37 Office of the City Manager INFORMATION ITEM December 16, 2014 To: Honorable Mayor and Members of the City Council From: Christine Daniel, City Manager Submitted by: Eric Angstadt, Director, Planning and Development Department Subject: Supplemental information Related to Building Energy Saving Ordinance INTRODUCTION This report provides supplemental information requested by Council at the November 18th, 2014 meeting during the first reading of the Proposed Building Energy Saving Ordinance (BESO). At that time, Council requested that the BESO staff report and proposed ordinance be posted on the City’s website and that staff provide additional information on resources to support and offset costs of complying with the ordinance, including lists of available rate-payer incentives and local contractors performing energy services eligible for those incentives. CURRENT SITUATION AND ITS EFFECTS The proposed ordinance replaces the mandatory minimum measures of the Residential and Commercial Energy Conservation Ordinances (RECO and CECO) at time of sale and remodel with requirements for all buildings to conduct building efficiency assessments and publically report energy information. A summary of the proposed requirements, as well as the November 18th BESO staff report and proposed ordinance, are available at http://www.ci.berkeley.ca.us/EnergyOrdinanceUpdate/. The BESO energy assessment requirements are designed to align with efficiency incentives for energy audits and technical assistance, and to encourage participation in energy efficiency incentive programs. These rate-payer funded programs have evolved from individual rebates for specific measures to comprehensive efficiency performance incentives available through multiple agencies, including Pacific Gas & Electric (PG&E), Bay Area Regional Energy Network (BayREN) and third-party program providers. The energy assessment reports are required to include site-specific energy efficiency recommendations, along with improvement incentives and financing opportunities, to create a compelling value proposition for utility customers and building owners to invest in energy efficiency. BACKGROUND Funding for energy efficiency programs comes from utility rate-payer funded public purpose programs administered by the California Public Utilities Commission (CPUC) through PG&E and BayREN. Examples of Commercial and Residential incentives programs are provided in the case studies below: Commercial Building Case Studies: 1. SmartLights Case Study: A 5,000 sq/ft property containing a grocery store and deli in Berkeley had a free lighting and refrigeration efficiency audit from Community Energy Services Company (CESC). Lighting and refrigeration measures were recommended and installed. The lighting in the retail area was retrofitted to LED. Refrigeration infiltration and air sealing measures were installed in two walk-in coolers, and one walk-in freezer. First year energy savings totaled 35,000 kWH. The gross project cost was approximately $4500, less the $3,400 rebate which covered 75% of the cost. Annual savings are estimated at $1,200, producing a simple payback of less than one year. 2. SmartLights and On-Bill Financing Case Study: A 25,000 sq/ft, single story building with offices and a restaurant had a free lighting and refrigeration efficiency audit from CESC. Lighting and refrigeration measures were recommended and installed. The lighting was retrofitted to LED in the retail area and restaurant, and to efficient fluorescent lighting in the office spaces. The exterior parking lot pole lighting was changed to LED. Refrigeration infiltration and air sealing measures were installed in two walk in coolers, and one walk in freezer. First year energy savings totaled 46,000 kWH. The gross project cost was approximately $25,000, less a $7,500 rebate which covered 30% of project costs. Annual savings are estimated at $5,500, producing a simple payback of three years. The net cost of $17,000 was financed through PG&E’s On-Bill Financing program -- $0 down, 0% interest, and a payment plan which matched the three year simple payback. Residential Building Case Study: 1. Energy Upgrade California – Advanced Home Upgrade Case Study: A single family home had an advanced energy assessment with diagnostic testing for $300. Recommendations implemented included air sealing the attic and crawlspace, attic insulation to R-38 and wall insulation for a total project cost of $8,034. The client received $2,500 in improvement incentives and a $300 assessment incentive, netting a total project cost of $5,235. Benefits include improved comfort from reduced air infiltration and drafts, improved air quality, reduced sound and vibration transmission from outside, pest control, improved fire safety, and reduced energy costs. ENVIRONMENTAL SUSTAINABILITY This ordinance is a key implementation action of the Climate Action Plan and is projected to result in substantial reductions in energy use and greenhouse gas emissions, as well as improve indoor air quality that will contribute to the health and well-being of occupants. POSSIBLE FUTURE ACTION The purpose of this report is to provide City Council with additional background information on energy efficiency assessment and improvement incentives and resources for consideration of the proposed BESO. FISCAL IMPACTS OF POSSIBLE FUTURE ACTION Program compliance customer costs include administrative filing fees to the City of Berkeley and energy assessment fees to an energy service provider. Filing fees will be reduced through the use of general fund supported staff and are waived for exemptions, such as the High Performance Exemption or Hardship Exemption. Staff will reduce administrative costs when possible, especially to encourage early compliance.
