DEFINITIONS In this Terms & Conditions, the following words and expressions shall have the following meanings: “Organizer” means BN Youth; “Event Management” means My Events Sdn. Bhd. 2. PARTICIPATIONS FEE & CANCELLATIONS 2.1 Upon submission of the registration form to the Event Management, the Exhibitor agrees to make full payment within 15 working days upon booking, failing which, the Event Management shall bentitled to cancel the booking made by the Exhibitor. The Event Management shall then have the right to allocate the Exhibitor Booth to another Exhibitor. 2.2 For any cancellation made by the Exhibitor on or before the date of the Exhibition, participation fees will be forfeited. 2.3 The GST of 6% (where applicable) would be charged to the client and is payable in full prior to actual event date. 3. ALLOCATION OF BOOTH AND SET UP 3.1 The allocation of booth(s) is at the absolute discretion of the Event Management, in accordance with the nature of Exhibits or in the manner deemed fit and appropriate. 3.2 Should the Exhibitor decide to engage a contractor other than the Event Company, the Exhibitor is required to seek approval from the Event Management. The non- official contractor shall undertake to adhere to all Terms & Conditions contained herein. 4. CONDITIONS OF EXHIBITION 4.1 Exhibitor shall refrain from marketing their services to other participants during the job fair. 4.2 The Exhibitor shall solely responsible for any representations and /or job offers made during its promotion in the exhibition, based on the remuneration package agreed and signed by both parties during the exhibition. 5. PROHIBITIONS 5.1 The Exhibitor is expressly prohibited from displaying any Exhibits which are unlawful, offensive, explosive or immoral at the Exhibition Booth. 5.2 The Organizer and/or Event Management reserves the right to instruct the exhibitor to remove such unlawful or immoral exhibits immediately from the Exhibition Booth failing which the Organizer and/or Event Management has the right to remove the same and the Exhibitor shall be liable to pay the Organizer and /or Event Management costs and expenses incurred. 5.3 The Exhibitor shall not assign, sub-let or allow any other Exhibitor, their agents, manufacturer, employees or supplier to occupy the exhibition space without the consent in writing from the Event Management. 5.4 Exhibitors are not allowed to break down their displays before the close of the exhibition at the time set by the Organizer. 6. RIGHT OF REMOVAL 6.1 The Organizer and/or Event Management reserves the right to prevent access or to remove from the Exhibition space (including the Exhibition Booth) any person or persons acting in a way which may cause a breach of peace, or may be considered to be harmful, undesirable or offensive, or may constitute a danger to public safety including the safety of those present at the exhibition. 7. CHANGE OF THE VENUE AND /OR TIME 7.1 The Organizer reserves the right to amend the venue and duration of the job fairs. The Organizer shall accordingly inform the Exhibitor in the Event of any such change. The change of the venue and duration of the exhibition shall not entitle the Exhibitors to cancel its participation in the exhibition. The Exhibitor hereby agrees that the Organizer shall not be liable for any claim arising from such change. 8. INDEMNITY The Exhibitor undertakes to fully indemnify the Organizer and/or Event Management for any lost items or goods owned or in the possession of the Exhibitor throughout the exhibition. 9. FORCE MAJEURE In the event of fire, tempest, explosion of any kind, failure or neglect on the part of any utilitysupplying electricity or water, labor strife, civil commotion, war, fire or explosions or any other eventbeyond the control of the Organizer that prevents or hinders the Organizer from fulfilling itsobligations under this Agreement, the Event Management shall ensure that the Exhibitor is aware ofthe occurrence of any such event and to cancel or suspend this Agreement by notice in writing to theExhibitor. 10. Payment Terms: Following completion and return of the registration form, full payment is required within 5 days from receipt of invoice. PLEASE NOTE: Full payment must be received prior to the event date. A receipt will be issued on payment. A 50% cancellation fee will be charged under the terms outlined below. We reserve the right to refuse admission if payment is not received on time. The GST of 6% (where applicable) would be charged to the client and is payable in full prior to actual event date. 2. Cancellation/Substitution : Provided the total fee has been paid, substitution at no extra charge up to 5 days before the event are allowed. Substitution between 5 days and the date of the event will be allowed subject to an administration fee of equal to 10% of the total fee that is to be transferred. Otherwise all bookings carry a 50% cancellation liability immediately after a signed sales contract has six (6) weeks before the conference is to be held in order to obtain a full credit for any future My Events exhibition. Thereafter, the full sponsorship fee is payable and is nonrefundable. The service charge is prior to the start of the exhibition. Nonpayment or non-attendance does not constitute cancellation. By signing this contract, the client agrees that in case of dispute or cancellation of this contract that My Events will not be able to mitigate its loses for any less than 50% of the total contract value. If, for any reason, My Events decide to cancel or postpone this conference, My Events is not responsible for covering airfare, hotel, or other travel cost incurred by clients. This conference fee will not be refunded, but can be credited to a future exhibition. Event program content is subject to change without notice. 3. Copyright: All intellectual property rights in all material produced or distributed by My Events in connection with this event is expressly reserved and any unauthorized duplication, publication or distribution is prohibited. 4. Data protection: Client confirms that it has requested and consented to My Events retaining client information on My Events group companies database to be used by My Events group companies and passed to selected third parties, to assist in communicating products and services which maybe of interest to the client. If the client wishes to stop receiving such information please inform My Events via email to sabrina@myevents.com.my 5. Important note: While every reasonable effort will be made to adhere to the advertised package, My Events reserves the right to change event dates, sites or location or omit event features, or merge the event with another event as it deems necessary without penalty. In such situations no refunds, partfor any reason whatsoever, (including, but not limited to majuere occurance) and provided the event is not postponed to a later date nor is merged with another event, the client shall receive a credit note for the amount that the client has paid to such permanently cancelled event, valid up to six months to be used at another My Events event. No refunds, part refunds or alternative offers shall be made.
