There’s been plenty of news items this past year to concern independent agents and brokers. One of the most talked about is the definition of “agent” and “broker” which got one of the biggest carriers utilizing agents/brokers in a bit of trouble. Anyone who has been aware of regulatory and legislative action the past two decades knows that if you charge a broker fee, you have to be a broker. What constitutes a “broker” is a matter of debate. Other big news is that a certain search engine behemoth has stepped into the insurance aggregator business. Not sales (yet), but ostensibly showing insurance shoppers where they can find a great deal. As of March 25th, there were 14 willing companies utilizing the Google quote to offer the lowest price on car insurance. That number will grow, count on it. There are 125 companies on Google’s UK insurance site. The point is that companies are not waiting to embrace new (or not so new) sales venues. They are being proactive and so should you. Insurance companies are not leaving agents and brokers behind, they just expect them to stay current. Why should you ask for 1,000 brochures when you can send them out in a .pdf attachment with your e-mail? It’s not about the industry going in a anti-agent direction, It’s about you keeping up. Which is why you are here at the BIG Convention. Maybe you are stuck in your office, you talk with the occasional company rep, maybe have lunch. Even better, you attend the monthly BIG member meeting and connect with people on both sides of the policy and learn a lot. Think of our convention as a BIG monthly meeting on steroids. You will meet new people, rekindle old relationships, and absorb a wealth of information in just three short days. Look over the program and plan your attack. As vice president of product development and marketing from 2008 to 2013, he implemented sales technology and procedures that increased ITC’s revenue by 25% and profit by 200%. An expert in insurance technology and marketing, Rixford created AgencyBuzz, ITC’s automated agency marketing tool, in 2011 and Insurance Website Builder in 2006, which he sold to ITC in 2008. Since Insurance Website Builder’s inception, he has supervised the development of more than 5,000 insurance websites. Rixford consults agencies nationwide on their online marketing initiatives and speaks at various industry events around the country. Page 19 Legal Update with Jon Stanley Heim Jon Stanley Heim is a California attorney with thirty years of successful experience in the fields of insurance regulation, coverage, brokerage, contacts and litigation. Mr. Heim was born in Riverside, California and raised there and on Catalina Island, California. He attended college at University of the Pacific in Stockton, California, the oldest school in that state. There he achieved Dean’s List and was captain of the college’s water ski team. From college Mr. Heim graduated to the University of California, Hastings College of the Law, San Francisco, California. At Hastings Mr. Heim was appointed to the Moot Court Board and taught a section of moot court advocacy. He also worked as an extern to the Honorable Allen E. Broussard, Associate Justice of the Supreme Court of California. In that capacity Mr. Heim advised Justice Broussard, and wrote memoranda, bench briefs and draft opinions for him, on topics ranging from admiralty to insurance to the environment. Notable among such work was National Audubon Society v. Superior Court (1983) 33 Cal.3d 419, which applied the doctrine of public trust ownership of waterways to non-navigable tributaries of endangered Mono Lake, laying the groundwork for restoration of the rare saline lake after historic overexploitation by the Department of Water and Power of the City of Los Angeles. Mr. Heim entered private practice in 1982, first as appellate and law and motion attorney for the noted tort and insurance firm Perona, Langer, LaToracca & Beck in Long Beach, California, then as senior litigator or partner in a series of commercial law firms in San Francisco. In the latter capacity he prosecuted and defended a variety of insurance, commercial, real estate and legal malpractice actions. In 1992 Mr. Heim opened his own law practice specializing in those fields. He continues in that practice and specialties to this day. Mr. Heim has been general counsel or advisor to United Farmers Agents Association, American Agents Alliance and the Independent Brokers’ Network. He has represented domestic and foreign insurers, reinsurers, general agents, surplus line brokers and brokers in a wide variety of contract negotiations and drafting, and judicial and administrative proceedings. Mr. Heim was one of two principal authors of the California Insurance Commissioner’s broker fee regulations, California Code of Regulations sections 2189.1 – 2189.8. Among the published cases he advocated as attorney of record are Heston v. Farmers Ins. Group (1984) 160 Cal.App.3d 402 and Wallis v. Farmers Group, Inc. (1990) 220 Cal.App.3d 718, which respectively established trade secret rights and contract termination protections for thousands of independently-owned insurance brokerages in California. Mr. Heim is regularly requested to speak to or conduct continuing education classes of independent and captive insurance brokers in the western United States.
