ORDER nder the provisions of sub-section (3) of Section 7 of the Multi St Whereas the Chief Promoter of Hindustan Toursim Development Cooperati e So iet) Ltd., 29 onkucbi, Bye Lane No.3, Beharbari, Guwahati-781029, Assam had submitted a proposal for registration of the proposcd society under the Multi State Cooperative Societies Act, 2002 (MSCS Act, 2002). hereas the following deficiencies were found in the application submitted by the Society: 1. As per circular dated 26.3.2014, it has becn decided that henceforth, the primary multi state cooperative societies shall be registered initially with only two contiguous states/Uts as area of operation. Since Assam, Orissa and West Bengal are not contiguous states, this cannot be considered for registration. 2. The name of the society is misleading; it gives an impression as if it is an alJ India level society. 3. Soci ty has submitted photo copy of the Bank Certiflcate. 4. Scheme of viabil ity does not outline the fact that how the society will become a viable unit. 5. Provision of notice to defaulters has not been incorporated in bye-laws. 6. Bye-law no. 20(iii) relates to credit for which following documents have been mandatory for the proposed credit societies to submit along with their proposal of registration : A. No Objection Certificate from the Registrar of Cooperative Societies of the States/ .T. where the area of operation of the society extends. B. A certificate to the effect that the credentials of the Chief Promoter/Promoters members have been verified by the Registrar of Cooperative Societies of the concerned States. 7. Bye-law no. 23 is not consistent with Rule 13 of the MSCS Act, 2002. 8. Bye-law no. 26(d) is vague. 9. Composition of Board is not depicted in bye-law no. 28(a). ] O. Tour". 14. Bye-law no. 34(iii) is against the principles of democratic management of cooperatives. Whereas under the provisions of Section 7(3) of the MSCS Act, 2002 the Chief Promoter vide notice of even number dated the 24 1h April, 2015 was given an opportunity of personal th hearing on 30 April, 2015 to contest the deficiencies. Whereas none appeared for hearing.
