Winners will be announced at the Christmas Party on Saturday, December 6 at the McAllen Country Club. 2015 RGVBA/GreenBuilt RGV Parade of Homes April 18-19 & 25-26, 2015 A reminder to all builders, deadline for Early Entry ($2800) was Thursday, October 30; deadline for standard entry ($2900) is Monday, December 1 and deadline for late entry ($3000) is Monday, January 5, 2015. The longer you wait, the more you pay. If you have already decided where you will be building your entry, you may to to our website: rgvba.org and download the Entry Form, fill out and bring by the board office along with your check. Parade of Homes packages including Timelines, Builder Entry Form/Contracts are being prepared and will be send out to those builders entring the parade of homes or you can go to our website and download same. The parade of homes committee will hold a “Mandatory Meeting” of all builders in the parade to go over all the rules and guidelines and to get feedback from our builders on other issues of concern to them. We will keep you updated on this meeting. TAB 2013-2015 Texas Residential Construction Contracts Package — Order Online www.TexasBuilders.org “CAUTION” BUILDERS *********************** ATTN RGVBA BUILDERS Sunday, November 2 ***************************** I am in need of a person that is willing to chair this years annual Christmas Banquet and Party. The final event of the year is in a little over a month, Saturday, December 6 at the McAllen Country Club. and we need to get started. We need ideas on theme, band, etc. as well. REMINDER new format NAHB contracts that are now available on-line. There has been some consternation and attention to this by the TAB Contracts Committee and subsequently a resolution was passed by the TAB Board of Directors at the summer meeting directed to NAHB because of the implications to our members if they use the NAHB contracts. TAB staff and leadership have been working with NAHB to make sure that adequate disclaimers are included on the NAHB website to warn prospective purchasers of the implications that could result from using these forms in Texas. This is because they do not meet numerous Texas statutory and case law requirements. Texas law mandates in multiple instances that specific language be included in our residential contracts and the NAHB forms do not address these requirements. In other words, our members face serious liability and the risk of having voidable contracts if they utilize the NAHB forms. The following is a follow up to the above notice, from our TAB legal counsel, Ned Munoz, please read carefully: As a follow up to Scott’s email, please note that TAB has a standing Contracts Committee to ensure that its contracts are comprehensive, upto-date, and the best product available in Texas for its members. In addition to providing valuable revenue to local HBAs and TAB, the TAB contracts provide our members an invaluable benefit in the form of enhanced legal protections, reduced liability, and clear legal compliance with various Texas laws. Many other form contracts, including NAHB’s, fail to meet numerous statutory requirements in the Texas Property Code, as well as fail to properly waive all implied warranties as outlined by the Supreme Court of Texas, thereby exposing builders that may use the NAHB contracts in Texas to increased liability and the voiding of non-compliant contracts. “Again, the failure to use Texas specific contracts and comply with Texas statutory and common law exposes TAB builder members to serious legal liabilities and significant expenses, including the voiding of non-compliant contracts”.
