History of the Macomb County Building

Facilities and Operations
M
acomb County had outgrown its 3rd
Courthouse by the 1920s, and in
November of 1926, voters approved a 5 year
1 mill tax for a new building. The old Courthouse was torn down in 1930 and county
offices were temporarily housed throughout the
town.
St. Clair Shores architect George Haas and
general contractor Otto Misch were chosen to
build the new facility. The name was changed at that time from the Court
Building to the County Building to reflect the different departments the new
facility would house.
The cornerstone laying was in July of 1931, with the building scheduled to
open on January 1, 1932. Lacking funds to continue working during the
height of the depression, work ceased on the building with no roof and no
funds to weatherproof what had been completed, and it stood unfinished for
18 months.
Construction was renewed in 1933, and the building in all its glory began
to emerge as the exterior was completed. The Art Deco structure was given
a military motif, and the 13 floor building was topped with eight granite

Jury Room: Shortened jury service for most with the One-Day One-Trial system,
free library books waiting on the day of service, free wireless Internet service,
free bus tickets for rides to and from the Courthouse via partnership with
SMART, pagers that allow jurors to roam the downtown area while waiting to be
called to a courtroom and self-serve kiosks for improved service.
Register of Deeds: Combats real estate fraud with the state’s first electronic
entry book and improves the process of recording real estate records with electronic filing and computerized scanning and indexing and the new Super Index,
which may be the nation’s best public real estate search system.
Vital Records: Prevents fraud with a birth record verification system developed
for use with the Social Security Administration, allows 24/7 access online to: CPL
status tracking, the business registration index and the death record index, more
efficient customer service due to digital records and extended office hours on
Wednesday nights.
Other services offered are a fast-pass system eliminating a wait in line, 24/7 faxon-demand system, next-day delivery option, online videos with more thorough
information, live Internet chat, a mobile office that travels to different communities throughout the year and acceptance of credit cards for easier payment
options.

BRIEF HISTORY OF MACOMB COUNTY
Named in honor of General Alexander Macomb, a highly decorated veteran of
the War of 1812, Macomb County was formally organized on January 15, 1818
as the third county in the Michigan territory. At that time, it covered a much
larger area than it does today. In 1819 and 1820, large portions of the county
were removed to form the counties of Oakland, Lapeer, Genesee and St. Clair.
The first Europeans arrived in the area during the 17th century. They included
French fur trappers who recognized the richness of the marshes and sought new
opportunities for trade. Moravian missionaries established the first organized,
non-native settlement in the county in 1782 as a refuge for Christianized Indians
driven out of Ohio. They built along the banks of the Clinton River, then known
as the Huron River, but were forced to leave four years later by the Chippewa
Indians. In the late 1790s, Christian Clemens visited the area, and in March
1800, purchased a distillery considered the first building on the site of the future
Mount Clemens. The next year he purchased 500 acres for development. This
site, known as High Banks, was platted as the Village of Mount Clemens in 1818,
when it was proclaimed the Macomb County Seat.
In the early 1800s, and at least by 1840, settlers moved into the interior of the
county, carving out farms from the hardwood forests. The roots of the county
villages and townships were established by this time. In addition to the original
French and English, later settlers included Germans, Belgians and others who
came directly from Europe.
In the 1870s, mineral baths brought international fame to Mount Clemens.
Many believed the waters had healing powers. Although the stream still runs
beneath the city, interest in the spas died out in the early 20th century. Recently,
there has been a reemergence of interest in the mineral baths now being
offered at Henry Ford Macomb-East Campus in Mount Clemens.
Between 1920 and 1930, Macomb County doubled in population, rising
from 38,103 to 77,146 persons. Two significant developments spurred this
growth – the establishment of Selfridge Field in 1917, and the beginning of the
urbanization movement northward from the City of Detroit. During the 1940s
and the 1950s the movement from the central city to the suburbs increased. The
largest growth occurred between 1950 and 1970, when over 440,000 people
were added to Macomb County’s population.
Today, Macomb County encompasses 482 square miles, and ranks third in
population in the state, with a 2010 census total of 840,978 persons. The
county is recognized as a leader in business and industry, and designated as a
“Community of Economic Excellence” by the State of Michigan
History prepared in consultation with the Macomb County Historical Society
and Crocker House Museum.

The County Executive, Mark A. Hackel, serves as head of the executive branch
of government. He directs, coordinates and supervises all county departments,
except for those headed by countywide elected officials. The mission of the
County Executive’s Office is to ensure that all county services provided to the
residents, communities and businesses are efficient, economical, and ethical.
As such, he sets and implements policies and provides analytical support,
strategic planning, policy analysis, and budgetary oversight for the county
organization. Executive Hackel aggressively focuses on both economic and
community developments by promoting and marketing the county as a great
place to live, work, play, raise a family and grow a business.

The Macomb County Commission is the legislative and policy-making
body of Macomb County government. The board is composed of 13
members, elected for two-year terms from 13 districts of nearly equal
population, with all terms expiring on December 31, 2014. The Macomb
County Board of Commissioners functions on a committee basis. An
indication of the scope and subject matter dealt with by the Board is
revealed in the titles of the various committees. Ad Hoc committees are
appointed as needed for specific purposes.
COMMISSION MEETINGS
The public is invited to attend all Board and committee meetings and
there is an opportunity for public comment at each meeting. Full Board
meetings are held at 7 p.m. in the Board Room on the 9th Floor of the

The Animal Shelter provides shelter for stray animals in Macomb County.
Animal Control laws are enforced through this agency for cities and townships
that have no provisions for this service in their charters. Macomb County
residents may turn over their animals if they are no longer wanted or need to
be euthanized due to failing health or an aggressive disposition. Animals are
available for adoption during our regular business hours and end 30 minutes
before the close of business. This facility is also a source of information for
Macomb County residents regarding animal related issues.

The Area Agency on Aging for Region 1-B is a nonprofit agency, serving the
counties of Livingston, Macomb, Monroe, Oakland, St. Clair and Washtenaw
Counties. The Agency is governed by a Board of Directors composed of
members representing the six county geographic area served including a County
Commissioner and older adult representative appointed by the local County
Board of Commissioners. The agency helps older adults, adults with a disability,
and their family caregivers to maintain their health and independence through
trusted information and access to home and community based services.

The Macomb County Art Institute Authority was established by the Board of
Commissioners pursuant to Act 296 of 2010. By law, the Authority is responsible
for levying the millage approved by the electors to provide revenue to an art
institute services provider such as the Detroit Institute of Arts (DIA).
The purposes for which the Authority is organized are to: support the operation
of an encyclopedic art museum, and the facilities where the DIA operates;
enhance the world-class art collection of the DIA; and contract for art institute
services with a world-class art institute services provider that will provide
meaningful and educational experiences involving the appreciation of an
encyclopedic art museum.

The Brownfield Redevelopment Authority promotes the revitalization of environmentally distressed areas, either by providing incentives for developers to
clean up contaminated or functionally obsolete property, or by receiving grants
to perform the clean up before a development is involved, or a combination of
the two. A Brownfield Redevelopment Authority may use Tax Increment Financing (TIF) as a tool for property redevelopment. An authority may: (1) capture
increases in property tax revenues generated by the redevelopment of eligible
properties to reimburse parties for costs of eligible development activities and
(2) use captured revenues to finance a local remediation revolving fund to address other eligible sites. Brownfield authorities can qualify for Brownfield site
assessment grants, redevelopment grants and the state revitalization loan fund.
Brownfield Redevelopment Authorities are authorized under Michigan Public
Act 381 of 1996.

Each county has a board to canvass all state, county, school, village, and some
city and township elections. After the primary and general elections, the board
reviews and analyzes the results to determine who has been nominated in
primary elections and which candidates are elected in general elections. After
general elections, the board delivers certificates of election to the County Clerk.
The board is also empowered to conduct recounts of certain offices.

The Civil Service Commission was established by the electorate of Macomb
County on November 8, 1966. This Commission oversees the Civil Service
System for the Macomb County Sheriff’s Office that employs, promotes and
disciplines employees pursuant to Act Number 298 of the Public Acts of 1966.
It is based on the examination and investigation of all Civil Service officers
and personnel in regards to merit, efficiency and fitness for appointment,
employment and promotion. In addition, the Commission regulates the
transfer, reinstatement, suspension and discharge of officers and provides for
referendums.

Boards and Commissions: The County Clerk is the official clerk for the 16th Ju-
dicial Circuit Court, Board of Commissioners, Apportionment Commission, Board
of Canvassers, Plat Board, Macomb County Sheriff’s Office Civil Service Commission, Jury Commission and the Concealed Weapon Licensing Board. The Clerk is
also the Secretary to the Election Commission.
Circuit Court Section (586) 469-5351 & File Room (586) 469-5199: This
section processes court filings and personal protection orders. Court case information, court record request forms and instructions to use e-filing or fax filing
for pleadings are available on the Clerk’s Web site.
Elections (586) 469-5209: This section is responsible for overseeing the print-
ing and distribution of election ballots, conducting national, state, county and
some school elections, and complying with the Michigan Campaign Finance Act.
It also assists in the canvass of votes in state, county, school, village and some
city and township elections. Election results and campaign finance records are
available on the Clerk’s Web site.
Jury Room (586) 469-5158: This section oversees the operation of the Jury
Room for the Circuit and Probate Courts. A computer randomly selects jurors
from a list of resident drivers license and persons with a Michigan identification
card. The term of jury service is either one day or one trial. Jurors are provided
with bus transportation, if needed. Jurors may also have library books delivered
to the Jury Room, have wireless internet available and are able to roam town
while waiting to be called with the new pager system.

death certificates and military discharges and veteran photo ID cards. It also
issues marriage licenses, business registrations, and concealed pistol licenses.

Corrections Advisory Board (CCAB) is responsible for planning and policy-making
with regards to the community corrections funding received from the Michigan
Office of Community Alternatives/Community Corrections. The Macomb County
CCAB has thirteen members representing stakeholders from within the county’s
criminal justice system. Meeting through the year, CCAB members review and
discuss issues pertinent to the criminal justice system in the county and how
community corrections programming can effectively address these issues.

Under the direction of the Mental Health Board, MCCMH, as a Managed
Healthcare Network, manages and supports a full continuum of support and
specialty services for persons with mental illness, developmental disabilities,
and substance use disorder, based on eligibility and defined benefit plans.
Services may include assessment, emergency services, outpatient or homebased services, residential, respite or support services, as well as other
treatment options. Outpatient services are available in American Sign Language
and in other languages through interpreters. Initial access to the MCCMH system
via TTD is available through the Crisis Center. MCCMH programs and services
are accredited by the Commission on Accreditation of Rehabilitation Facilities.

Macomb County Community Services Agency is a Community Action Agency
that works to diminish the causes and effects of poverty. The agency provides
a network of comprehensive educational, economic and social services
to Macomb County residents in need. Human service programs include:
three Community Action Centers assisting with emergency needs, home
weatherization, child development services and preschool programs for
children ages 0-5 and pregnant women through Head Start, supplemental and
emergency food programs through the Macomb Food Program, the Individual
Development Account (IDA) Program for first time home buyers, transportation
services, Senior Citizen Chore Service and Home Injury Control, and Senior

The three member Chapter 20 drain boards oversee the operation of some 150
Chapter 20 drains in Macomb County. The drains are located primarily south
of M-59 in communities such as Warren, Sterling Heights, Eastpointe, Clinton
Township, St. Clair Shores, Roseville, Center Line, Fraser and Utica. Chapter 20
drains are established pursuant to the State Drain Code, Act 40 of Public Acts of
1956, as amended. Each drainage district is considered a special purpose public
corporation with the power to enter into contracts, acquire property, sue, be
sued and conduct other necessary business.The drain boards approve agreements, pay invoices, sell bonds, authorize new projects and make assessments
against municipalities in the districts, among other duties.

systems, cooling towers and steam-line infrastructures; repairs and upgrades

The Finance Director is appointed by the County Executive and has certain
statutory duties prescribed by law, including the maintenance of the necessary
books and ledgers to control the expenditures of all county departments.
The Finance Director supervises the county budget and the expenditures of
all county departments and agencies for the County Executive to assure that
a balanced budget is maintained. The Finance Director serves as secretary
of the Employees Retirement System and is the administrator of the Retiree
Health Care Fund. The Finance Director also is responsible for maintaining the
necessary insurance coverage for loss prevention and monitoring the county’s
self-insurance and claims administration budget. The Finance Director also has
administrative responsibility for the Equalization, Accounting and Purchasing
Departments.

The Health Department’s mission is to improve, promote, and protect the
personal and environmental health of Macomb County’s residents and
communities. It accomplishes this mission by providing a wide range of
programs and services through three major divisions: Environmental Health
Services Division: restaurant inspection, onsite water supply (well) and sewage
disposal (septic) system permit and inspection, household hazardous waste
disposal, bathing beach and surface water quality monitoring, lead investigation,
etc.; Family Health Services Division: immunization, Women, Infants & Children
(WIC) Program, family planning, and other family and maternal/child health
programs, etc.; and the Health Promotion/Disease Control Division: health

The Macomb Orchard Trail Commission, formed in July 2002, is charged with
acquiring and converting the abandoned railroad into a 24 mile equestrian, bicycling and walking trail. The Commission is composed of Macomb County, HuronClinton Metroparks and the communities along the trail. Each organization has a
representative on the Commission who is actively involved in the development
and maintenance of the trail. The Commission, along with the support of the
Friends of the Macomb Orchard Trail and Michigan Rails-to-Trails Conservancy,
research, plan and direct further development of the trail.

The Prosecuting Attorney is the chief law enforcement officer in the county. He
is a sworn, impartial arbiter responsible for conducting criminal prosecution

Juvenile Court, Supreme Court, and Court of Appeals. The office also represents
parties in mental health proceedings in the Probate Court, and pursues civil

Public Works Commissioner Anthony V. Marrocco wears many hats.
He is responsible for the design, financing and construction of new county
drains and maintenance of 950 existing drains. He manages the Macomb County
Wastewater Disposal District, which provides sewer service through the Oakland
Macomb Interceptor and Detroit for eleven Macomb County communities with
a combined service population of 492,000 residents.
Other duties include administration of the Soil Erosion Control statute, review of
drainage plans for subdivision plats, management of 13 pump stations including
the Chapaton and Martin in St. Clair Shores and Clintondale in Clinton Township.
He operates the Phase 2 Storm Water Management Program for Macomb
County mandated by the U.S. Clean Water Act, which includes an illicit discharge
elimination program. He manages an extensive environmental education
program promoting the preservation and protection of our natural resources.
Commissioner Marrocco is a statutory member of the Inter-County Drainage
Board for the Oakland Macomb Interceptor Drain Drainage District and chairman
of the Drainage Board for the Macomb Interceptor Drain Drainage District.
These two districts have purchased from Detroit a 40 mile long sanitary sewer
interceptor system that transports sewage from 833,000 residents of Oakland
and Macomb counties for treatment at the Detroit Wastewater Treatment Plant
downriver. The two counties are currently engaged in a four year, $164 million
sewer rehabilitation project to extend the design life of the system and prevent
disruptions in service.
Commissioner Marrocco represents Macomb County on the Huron Clinton
Metropolitan Parks Authority and is a statutory member of the Macomb County
Parks and Recreation Commission.

A Regional Transit Authority (RTA) was recently established for Southeast
Michigan. The RTA is composed of the counties of Wayne, Oakland, Macomb
and Washtenaw. It will be governed by a 10-member board with two

Sheriff Wickersham’s jurisdiction encompasses the entire County. As a law
enforcement agency, it is the Sheriff’s Office duty to enforce all laws and to
protect the lives, property and welfare of the citizens who work, live and travel
through Macomb County. It is also his responsibility to secure all prisoners in
the County Jail, as well as provide security and transportation of those prisoners
to court proceedings. The Sheriff’s Office includes the road and marine patrols,
investigative bureaus, jail operations and is enhanced by a large group of
reserve officers who greatly assist our officers, as well as the citizens of Macomb
County with different events. The Sheriff also is part of multi-jurisdictional
units including COMET (drugs), MATS (auto theft), MACE (computer crimes),
and SWAT (tactical unit). The Townships of Harrison, Macomb, Lenox and
Washington, the Village of New Haven and the City of Mount Clemens contract
police services with the Macomb County Sheriff’s Office.

The Macomb Circuit Court is a trial court of “general jurisdiction” because it
handles all actions except those given by State law to another court. The Civil
Division has jurisdiction over civil cases involving more than $25,000 and cases
in which parties seek equitable relief. The Criminal Division handles all Macomb
County felony criminal actions and some serious misdemeanor cases. The
County Clerk serves as Clerk of the Court. Circuit Court judges are elected to
six-year terms on non-partisan ballots. The Family Division handles all domestic
relations matters. The Juvenile Division is part of the Family Division and handles
delinquency, abuse and neglect and adoption cases.

Deputy Court Administrator/ Probate Registrar............. John Brennan
The Court Administrator supervises the general operation of Probate Court
including personnel, budgets, and implementation of statutory changes and
applicable court rules. This office maintains statutory records and indexes
as well as archival records. The scheduling of cases for hearings and trials as
well as alternative dispute resolution (ADR) are handled by this office. The
Administrator will accept comments, suggestions and reviews complaints that
may arise.

This division processes petitions on the hospitalization of those individuals who
are in need of mental health services and appoints guardians for those adults
who are found to be developmentally disabled.
WILLS AND ESTATES DIVISION

This division administrates testate and intestate decedent’s estates and
has exclusive jurisdiction over testamentary and intervivos trusts. Where
appropriate the Court appoints guardians and/or conservators for minors
and legally incapacitated adults. As a public service, the Court accepts for
safekeeping the Last Will and Testaments of county residents. There is a nominal
fee of $25 for this service.

MACOMB COUNTY DISTRICT COURTS
District Courts have exclusive jurisdiction of all civil litigation up to $25,000
and also handle garnishments, eviction proceedings, land contract forfeitures,
civil infractions, and other proceedings. For criminal cases, the district
court conducts preliminary examinations in felony cases and handles all
misdemeanors where punishment does not exceed one year in jail including
arraignment, sentence, and setting and acceptance of bail. District judges may
appoint magistrates. The magistrates may set bail and accept bonds in criminal
matters, accept guilty pleas, sentence for traffic, motor carrier, dog, game,
snowmobile and boat law violations, and issue arrest and search warrants.
Attorney magistrates may hear small claims cases. Magistrates may, at the
direction of the Chief Judge, perform other duties allowed by statute.
Municipal Court civil jurisdiction is limited to $1,500. Its criminal jurisdiction
is similar to district court. Municipal judges must be lawyers, residents, and
electors of their cities. They are paid by the municipality and are elected for
four-year terms as provided by city charter. They are part-time judges and may
practice law outside of the courtroom.

MAJOR MACOMB COUNTY PARKS
Macomb County is often noted for its recreational opportunities,
particularly its access to inland lakes and Lake St. Clair. There are
three major public parks in the County and our new linear park, the
Macomb Orchard Trail, where people can enjoy a vast array of yearround recreational activities. County residents are never far from leisure
facilities.

This up and coming hike and bike path is a 24-mile linear park that starts at 24
Mile Road and Dequindre in Shelby Township and travels northeast to the City
of Richmond. Phase I is now open consisting of 7.5 miles through Shelby and
Washington Townships. Once completed the trail will link to 180 miles of trails in
southeast Michigan.
Scenic Lake St. Clair Metropark offers a mile-long shoreline on Lake St. Clair. This
770-acre park features a 1,000-foot sandy beach, an Olympic-size swimming
pool with two waterslides, the “Squirt Zone” sprayground, children’s play areas,
picnic areas and shelters, three marinas, day sail area, nature center, nature
trails, paved hike/bike trail, boat launches, an 18-hole par 3 golf course and an
18-hole adventure golf course. Winter activities include ice fishing, ice skating
and cross-country skiing.
Built around the 500-acre Stony Creek Lake in gently rolling terrain, this 4,461acre metropark offers many recreational activities, including nine large picnic
areas, an 18-hole regulation golf course, nature center, a nature interpretive
area, 24-hole disc golf course, two swimming beaches, play areas, boat launch,
and boat rentals. An 8 mile paved hike/bike trail circles Stony Creek Lake.
Mountain bikers can ride on 14 miles of hilly, heavily wooded dirt trails that
traverse the southwest side of the park. Hiking trails are located near the
Nature Center and north of Inwood Road (separate entrance). Winter visitors
can enjoy cross-country skiing, sledding, and ice-skating.
Located along the banks of the North Branch of the Clinton River in Ray
Township, this 2,625-acre park features a Farm Center, historic grist mill and an
18-hole regulation golf course. Ten miles of equestrian trails and a rental facility
for parties available at Camp Rotary. Visit the Farm Center to see a modern
working farm, complete with horsees, goats, sheeps and ducks. The dairy
herd is milked daily at 10 a.m., April 1 through October 31; and at 4:30 p.m.,
November 1 through March 31. The grist mill offers a rare glimpse of Macomb
County’s historic past and is listed on the National Register of Historic Places.
Mill quilting bee and car club meet monthly. Interpretive programs are offered at
the mill and the farm. The Historic Center (grist mill and surrounding buildings)
is open Friday - Sunday and other times by appointment.

County Clerk Carmella Sabaugh and Turning Point, Inc., applied for a state
VOCA grant to help fund and establish the PPO Assistance Center. The VOCA
grant funds come from fines and penalties levied against criminals convicted of
federal crimes. The PPO advocate helps citizens complete the PPO forms which
assists the circuit court staff in filing the forms quickly and helps the judge in
determining whether to grant the request. In addition the advocate assists with
safety planning and screens for lethality.

SMART operates Fixed Route Linehaul bus service and curb-to-curb Connector
Service in the tri-county area. Connector Service meets the special needs of
people who can’t access SMART’s Fixed Route Linehaul service. All SMART buses
are wheelchair lift equipped. SMART is funded by federal and state grants. The
Board of Directors establishes board policies covering all major operations and
financial oversight of the transit authority.

History of the Macomb County Building

a marine were erected on the Cass side, and an Indian and Revolutionary
soldier are on the front and back of the building. Original plans called for
a likeness of Christian Clemens and Alexander Macomb, but they were not
able to find a likeness of either of them.
The second building dedication was held June 5, 1933 with the exterior
and the 1st 5 floors finished. The rest of the floors were completed primarily with funds from the Civil Works Administration, Public Works Administration, and the Works Progress Administration.
The building was completed, not floor by floor, but room by room, at a cost
of $619,204. The Veteran’s Administration donated money from the balance of the war fund to complete their offices. Judge Reid’s court fines and
state refunded jury funds finished the 3rd, 5th, and 7th floor courtrooms
which used the staggered floor concept that mixed high ceiling courtrooms
with support offices with standard height ceilings.
The City of Mount Clemens paid for the 6th floor and the Road Commission’s 11th floor was finished with Democratic offices on one end of the
hall, and the lone Republican on the other. The building was paid off in
1944, and in 1947 half of the 12th floor was completed and a room on the
13th floor was made over as a library.
Several renovations were completed over the years including the construction of the intermediate courtroom floors in 1973, replacement of the
manually operated elevators in 1974, and the addition of air conditioning
in 1975.
