The Enlistment of manufacturers/suppliers of polyhouses and net houses is compulsory for obtaining subsidy under this scheme. 3. The Enlistment is for the supply of complete polyhouse and net house to the cultivators and not for the supply of individual components/materials of the polyhouse and net house 4. The Enlistment shall be for the State of Maharashtra. 5. The design of polyhouses and net houses must confirm to the models approved by Department of Agriculture/ Maharashtra State Horticulture and Medicinal Plant Board (MSHMPB)/State NHM, Maharashtra State (Annex-1). 6. The poly house and net house manufacturers/suppliers must use all the components required for the installation of polyhouses and net houses confirming to the relevant BIS standards and/or as per specifications provided by the Department of Agriculture/ Maharashtra State Horticulture and Medicinal Plant Board (MSHMPB)/State NHM, Maharashtra State(Annex-2). 7. The manufacturers/suppliers must have at least one service center in Maharashtra. 8. The invoices in respect of supply of polyhouses and net houses shall be raised by the registered manufacturers/suppliers. However the local sub contractor/supplier if any for civil material,installation and transportation work for the polyhouses and net houses installation will be permitted provided that the manufacturers/suppliers undertake the responsibility/guarantee of these works. In such cases invoices/bills given by the subcontractor & authenticated by the manufacturers/suppliers are valid for civil material, installation and transport work only. 9. The manufacturers/suppliers shall under take the responsibility/guaranteeof different components of polyhouses and net houses supplied to the cultivators (Annex-2). 10. The manufacturer /supplier shall undertake to provide guaranty/ warranty as below. (a) Cladding material (polyfilm, all types of net and fabric): One year guarantee (i.e. replacement) against natural wear and tear (excluding the natural calamities, vandalism and any other forced action). Two years warranty (i.e. repairs) against natural wear and tear (excluding the natural calamities, vandalism and any other forced action). (b) Structure: Five years warranty (i.e. repairs) against natural wear and tear (excluding the natural calamities, vandalism and any other forced action)The decision of Managing Director, Maharashtra State Horticulture and Medicinal Plant Board, Pune shall be final in this regard. 11. The manufacturers/suppliers must undertake to supply the components at the rates equal to or less than the rates given as per the Annex-3 and/or the rates per unit area of polyhouse/net house in any case should not be higher than those prescribed in the Annex-4. 12. If Manufacturers/suppliers not follow the rules and regulations mentioned in the Para No. 9,10,11then above the entire Bank Guarantee amount will be deposited in government account and such manufacturers/supplierswill be black listed. Following documents are required for Enlistment of manufacturers/suppliers(a) Completely filled in application cum company profile in the prescribed Pro-forma (Annex-5). (b) Enlistment feeRs. 10,000.00 (Rupees Ten Thousand only). ThisEnlistment fee is nonrefundable. The Enlistment fee shall be paid in the form of demand draft only, issued in favour of “Managing Director, Maharashtra State Horticulture and Medicinal Plant Board, Pune” payable at Pune along with application for Enlistment. (c) Copy of VAT Enlistment certificate/s. (d) Copy of SSI Enlistment certificate/Enlistment issued by the Director of Industries. (e) Latest Sales Tax clearance certificate (Maharashtra State)/VAT return. (f) The make/brand name/s of different components as per the format given in Annex-6. (g) List of service centers in Maharashtra. Service centre must be as per description given in the item No. 15. (h) Price list of additional components (other than listed in Annex-2 if any) for poly house and net house system as per the format provided in Annex-7. (i) Latest “Certificate of Performance status from the concerned State authority” (Agriculture/Horticulture Department / State Horticulture and Medicinal Plant Board) for the manufacturers/suppliers from outside Maharashtra. They must have regional office in Maharashtra State for better co-ordination and efficient implementation of the scheme. (j) Copy of valid BIS certificates/undertaking by manufacturers/suppliers to supply the different components of polyhouses/net houses according to the specifications provided by the Department of Agriculture/ Maharashtra State Horticulture and Medicinal PlantBoard (MSHMPB)/State NHM, Maharashtra Statefor all components of poly house/shade net house system. (k) Turnover of minimum Rs. 50.00 lakh per year for previous two years which will be counted based on copies of balance sheet. (l) Experience of more than two years for installation and supply of polyhouse/nethousewhich will be counted based on the copies of firm orders/bills amounting to minimum Rs. 25.00 lakh per year. 14. The performance guarantee of Rs. One Lakh in the form of bankguarantee(only of Nationalized bank)in favor of“Managing Director, Maharashtra State Horticulture and Medicinal Plant Board, Pune”according to the format provided in Annex-8 will be required at the time of signing the agreement for Enlistment. The performance guarantee should be renewed after every year. However for the manufacturers/suppliers registered in Maharashtra State as small scale unit, the performance guarantee of Rs. 50,000/- (Rupees Fifty Thousand only) is required. 15. Service Centre: The service center must be of following description(a) The service center should be manned with at least two technical persons; one of them must be an Agricultural Engineer with minimum qualification of B. Tech (Agricultural Engineering). (b) The technical person other than Agricultural Engineer should have completed the training on Polyhouses/Nethouses from one of the State Agricultural Universities (SAUs) or Horticultural Training Center (HTC), TalegaonDabhade. In process of time and as per additional requirements, no. of trained technical persons (either agricultural engineer or trained from SAUs/HTC) should be increased. (c) At least one “service center” shall be located in the State of Maharashtra. (d) The service center must provide free after sales service to the farmers for at least five years. (e) The service center shall also provide the service as per clause (10) above of these terms and conditions. (f) Service center shall have the information board as per the format provided in Annex-9 or as prescribed by Department of Agriculture/ Maharashtra State Horticulture and Medicinal Plant Board (MSHMPB)/State NHM, Maharashtra State from time to time. (g) Service center shall maintain the list of farmers covered under the scheme. (h) Service center shall maintain the registers as per the format provided in Annex-10 or as prescribed by Department of Agriculture/ Maharashtra State Horticulture and Medicinal Plant Board (MSHMPB)/State NHM, Maharashtra State from time to time. (i) It will be the responsibility of the manufacturer/supplier to see that the service center is kept functional all the year and grievances/complaints of cultivators/farmers are attended to within a week after receiving written complaints. (j) The service center must be equipped with the communication facilities such as phone, internet/email etc. 16. The information furnished for Enlistment should be signed by the competent authority of the manufacturer/supplier. The true copies should be attested by a Gazzetted officer. The competent authority means. (a) For the private and public ltd company: Chairman/CEO/MD or the authorized Person/Director from the Board of Directors. (Copy of resolution passed by the board for this purpose shall be submitted) (b) For Partnership firm/company: One partner duly authorized.(Copy of Authorization signed by all the partners shall be submitted) The above mentioned authorities (as stated in (a) and (b)) will have to submit MOU/Partnership deed in prescribed form. (c) Proprietorship firm/company: Proprietor. 17. The manufacturer must submit the application in prescribed format with all details to the office of the “Managing Director, Maharashtra State Horticulture and Medicinal Plant Board, Pune”. 18. Maharashtra State Horticulture and Medicinal Plant Board (MSHMPB)/State NHM, Maharashtra State reserve the right to reject the Enlistment and the decision of Managing Director, Maharashtra State Horticulture and Medicinal Plant Board, M. S, Pune shall be final in this regard. 19. The Enlistment will be subjected to conditions of guidelines issued by Government of India/Government of Maharashtra/ State Horticulture Mission/ MSHMPB from time to time. 20. Annex-8 To, ________________________________ ________________________________ ________________________________ BANK GUARANTEE WHEREAS ______________________________________________,(hereinafter) called as CAO) have approved M/s ___________________________________________ (hereinafter called firm) for the supplies of Polyhouseand Nethouse (hereinafter called the said goods) under the Polyhouse and Nethouse Scheme(hereinafter called the said scheme) AND WHEREAS in pursuance and under the terms of the said approved of the firm, firm has agreed to furnish in favour of the CAO the Bank Guarantee for a sum of Rs.1,00,000.00 (Rupees one lakh only) for the due performance of his/her its obligation to the CAO under the terms and conditions of the G.R. of Govt. of Maharashtra performance as per the terms and conditions of G.R. and circular as when Govt. and Deptt. have issued. We, ________________________________________ (hereafter called the bank) hereby irrevocably and un-conditionally undertake and guarantee payment to CAO forthwith on demand being made by CAO in writing without dumur any and all monies anywise payable by firm, as may be specified in the notice of the demand made by the CAO to the bank upto an aggregate a sum of Rs. 1,00,000/- (Rupees one lakh only) and the bank hereby agree and undertake to the CAO that 1. The firm will have to give complete material to the farmers as mentioned in the bill invoice in quantity and quality as per specification. (with prescribed guarantee of materials), alongwith installation of Polyhouse and /or shadenet house work . 2. In consideration interalia of the firm paying to the guarantor the guarantee charges and executing requisites documents in favour of the bank and which have been done prior to the execution hereof and the request of the firm, the Bank hereby agree with CAO THAT in the event of any default and / or defaults being committed by the firm in payment to the firm of the said Rs. 1,00,000/- (Rupees one lakh only) and or any part thereof the Bank hereby irrevocably unconditionally and or without any demur and not withstanding any intimation and or direction by the firm to the contrary guarantee and convenients to pay to the CAO IN PUNE the said sum Rs. 1,00,000/- (Rupees one lakh only) and or any part thereof as the case may be. 3. The CAO shall be entitle to act under the terms hereof as if the Bank was the Principal Deptor to the CAO for payment of any amount upto the said sum of Rs. 1,00,000/- (Rupees one lakh only) guarantee by the Bank aforesaid to the CAO. 4. The guarantee is additional and without prejudice to any security of obligations which CAO may now of hereafter have from the firm and or any other person in respect of the said indebtness and or liabilities and or obligations hereby guaranteed and all rights and remedies in respect thereof are hereby reserved by the CAO in its favour. The guarantee contained herein is irrevocable and unconditional shall be continuing guarantee and shall remain in force for a period of 36 months with effect from the date of guarantee. On the CAO serving on the bank notice of claim under this guarantee before the expiry of the said period, the same shall be enforeceable against the bank not withstanding the fact that the same is payable after expiry of the said period. 6. The guarantee shall be continuing guarantee and shall not be considered as wholly or partially satisfies or exhaust by any payments from time to time made by the Bank or the distributor or any settlements of the accounts between the CAO and the firm. 7. The bank shall make the payment to the firm at the time or from time to time a sum not exceeding in aggregate the said sum of Rs. 1,00,000/- (Rupees one lakh only) unconditionally and without any demur and irrespective of any instructions or directions given by the firm to the bank to without payment thereof or any ground whatsoever. The bank obligations of the bank in terms hereof shall not be anywise affected or suspended by reason of dispute (if any) having been raised by the firm (whether of not pending before any Arbitrator Office, Tribunal or Court) or any denial of liability by the firm stopping or preventing or purporating to stop or prevent any payment by the Bank of CAO in terms thereof. 8. The bank hereby further agrees with declares and undertake to CAO that his guarantee is and shall always be unconditional irrevocable and absolute till guaranteed amount hereunder have been paid in full to the CAO irrespective of any dispute of difference as to any liability of the firm under the said G.R. or invalidity, enforceability, illegality or otherwise of any terms, conditions or provision for the said G.R. between the firm and the CAO or otherwise. 9. This guarantee shall be determined of affected by the liquidation or winding up, dissolution of change of constitution or insolvency of the firm or change in the constitution of either the firm or bank but shall in respect and for all purposes be binding and operative until satisfactory performance of all the obligations by the firm towards CAO. 10.
