Council previously released this easement in 2007, however, a re-plat filed that same year placed the
easement back on the properties.
Background Information/Analysis:
In 2006, the developer of the Parker Oaks subdivision purchased an addition 75 feet of property from
the owner of the Parker County Airport. The additional 75 feet was re-plated to increase the lot sizes
from ¾ of an acre to 1 acre lots in 2007. The City subsequently, zoned these lots to allow for airside
hangers (SF-1AP).
During the process of expanding the lots, the City released and abandoned a 10’ foot utility easement
located at the rear of the old ¾ acre lots. However, when the developer re-platted the lots to increase
their depth by an additional 75 feet it reestablished the utility easement previously abandoned. To
clean up the process and release the easement currently dissecting these lots, staff is recommending rereleasing the easement and executing quitclaim deeds. By performing this function, all questions to
whether the easement exists will be clarified.

ORDINANCE NO. 2015-XX
AN ORDINANCE VACATING AND ABANDONING THE TEN FOOT (10') UTILITY
EASEMENT DISSECTING LOTS 1R THROUGH 11R BLOCK 3, PARKER OAKS PHASE
I AND LOTS 12R THROUGH 24R, BLOCK 3, PARKER OAKS PHASE II; DECLARING
THAT SUCH EASEMENT IS UNNECESSARY FOR USE BY THE PUBLIC; PROVIDING
A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Hudson Oaks, Texas is a Type A general law municipality located
in Parker County, created in accordance with the provisions of Chapter 6 of the Local
Government Code and operating pursuant to the enabling legislation of the State of Texas; and
WHEREAS, the City Council of the City of Hudson Oaks, after careful study and
consideration, has determined that the ten foot (10’) utility easement dissecting Lots 1R
through 11R, Block 3, Parker Oaks, Phase I and Lots 12R through 24R, Block 3, Parker Oaks,
Phase II is not being used by, nor useful or convenient to the public in general; therefore, it
constitutes a public charge without a corresponding public benefit, and the public would be
better servied and benefited by its vacation and abandonment; and
WHEREAS, in order to remove any question as to the continued interest or ownership of
the public in such utility easement, the City desires to adopt this ordinance vacating any
interest of the public in said utility easement.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUDSON
OAKS, TEXAS:
SECTION 1.
The ten foot (10') utility easement dissecting Lots 1R though 11R Block 3, Parker Oaks
Phase I and Lots 12R though 24R, Block 3, Parker Oaks Phase II as shown on the plat recorded in
Plat Cabinet C, Slide 632, Plat Records, Parker County, Texas, and as more particularly described
and depicted on Exhibit “A” attached hereto, is vacated and abandoned as public property. The
utility easement so vacated and abandoned shall revert in fee simple to the owner of the
underlying property.
SECTION 2.
The Mayor of the City of Hudson Oaks, Texas, is hereby authorized and directed to
execute an abandonment of easement to the owner of the underlying property in the form
shown in Exhibit “B” releasing all claims to title, ownership, or control of the utility easement
on the behalf of the City. A copy of this abandonment of easement shall be presented for filing
with the County Clerk of Parker County, Texas.

SECTION 3.
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,
paragraph or section.
SECTION 4.
This ordinance shall be in full force and effect from and after its passage, and it is so
ordained.

Adoption of Minute Order 2015-15
Staff Recommendation:
Adopt Minute Order 2015-15, approving and authorizing the Mayor to sign Amendment #1 to
the Local Project Advance Funding Agreement (LPAFA) for the Lakeshore Bridge Project.
Prior Board or Council Action:
The Council most recently approved a revision to this agreement with Minute Order 2014-22 on
June 19, 2014.
Background Information/Analysis:
The Local Project Advance Funding Agreement (LPAFA) describes the roles and responsibilities
of each party participating in a jointly funded transportation project. The Lakeshore Bridge
project contains local, state, and federal funding sources, and as such requires a LPAFA. The
current LPAFA was revised most recently last summer.
The new revision was proposed by TxDOT in response to several items, most notably the need
to clarify financial responsibilities for right-of-way (ROW) acquisition and utility relocation. The
Lakeshore Bridge project was originally conceived as a Pass-Through Financing (PTF) project,
but was later converted to a more standard project including CMAQ (air quality) and Category
11 (discretionary) funding. Local and state responsibilities vary between these funding types,
and as a result the LPAFA has undergone several revisions to accurately reflect these changes.
Under the PTF program, ROW acquisition and utility relocation are often reimbursed. Under the
new funding arrangement, however, a 20% local match is required. Originally, the State
Transportation Improvement Program allotted $161,000 for ROW acquisition. In previous
meetings, staff has informed Council that property appraisals came in well over those initial
projections. When staff became aware that the ROW funding would be inadequate, we began
working with TxDOT and the Council of Governments to find additional funding.
The expected match for these portions of the project is approximately $135,000. TxDOT has
agreed to waive the local match to the Direct State Costs in order to help the City account for
these overages while also providing construction funds for a concrete intersection at US
180/Lakeshore Drive and aesthetic features on Lakeshore Bridge. This change will save the City
$101,292 in construction matching funds, and will defray approximately 75% of the City's ROW

and utility relocation costs. The remaining $35,000-$40,000 in overages will be absorbed in the
City's bond funds for the project.
Once approved, the City will submit the local contribution of $711,220.08 to TxDOT so that the
project may be let this summer. Construction is expected to last 14 months.
Financial Considerations:
This revision will reduce the City’s construction match in order to address overages in ROW
acquisition.

Each July, the City Administrator submits his formal budget proposal to the City Council.
Following deliberation, discussion, and public hearings, the City Council typically adopts the
budget, amended as necessary from the original proposal, during the August or September
meeting.
Tonight’s presentation will provide a high-level overview of the major items under
consideration by staff for the FY2016 budget, including:

Debt service timeline for the Centerpoint Bridge Project
General Fund fee schedule
Police Department market adjustments
Dyegard water rates
Staff will be presenting its preliminary direction on these (and other) budget questions and seek
