April 24, 2015 RE: Revocation and Closure of Bay Area Charter School Bay Area Charter School Employees, The Texas Education Agency (TEA) is providing you this letter to prepare you for the closure of Bay Area Charter School and the three campuses (elementary school, middle school, and high school) operating under the charter as public, accredited schools. On December 8, 2014, the Commissioner of Education communicated to Bay Area Charter School, Inc., your school’s charter holder, the statutory criteria that require the state to revoke the charter granted to Ed White School of Educational Enhancement, the school’s original charter holder, by the State Board of Education (SBOE) on May 15, 1998. The TEA has a responsibility to students and state taxpayers to ensure that each charter school that is authorized is fulfilling its performance and financial obligations. Bay Area Charter School has not met its academic accountability requirements for the past three years in which the state has issued accountability ratings. Bay Area Charter School has had academically unacceptable ratings in years 2014, 2013, and 2011. These ratings caused the charter to meet the criteria of default closure as cited in the Texas Education Code §12.115(c). The charter campuses will be effectively closed on July 31st. Any students needing to retake the state assessment will still report to their current campus for testing. As public entities charter schools are the custodians of student and staff records. In the instance of a closure of a charter school, the state secures these documents. After the school is closed, Education Service Center (ESC) 4 will temporarily house your personnel service records. Employees are encouraged to verify service credit with the Teacher Retirement System of Texas (TRS) for service rendered prior to August 21, 2015. If it is determined that you have eligible unreported service, to obtain credit, you must first have your employer verify the service on a “Verification of Service and Salary” form (Attachment A). Please be advised that, unless employment with another TRS eligible entity is procured, you will no longer be a contributing member of TRS after August 21, 2015. State healthcare provider benefits and any other state benefits or immunity granted to public education personnel will expire at the end of August 2015. INSTRUCTIONS FOR MEMBER: Employment that is eligible for TRS membership is employment in a Texas public educational institution for at least one-half the standard workload, paid at a rate comparable to someone employed in a similar position. To establish service credit, prior to the 2011-12 school year, a person must have served in an eligible position, by an eligible employer, for a period of at least four and one-half months, a full semester of more than four months, or, in some circumstances, 90 days in one school year. For the 2011-12 and later school years, a member must work or be on paid leave for at least 90 days in one school year to receive a year of service credit. In addition, if there is no equivalent full time position of a given position, the minimum number of hours required per week that will qualify the position for TRS membership is 15.
