Company Owners – We all hear these terms but few
of us really understand them. It’s really not that hard States, the Federal government and local ordinances are
all your partners in the workplace. To many people who
are new to supervision and management this seems
wrong. We like to think that as a society we are unique
individuals who are very independent and many of us
have an adverse impression of unrequested government regulation.
Actually, government and established custom in employment goes back for a long ways and the
employment relationship is highly regulated. In general, anything you do or say can reflect back upon
your employer as long as it was even remotely in the course of your employment. So if you ask a job
candidate why he is bothering to look for a job at age 60, or if you tell the cute secretary upstairs that
you wish she would give you a kiss, you are doing this in the name of your employer, regardless of your

2015 Calendars are in! You are probably asking yourself, “What’s the big deal about these
calendars?” Well, besides being free, the calendars are also good! Greg McCartney, who is the VP of
McGovern Insurance in Belmont, gave us a couple of cases of these for our members. Why are they
good? Because they are 13 month (start with December 2014) and they have lots of good space for each
day to write things in. They also show all the holidays so you don’t have to look them up on Google.
There is something to be said for low-tech after all! Stop by the Exchange and pick a bunch up. Home,
office, trailer, garage. Here I am holding one up.

Litigation Search. One of the best ways for contractors to assess your owner client, or
for subs to assess general contractors is to look at their past. Have they been involved in a
lot of litigation? People tend to continue the same pattern in life and those who have had a
great many disputes in the past will probably also have them in the future. Your exchange will provide
member companies with a San Mateo County, and adjacent counties, court history of prospective
customers. Look for the form in this issue.

Membership – It pays to be a member of the Exchange both financially and
socially.
In addition to plans on line, safety assistance and insurance discounts we also have
fun. Members take a variety of trips each year, go to sporting events, spend an
evening at the theatre and do other fun things.
Builders exchanges are a network of people with common interests so if you
belong to our exchange you get all the local things like plans to bid, insurance
discounts and you are also part of a larger social network of people in the industry.
A lot of what builders exchanges are about is just plain friendship and doing things
together.
Beyond the local aspect we work with most of the other exchanges in the State to
represent our industry on the California level so you can be informed of issues
which are important to us and our lobbyist can present the views of our industry on
important issues.

Construction Notary – Notary service is free for members on construction related
items. Call first, 650-591-4486 to make sure Leslie, our notary, is available and then

Conference Room Use – Members are welcome to use the conference room at
735 Industrial free of charge during business hours. Sign up is on a first come,
first served basis and you can reserve the room by calling us at 650-591-4486. It
holds about 20.
Construction Forms – Stuff like lien forms, pre-liens, contracts, notices of
completion, etc. We have them at the exchange for a nominal fee. Stop by and get
the ones you need!

Mediation – The Exchange will informally mediate construction related disputes. This
is true “no fault” mediation where parties are assisted in reaching a settlement. There
is no “verdict” or “judgment” and attorneys are not allowed. If you need help in
resolving a problem please give Tom a call at 650-591-4486. There is no charge for mediation.
Workers Comp Discount – Many Exchange members who have workers comp
insurance through State Fund get a 6% discount (in addition to other discounts)
because they can join our State Fund group 826. You need to know that when you
renew you need to ask to be put in 826 otherwise they will not put you in a group and
you will have to pay more. If you discover it later on, they will not “reverse it”. Be sure you ask
for group 826 at the time of renewal!
New Construction Financing Program for
Exchange Members – Need a construction
loan? Colorado Federal is actively soliciting PBX members and will give you a ¼% discount if
we verify your membership. With building going great guns this is a good opportunity to get
financing for your next
project.

Discrimination and Harassment for Supervisors and Company Owners
States, the Federal government and local ordinances are all your partners in the workplace. To
many people new to supervision and management this seems wrong. We like to think that as a
society we are unique individuals who are very independent and many of us have an adverse
impression of unrequested government regulation. Actually, government and established custom
in employment goes back for a long ways and the employment relationship is highly regulated.
In general, anything you do or say can reflect back upon your employer as long as it was even
remotely in the course of your employment. So if you ask a job candidate why he is bothering to
look for a job at age 60, or if you tell the cute secretary upstairs that you wish she would give
you a kiss, you are doing this in the name of your employer, regardless of your intention.
There are basically three classifications of laws that govern your actions in the workplace. These
are Federal law, State law and finally common law, which are those laws which exist by custom
(most of common law is actually codified into state laws by definition) It could take a lifetime to
review this confusing roster of laws and court decisions so we won’t attempt to do it here.
Federal law applies everywhere and state laws are a checkerboard of different things applying in
different locations. All you need to succeed in the workplace is enough knowledge to have an
awareness of when you could be approaching an area that is highly regulated so you know to
seek more knowledge, or personnel department assistance, before proceeding. Let’s look at the
two areas, discrimination and harassment that a supervisor has to be most aware of.
Discrimination
To be discriminated against under law a person must be part of what is called a “protected class”
which means there is a law passed specifically to protect a person falling into that category. The
common protected classes are:
Sex
Race
Pregnancy
Disability (including HIV)
Age
Military Service
Bankruptcy
Genetics
Citizenship
Discrimination is the one you hear about most and it seems to always be in the news. The basis
for discrimination rules is the concept that all people have a right to be treated equally in the
workplace and other economic pursuits. After all, each of us has the obligation to pay taxes, obey
the laws, and many of us to get drafted into the military, so it follows that if we suffer the
detriments of being part of a society we ought to have the right to participate on equal footing for
the benefits of that society. To discriminate you basically treat one class of people (see above
list) differently than the others in the workplace. If you never hire old people because their
company paid health insurance costs more, you are discriminating. If you never promote
Christians because you don’t like their God, then you are discriminating. If you always
recommend women for a smaller raise than men because their husbands work and they don’t
really need the money anyhow, you are discriminating. If you don’t hire or promote females to
certain jobs because they get pregnant and quit or take lots of time off, then you are
discriminating. It’s important to remember that how you feel or what you think has nothing to do
with discrimination. It’s what you do, or don’t do, that counts and it counts against your
employer.
Harassment.
This one is best thought of as, “Creating a Hostile Environment” which is designed to make a
person quit or just make them miserable. Think of the words “oppressive and intimidating
atmosphere” when trying to understand harassment. People who are harassed can (and often do)
fit under one of the protected classes, but they do not have to. Harassment can be overt, such as
belittling an employee in front of peers or it can be more subtle such as the continual telling of
off color jokes and hanging “girlie” calendars on the walls. Often harassment comes about when
an inexperienced supervisor tries to make a bad employee quit. Here is a typical harassment
example:
Mark hated Jim because Jim did not finish his assignments, did sloppy work and spent a
good portion of each day complaining to his co-workers about the company. Mark
wanted to get rid of Jim by making him quit. Mark gave Jim the worst assignments. Mark
also scheduled him for all of the weekend work, sometimes made fun of him in front of
others and generally made his life miserable. Instead of quitting Jim kept a journal of his
interactions with Mark and then after a period of time sued the company for
harassment since he was intentionally singled out for bad treatment.
Note that Jim did not have to be a member of a protected class to be harassed. Mark was correct
in assessing Jim as a bad employee but instead of using progressive discipline focused on
quantifiable and qualitative work standards, he chose to make work conditions bad so Jim would
quit. This was harassment and it did not matter that Jim was a bad employee. Here are some of
the repetitive actions that can constitute harassment.
Criticizing, insulting, blaming, reprimanding or condemning an employee in public.
Exclusion from group activities or assignments without valid reason.
Statements damaging to a person's reputation.
Making sexually suggestive remarks.
Physical contact such as touching or pinching.
Inappropriately giving too little or too much work.
Constantly overruling authority without just cause.
Unjustifiably monitoring everything that is done
Harassment generally requires a repetitive pattern over a period of time. One argument, one bad
joke or one inappropriate remark or one bad assignment is not harassment.
You should be careful to make sure that your work environment does not allow some workers to
be singled out for bad treatment. Employees who do not perform should be handled by
addressing the issues of work standards. This brings us to the area of employee discipline. It
must be fair and it must be controlled so that a “rogue manager”, cannot damage the company
through their actions. You will also find that employees who are not performing well at their jobs
rarely blame themselves and often try to claim harassment or discrimination rather than face up
to the fact that they are not doing well. Virtually every large company uses a variation of what is
called “progressive discipline” to make sure that correcting an employee’s behavior is done
fairly, consistently and in the interests of productivity and harmony.
