We do not find the meaning of life by ourselves alone - we find it with another. - Thomas Merton I know of only one duty, and that is to love. - Albert Camus BE PREPARED FOR WINTER WEATHER AND STORMS The winter season is upon us, and Legislator Tom Muratore (R-Ronkonkoma) would like to offer residents helpful tips in preparation of extreme cold weather and winter storms. “We have already been hit with one freezing cold spell, and winter is long from over,” stated Legislator Muratore. “It is important to take some simple precautionary measures to keep your family safe and protect your home and personal property.” The following information is provided courtesy of http://www.ready.gov/ BEFORE WINTER STORMS AND EXTREME COLD To prepare for a winter storm you should do the following: • Consider adding the following supplies to your emergency kit: • Rock salt or more environmentally safe products to melt ice on walkways. Visit the Environmental Protection Agency for a complete list of recommended products. • Sand to improve traction. • Snow shovels and other snow removal equipment. • Sufficient heating fuel. You may become isolated in your home and regular fuel sources may be cut off. Store a good supply of dry, seasoned wood for your fireplace or wood-burning stove. • Adequate clothing and blankets to keep you warm. • Make a Family Communications Plan. Your family may not be together when disaster strikes, so it is important to know how you will contact one another, how you will get back together and what you will do in case of an emergency. • A NOAA Weather Radio broadcasts alerts and warnings directly from the NWS for all hazards. You may also sign up in advance to receive notifications from your local emergency services. Download FEMA’s Be Smart. Know Your Alerts and Warnings for a summary of notifications at:www.ready.gov/prepare. Free smart phone apps, such as those available from FEMA and the American Red Cross, provide information about finding shelters, providing first aid, and seeking assistance for recovery. • Minimize travel. If travel is necessary, keep a disaster supplies kit in your vehicle. • Bring pets/companion animals inside during winter weather. Move other animals or livestock to sheltered areas with non-frozen drinking water. SENIOR JOKES Three old ladies were discussing the trials and tribulations of getting older. One said, "Sometimes I catch myself with a jar of mayonnaise in my hand while standing in front of the refrigerator, and I can't remember whether I need to put it away or start making a sandwich." The second lady chimed in with, "Yes, sometimes I find myself on the landing of the stairs and can't remember whether I was on my way up or on my way down." The third one responded, "Well, ladies, I'm glad I don't have that problem, knock on wood," as she rapped her knuckles on the table and then said, "That must be the door, I'll get it!" Second grader Joseph Esposito was honored as the first contest winner this year for writing a wonderful essay about “Who is a hero in your community and why?” The day began with an assembly in the auditorium for the entire second grade class. Members of the Ducks congratulated Joseph for a job well done, and he was presented with a $50 Visa gift card by TD Bank Vice President of U.S. Field Marketing Eric Fishon and TD Bank Deer Park store manager Mary Warren-Mancini. Joseph went on to read his essay aloud to everyone in attendance, including his family and the hero he wrote about, North Babylon firefighter Dave Pappio. After a long ovation, Long Island’s favorite mascot, QuackerJack, was welcomed by the students and even showed off some of his favorite dance moves. Dave then spoke with the students about fire safety and was interviewed, along with Joseph, by several members of the media who covered the event. Following the assembly, Joesph and his classmates received a special visit to their classroom from QJ and TD Bank. The entire class was prepared with popcorn bags featuring QuackerJack on the front and cupcakes to celebrate. Both could barely see over the dashboard. As they were cruising along, they came to an intersection. The stoplight was red, but they just went on through. The woman in the passenger seat thought to herself, "I must be losing it. I could have sworn we just went through a red light." After a few more minutes, they came to another intersection, and the light was red again. They went right though it. This time, the woman in the passenger seat was almost sure that the light had been red and was really concerned that she was losing it. She was getting nervous and decided to pay very close attention to the road and the next intersection to see what was going on. At the next intersection, the light was definitely red, and sure enough, they went right through again. She turned to the other woman and said, "Mildred! Did you know we just ran through three red lights in a row? You could have killed us!" Mildred turned to her and said, "Oh my, am I driving?" You may submit your questions via email or call the number listed below for immediate answers. All inquiries are confidential and free. The names of those submitting questions are changed to ensure anonymity. Q: Dear Attorney: I have a tenant who hasn’t paid me rent for five months. I went to an attorney to start an eviction but I just received a letter that the tenant filed for bankruptcy. My attorney says I can’t file the eviction now and that I may not get the back rent I’m owed. Is there anything I can do to get the tenant out and collect the money that I’m owed? - Ann A: Dear Ann: The answers to your questions are yes and maybe. You didn’t indicate in your letter what chapter of bankruptcy the tenant filed. However, whether you’re dealing with a Chapter 7 or Chapter 13 bankruptcy, there is an automatic stay in effect which prevents you from starting the eviction proceeding while the bankruptcy case is pending. If your tenant filed a Chapter 7 bankruptcy, you can either wait until the case is closed and then start the eviction proceeding or you can make a motion to the bankruptcy court for permission to lift the stay and proceed immediately. However, you will have to pay an attorney to make the motion and since a typical Chapter 7 case only takes about three months to be discharged and closed, it may make more sense to just wait until the end of the case. With respect to the rent that you are owed, that debt will likely be wiped out in the Chapter 7, so although you will still be able to evict the tenant, you probably will not be able to get a money judgment for the back rent. The one exception may be if there are nonexempt assets belonging to the tenant that the Chapter 7 trustee is liquidating. In that case, you would be notified by the trustee to file a proof of claim for the amount you are owed and you may receive some money. Similarly, if the tenant filed a Chapter 13 bankruptcy, you will have the opportunity to file a proof of claim and possibly collect the back money as well as the go-forward rent payments. Feel free to contact my office to discuss your rights and remedies further. Q: Dear Attorney: My fiancé and I have been together for many years. We own a house together and have joint credit cards. We are struggling financially and are considering bankruptcy. Can we file a bankruptcy case together since we have joint debts? - Barb A: Dear Barb: Unfortunately, no. While you can both file for bankruptcy, you would have to file separate cases since you are not legally married. The younger angel was infuriated and asked the older angel how could you have let this happen? The first man had everything, yet you helped him, she accused. The family was rude and refused to let the angels stay in the mansion's guest room. The second family had little but was willing to share everything, and you let the cow die. Instead the angels were given a small space in the cold basement. "Things aren't always what they seem," the older angel replied. As they made their bed on the hard floor, the older angel saw a hole in the wall and repaired it. When the younger angel asked why, the older angel replied, "Things aren't always what they seem" The next night the pair came to rest at the house of a very poor, but very hospitable farmer and his wife. After sharing what little food they had the couple let the angels sleep in their bed where they could have a good night's rest. When the sun came up the next morning the angels found the farmer and his wife in tears? Their only cow, whose milk had been their sole income, lay dead in the field. "When we stayed in the basement of the mansion, I noticed there was gold stored in that hole in the wall. Since the owner was so obsessed with greed and unwilling to share his good fortune, I sealed the wall so he wouldn't find it." "Then last night as we slept in the farmers bed, the angel of death came for his wife I gave him the cow instead. Things aren't always what they seem." Sometimes that is exactly what happens when things don't turn out the way they should. If you have faith, you just need to trust that every out come is always to your advantage. You just might not know it until some time later. LINDSAY III FREEZES LEGISLATIVE SALARY INDEFINITELY SACHEM EAST VARSITY ARROWETTES Suffolk County Legislator Bill Lindsay III followed through on a promise to freeze his legislative salary at the 2014 rate earlier this month. Lindsay III, a freshman legislator, needed to wait until his first year was complete for the freeze to officially take effect. If no freeze was initiated by Lindsay III, he would have received a cost of living adjustment (COLA) which would have been near the 10 year COLA average of 2.7%. "I made a promise to the residents of my district to cut government waste and unnecessary spending. So I have frozen my salary indefinitely because it's not right for me to get a raise, while so many families are struggling to make ends meet." Lindsay III also proposed legislation that would have ended automatic pay increases for all Suffolk County Elected Officials in March of 2014, however that legislation failed. Nevertheless, Lindsay III made it clear, in a letter to Suffolk County Comptroller John Kennedy earlier this month, that he would continue to advocate for salary reform and forego any increase in his own legislative salary throughout his entire stint in office. “I am committed to serving the residents of the eighth legislative district; I have not taken a county car or cell phone, I have reduced spending within my own office, in terms of staff and rent, and I do not plan to ever take a salary increase,” said Lindsay III. “My focus is on solving the problems facing Suffolk County and my record has shown that I am committed to that goal.” Lindsay III’s rent decreased 25% after moving his office in April of 2014, saving $12,000 annually. Additional cost savings are associated with refusing to take a county car, cellphone, and gas reimbursements.
