richards told WLJ that
another excerpt, this one in
the “definitions” section,
was particularly troubling.
The agency claimed that a
“water right” on USFS land
“confers no property right
or ownership interest in the
physical access to the water
source... even when access
is needed for the physical
withdrawal of the water.”
“It seems to me this directly contradicts the recent
victory won by the Wayne
Hage family, when the court
granted them access to their
stockwater as an essential
part of their water right,”
Richards said. “We must
stand behind this victory and
not let a federal agency wick
away our rights by changing
definitions.”
USFS put its directive on
hold... for now. But Western
lawmakers are not counting
their chickens. Tucked away
in various pieces of pending
legislation are measures to
protect privately-held water
rights, on and off federal
lands. In the draft budget
for 2016 through 2025,
for example, Senator Cory
Gardner (R-CO) offered
an amendment to protect
privately-held water rights
and permits. Rep. Scott
Tipton (R-CO3) is reportedly geared up to reintroduce
legislation to protect water
rights on public lands. His
bill passed the House last
session, but was held up in
the Senate. This session,
the bill’s prospects may
be better, given the 2014
election results. Though the
fight’s not over, Richards
said Westerners should hold
their heads high. “We should
consider this a considerable
victory for two reasons.
First, it reminded us of the
importance of defending
states’ rights and our own
private property. Second,
it showed us the power we
have as Westerners when
we all join together and say
‘Enough!’”

USCA & Brenn Hill team up for special promotion
The United States Cattlemen’s Association (USCA) is pleased to announce an upcoming promotion on behalf of
singer-songwriter Brenn Hill. In recent years, Brenn Hill has partnered with USCA in donating a portion of his album
sales to the organization. The release of Brenn’s 11th studio recording, Spirit Rider, and the first release on the new
Defenders Recording Label, will once again provide an opportunity for producers across the country to support both
Brenn and USCA. Recorded at Spiral Recording Studios in St George, Utah, and produced by Brenn Hill and renowned
Multi-Instrumentalist Ryan Tilby, Spirit Rider is Hill’s first faith-based recording. It features six original songs penned
by Hill, covers of Texas cowboy classics like Andy Wilkinson’s “Power In the Wind” and Red Steagall’s “One Empty
Cot In The Bunkhouse” and classic hymns like “Nearer My God To Thee,” “The Old Rugged Cross,” and “How Great
Thou Art.” Hill states, “I want to make a statement of hope with this recording for those who have supported me and
anyone who needs a reminder that faith is real. My friends in the ranching industry have taught me that time and again.”
Hill has partnered with USCA in recent years with a joint promotional effort during the holiday season by sharing a
portion of his record sales with USCA. Hill will send a portion of the proceeds of each sale of his new release, Spirit
Rider, to USCA. The promotion will run through the month of April 2015. “I want to contribute to those that inspire
me to keep writing and singing. The times are difficult, the West is dry, and the future is uncertain for the heartland
and American agriculture. I need to do my part.”
