I look forward receiving our permits soon.” At this time, the Chairman opened the floor for Kim Lynn, Event Planner, Dave Washburn, Vice-President of Operations of FLW, LLC and Kelly Wells, Director of Shreveport Sports Commission to address the Commission Members regarding the upcoming Forrest Wood Cup and Expo. Mr. Washburn stated that there will be three test drives: Ranger Boats, Cam Am ATV and Chevrolet. Mr. Washburn added that the Chevrolet test drive vehicles would be provided by General Motors through Jack Morton Worldwide. Ms. Lynn and Mr. Washburn responded to further questions posed by the Commission Members regarding the Expo. After a brief discussion, Commissioner Ryan made a motion to approve Ranger Boats, Cam Am ATV and Chevrolet’s test drive at the Forrest Wood Cup and Expo. Commissioner Bent seconded this motion and it was unanimously approved. ***************************************************** The Executive Director presented to the Commission Members an e-mail correspondence from Lindsey Clifford, Account Executive of Jack Morton Worldwide, dated June 28, 2013, requesting approval for new motor vehicle off-site display: “General Motors and Chevrolet request permission to display Chevrolet vehicles at the NCLR Annual Conference event in the Morial Convention Center in New Orleans, Louisiana from July 20th through the 22nd. Vehicle Display Details for Approval: Event: National Council of La Raza (NCLR) Annual Conference Event Dates: July 20-22, 2013 (Load in- July 19th) Event Hours (Vehicles on Display and Activated): 10:30 a.m. to 6 p.m. July 20th and July 21st 10:00 a.m. to 3 p.m. July 22nd Location: Morial Convention Center 900 Convention Center Blvd. New Orleans, LA 70130 Vehicles on Display: 2 Chevrolet models (2013 Malibu and 2013 Volt) Vehicle Display Activation Special Request: -Chevrolet requests the opportunity to staff the vehicle display with product specialists who can provide vehicle feature information to consumers. After a brief discussion, Commissioner Hocevar made a motion to approve Jack Morton Worldwide’s request to display two new Chevrolet vehicles and staff product specialists at the National Council of La Raza (MCLR) Annual Conference on July 19, 2013 to July 22, 2013. Commissioner Tarver seconded this motion and it was unanimously approved. ***************************************************** With regard to old business, the Executive Director reported to the Commission Members at the last meeting, the Commission instructed the staff to researched the rules of other states regarding the use of the word “invoice” on websites such as Edmunds, NADA, Kelly’s Blue Book, etc. The Executive Director advised the research revealed Texas and Mississippi’s rules suggested that the use of the term “invoice” or “invoice price” in advertising shall not be used, however, Texas law gives the violator the right to cure. In response to a question, the Executive Director explained the right to cure allows the violator to correct the ad without penalty. The Executive Director reminded the Commission Members that in LA.R.S.32:1251, the legislature declares as public policy that one of LMVC.07.15.13.#3 the functions of the Commission is “to prevent false and misleading advertising.” In LA.R.S.32:1261(A)(2)(c), the Louisiana legislature prohibits a dealer “To resort to or use any false or misleading advertisement in connection with his business as such vehicle dealer or motor vehicle salesman.” The Executive Director continued by adding the United States Fifth Circuit Court of Appeal, in the Joe Conte Toyota vs LMVC case, upheld the position of the Commission and stated in the ruling that the word “invoice” is inherently misleading and as such, unless and until the calculation of “invoice” is no longer inherently misleading, to allow the use of “invoice” in advertising is to allow misleading advertisement, and this cannot be so under the current LMVC regulations and Louisiana Law. At this time, Counselor LaPeyronnie reminded the Commission Members Costco Auto Program had recently been in for a pre-hearing regarding violation of advertising “invoice” on their website. The Executive Director added Costco agreed to comply with the LMVC’s rules and whatever the Commission may decide on this subject but they asked that other organizations, i.e., Edmunds, NADA, Kelly’s Blue Book, etc. be brought into compliance as well. After a brief discussion, Commissioner Bent made a motion that “invoice” advertisement is a violation of Louisiana laws and internet sites such as those discussed must comply with the Commission laws and rules. Commissioner Tarver seconded the motion and it was unanimously approved. ***************************************************** The Executive Director and Counselor McCranie addressed the Commission regarding Act 158; the increasing issues concerning the manufacturers’ Certificate of Origin and manufacturers’ off-site display. The Executive Director presented to the Commission Members for their consideration a proposal for an emergency rule that would address these issues in the interim until such time as the issues could be addressed with either a permanent rule or legislative changes to the statutes. After a discussion, Commissioner Guidry made a motion to adopted the following Emergency Rule and have the staff take the necessary steps in implement same as a permanent rule. Commissioner LeBlanc seconded this motion and it was unanimously approved. DECLARATION OF EMERGENCY Office of the Governor Louisiana Motor Vehicle Commission Definitions (LAC 46:V.101) New Motor Vehicle Auto Shows; Offsite Displays (LAC 46:V. Chapter 13) Recreational Product Static Offsite Displays; Offsite Expositions (LAC 46:V. Chapter17) Manufacturer, Distributor or Wholesaler License Application; Submission of MSO/MCO; Information Included (LAC 46:V Chapter 19) The Louisiana Motor Vehicle Commission (the “Commission”) is exercising the emergency provisions of the Administrative Procedures Act, R.S. 49:953(B), and pursuant to the authority granted under R.S. 32:1251 et. seq., adopts the following emergency rule effective July 15, 2013 and it shall remain in effect for 120 days or until this Rule takes effect through the normal promulgation process, whichever comes first. The Louisiana Motor Vehicle Commission finds it necessary to adopt this Rule to further implement the provisions of R.S. 32:1252(l) which amends the definition of an all-terrain vehicle and codifies the agency’s policy of requiring a manufacturer’s certificate of origin in the licensing process. In §1307 the following language is deleted “with a maximum of six vehicles per licensee, per display.” This deletion makes clear the authority of the executive director to approve off-site displays and is consistent with similar provisions in the rule. The requirements for a manufacturer’s motor vehicle display are set forth in §1309. This rule makes no change but codifies the agency’s policy in effect for many years. The same is true of §1707 with regard to recreational product static off-site displays. The licensing requirements set forth in §1901 codify the agency’s requirement that a manufacturer’s certificate of origin accompany a license application and makes clear the requirements for the certificate. TITLE 46 PROFESSIONAL AND OCCUPATIONAL STANDARDS PART V. Automotive Industry Subpart1. Motor Vehicle Commission Chapter 1. General Requirements §101 Definitions *** Manufacture’s certificate of origin (MCO), a manufacture’s statement of origin (MS) or a certificate of origin -- a transitional ownership document issued by a manufacturer to a specific vehicle, or if a multi-stage vehicle, to a specific component of the vehicle and includes “a manufacturer’s statement of origin” (MSO), a certificate of origin or similar term. A MCO is used to convey ownership from the manufacturer to a franchised dealer or distributor and from the franchised dealer to a purchaser. *** VIN -- a series of Arabic numbers and Roman letters that are assigned to a vehicle for identification. *** LMVC.07.15.13.#4 Chapter 13. A manufacturer’s motor vehicle display is a vehicle display arranged by a licensed manufacturer, distributor or wholesaler to demonstrate its motor vehicles to the general public. A licensee’s request to display motor vehicles must be received by the commission thirty days prior to the commencement of the display. B. Each manufacturer’s motor vehicle display will be limited to ten days. C. The number of motor vehicles at any manufacturer’s motor vehicle display will be left to the discretion of the executive director. D. The manufacturer vehicle display may be manned by product specialists, but no licensed motor vehicle dealer personnel will be allowed on the display site. A licensee’s request to display recreational products must be received by the commission thirty days prior to the commencement of the display. B. Each manufacturer’s recreational products display will be limited to ten days. C. The number of recreational products at any manufacturer’s display will be left to the discretion of the executive director. D. The manufacturer’s recreational products display may be manned by product specialists, but no licensed recreational products dealer personnel will be allowed on the display site. Manufacturer, Distributor or Wholesaler License Application; Submission of MSO/MCO; Information Included §1901. Manufacturer, Distributor or Wholesaler License Application; License Application A. An application for a license as a vehicle manufacturer, distributor or wholesaler required by R.S. 32:1254 must be accompanied by a manufacturer’s statement/certificate of origin (MSO/MCO). B. The MSO/MCO may be prepared at a factory, assembly plant, or business authorized by the manufacturer. Although variations exist, an MSO/MCO normally is: 7” x 11” in size, on paper stock sixty (60) pound offset or equivalent durability, and printed with security features that include: (i) sensitize security paper without added optical brighteners that will not fluoresce ultraviolet light; (ii) engraved border and prismatic-rainbow printing with Copy Void Pantograph (the word “void” appears when the document is copied); and (iii) two complex colors (colors developed by using a mixture of two or more primary colors and black) and two security threads, with or without watermark, and/or intaglio print, with or without latent image, and/or security laminate. C. The MSO/MCO must contain at least the following information: 1. First conveyance of the vehicle after its manufacture; 2. The model year; 3 .Make; 4. Model, body style; 5. Vehicle identification number or serial number if all terrain (ATV) or off-road (ORV) vehicle; 6. An indication that the vehicle was not manufactured for road use, if applicable; 7.
