It also influences the outlook of its citizens and their behavior. Madhya Pradesh occupying geographical the central position in the country, is veritably the heart of India. The State of Madhya Pradesh is centrally located and is often called as the "Heart of India". The State is home to a rich cultural heritage and has practically everything; innumerable monuments, large plateau, spectacular mountain ranges, meandering rivers and miles and miles of dense forests offering a unique and exciting panorama of wildlife in sylvan surroundings. Madhya Pradesh, in its present form, came into existence on November 1, 2000 following its bifurcation to create a new state of Chhattisgarh. The undivided Madhya Pradesh was founded on November 1, 1956.Madhya Pradesh, because of its central location in India, has remained a crucible of historical currents from North, South, East and West. The concept of District Governance has been implemented and District Planning Committees have been empowered to plan and execute development works. A system of village level governance, Gram Swaraj, has been put in place, from Jan. 26, 2001, under which Gram Sabhas have been bestowed with considerable powers for development of villages and welfare activities. Madhya Pradesh is the second largest Indian state in size with an area of 308,000 sq. kms. The Population (Census 2011) 7,25,97,565, Districts 51, Zila Panchayats - 51, Development Blocks 313, Janpad Panchayats - 313, Total villages 54,903 and Gram Panchayats 23,010 2.2 About MAP-IT MAP_IT is a government society which has been established to propel the growth of Information Technology (IT) in Madhya Pradesh and implement the State IT Policy. Accordingly the Society has the following objectives. To provide IT inputs to government departments/agencies and to assist them in computerization and networking. To co-ordinate with investors and industry, trade organizations and financial institutions in public and private sector so as to promote growth in the IT sector; To facilitate Human Resource Development in the field of IT in the Government; To facilitate use of Hindi language in IT related projects; To undertake any other function(s) as may be assigned by the State Government. Page 9 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. 2.3 About this RFP The primary objective of this document to select the agency for design , develop and maintain the websites of 51 districts of MP as per the standards & guidelines of the government of India. This will also facilitate implementation and presentation of a consistent and standardized user interface/ architecture and making all the district websites compliant to “Guidelines for Indian Government Websites”. Overviews of understanding of User’s requirements with highlighting the features which are to be excluded/included in modified website are given in this RPF document. The details of proposed solution and how the proposed solution will get implemented through various phases or activities are also mentioned. Further, the detailed information about total time & cost included in this project are also given in this document. 2.4 Objectives The core objectives of the project are: a. To develop consistent and standard look and feel for all district sites of the Madhya Pradesh. b. Ensure compliance with “Guidelines for Indian Government Websites (GIGW)” of all district websites. c. Integrate easy to use content management system for easily managing overall content of the website. d. Redevelopment of website as Bi-lingual with i.e. English & Hindi (Unicode compliance) Version and to ensure that Hindi content is universally accessible by using Unicode compliant font (The approval of translated content will be done by MAP_IT). e. Make it easy to use for citizens by providing latest updates, important events, etc. of all the districts on respective websites home page itself. f. Make it easy to use for citizens by providing within site search feature. g. Make site accessible on all platforms like windows, mobile phones, disabled specific devices. h. Provide information to citizens with minimum number of clicks. i. To get Safe to Host Certificate from cert-in empanelled auditor for all websites. j. To get browser independence/ device independence of all websites. k. To get GIGW Compliance Audit Certificate from STQC for all websites. Go Live – This means that all requirement gathering documents stand approved by Nodal Agency or core team appointed by nodal agency. This would also entail – development / UAT in line with approved FRS/SRS/Design documents. Lastly production deployment Page 13 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. complete in all respects (possible integration as advised by Nodal agency and security audit) would define Go live. Once this is achieved Nodal agency/ core teams appointed by nodal agency would give sign off for each website. Collective sign off date for all 51 websites would define start date of 4 years 0&M phase of this project. Above timelines are mentioned for Application Service Provider to perform various activities under given milestones. Time taken by MAP_IT for evaluation and approval of deliverables will be excluded from above timelines. Page 14 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. 3 Scope of Work Design, Development, and Maintenance of MP Districts websites for 51 districts and to provide and Maintenance support for 4 years. The below mentioned scope of work is indicative, the more elaborated scope will be based on AS-IS and To-Be study after discussion with each district nodal officer. 3.1 Development 3.1.1 Fact Finding and Requirement Gathering A high‐level analysis of processes has already been performed and Functional Requirements as envisaged for this project are described in this document. The Application Service Provider needs to Study these carefully and should consult with the concern district officials whenever necessary to obtain more details on the requirements of the project. It shall be the duty of agency to refine functional requirements as needed during requirement gathering exercise. The Application Service Provider shall prepare detailed requirement gathering documents ( for each district), for which the agency shall have a comprehensive discussion with each district officials and other stakeholders to ensure that each of the requirements mentioned in this RFP or identified during study is covered. After approval of requirement gathering documents by concerned officials at respective districts and from MAP_IT, the Application Service Provider will start Website and CMS Development. 3.1.2 Unique designs for each 51 District Website Design Structure 1. Need to submit at least 5 home page design layouts for approval at each district. 2. Unique architecture as per the requirement of district team 3. Homepage should be attractive and well-constructed, so that it makes a good first impression to all website visitors. 4. Homepage should clearly communicate the site's purpose, and show all major options available on the Web site. 5. A consistent page layout must be maintained throughout the site. 6. Most important elements should be visible on the first screen and should not go inside a scroll. The majority of the homepage should be visible ’above the fold,’ 7. While using National / State identity symbols like flags, national /State emblem etc. it must be ensured that the images are in a proper ratio and color. 8. Graphic elements like buttons and icons should be simple and their meaning and symbolism should be self-explanatory and relevant. 9. Where ever a graphic is used meaningful ‘alt text’ must be given. 10. There must be adequate color contrast between text and background. Use of image should be limited as Images increase downloading time and Images should only be used when it adds value to the content. Use of text rather than images should be considered for headings and website navigation. 12. Use of frames must be minimized as many search engines do not index framed web pages properly, however if frames are used each frame must be titled to facilitate frame identification and navigation. 13. Easy access to the homepage should be provided from every page in the site. Design Themes 1. Approved design should have at least 5 color themes and one high contrast color theme. 2. These color themes should follow and should be according to the international standards for different types of vision disabilities (e.g. color blindness etc.) Compatibility 1. The design of the website should be responsible so that it should adjust according to the screen size. 2. Design should be compatible to Laptop, desktop, Tablet PCs, Mobiles and hand held devices. 3. Design should be compatible with all the major browsers. 4. Design should not be font dependent. The content of the site should be readable with default standard fonts. 5. Font properties should be such that the text must be readable both in print and electronic format and the page must print correctly on A4 size paper. Scalability 1. Design interface should be easy to configure, customize and extend 2. Table-less HTML Design should be developed using 960 grid system. 3. Optimized compressed CSS and JS should be used. All the decorative images should be used from CSS. And to reduce the load time of page image sprite should be used 4. Any CSS or JQuery used in designing should be free from copyright content and will be with the name of department itself. 5. All styling should be handled through external style sheet. All the HTML tags should be styles through CSS, so that it should be uniformly consistent at each location where ever used. 3.2 Functional Requirement in Each District Website Role Based User Access 1. Each website should have an authenticated area from where authorized users can update the content of the website. 2. There can be n number of users to manage the content of the website. 3. Each user can have their different roles, authorization of role and responsibility of users can be configured from the content management system. The user authentication module should be available on district website and access right should be on role based. 5. Users can have contributor, moderator or approval role for a particular section of the Website. 6. No user can permanently delete the content from website. Only administrator can have the rights to permanently delete the content from the website. Content Management System (Bilingual) 1. Page Title: The related page title should be displayed on the page with related content. 2. Meta Descriptions: The every page of CMS has to have brief summary within the page. 3. Meta Keywords: Every page of CMS has facility to update Meta keywords for search engines. 4. Long Description: - Long description can be used for details description of a short description or as a main page. 5. Active/Inactive: - Menu can be set in active/ reactive mode as per the requirement of concern district administrator. 6. Sequence/ordering: Sequencing or ordering of links, sub links should be manageable by the authorized user. 7. Approval: - Based on Districts Administration the approvals can be set on concern user base. 8. Contents/ Image/PDF upload on website: Contents /Image/PDF can be uploading as required for any page of concern user. 9. New Flag: If any new menu/link/document title added in the website it should automatically show a new flag against the menu/link/document. Duration till the new flag should display will be configurable by the administrator. 10. Concept Place Holder: The concept place holder based on predefined content section includes editable content based on requirements of concern user. 11. Mobile/ tablet Option: The content Management system has to have facility to active every option for the mobile/ tablet and any other devices. 12. Any other based on concern district requirement Menu Management 1. Header Menu: - The GIGW based with complete options top header menu, new creation with concern page, Modification of Menu and Sub-Menu, edition of Menu and Sub-Menu related work dynamically. 2. Footer Menu: - The GIGW based with complete options footer menu, new creation with concern page, Modification of Menu and Sub-Menu, edition of Menu and Sub-Menu related work dynamically. 3. Quick Menu: - The GIGW based quick menu, and other link based menu automatically updated. 4. Important Link Menu: - The GIGW based with important link navigation from main website to other website/PDF and other can be generate/ edit and also modify. Site Map: - The GIGW guideline based sitemap can be generated automatically with crated links dynamically without manual intervention. Work Flows 1. Each content likely to be published on the websites should go through workflow process. The Workflow process can be 2-3 stage depending upon requirements. 2. Workflow process can be configurable and customizable at district level depending upon the hierarchy available to publish the content at each district. 3. At each stage of the workflow email alerts should be sent to the designated officer regarding the assigned tasks to them. Localization 1. Content management system should be Bilingual and support localization. 2. Language for Website will be English and Hindi. 3. Content management system should support Unicode, so that no font is required to browse the website for Hindi language. 4. Front-end of websites will have all the content including dynamic & static text in both the languages. Version History 1. CMS should have version management system. Compliance with Guidelines for Government of India Websites. 2. Free from OWASP Top 10, Vulnerabilities. 3. Captcha to be implemented to prevent bot attacks. 4. Protecting against DoS attack targeting application like locking of the application 5. Secure mechanism of changing the password in lost/forgotten scenario. Password policies should be applied. 6. Audit trail should be enabled on the website, so that the administrator can see the successful and unsuccessful logon, with time, IP attempts on the website. 7. Audit trail at administrator level should also be enabled. It should capture each activity done by each authorized users, IP address, Time stamp etc. to track that who, when and from where has done what changes in CMS. . Server details will be taken by Application Service Provider in coordination with State Data Center. 2. Source Code and Database of all District website will be deployed by Application Service Provider on State Data center staging Server for security audit. 3. Digital Certificate for stating server will be taken by Application Service Provider in coordination with SDC Team 4. Installation of Digital Certificate will be carried out by the Application Service Provider. 5. Installation of all software related to installation will be the responsibility of Application Service Provider 6. Application Service Provider will be responsible for transferring the source code / database to production server. 7. If required Application Service Provider will have to visit State Data Center or District offices for making district website live. 8. Selected Application System provider would be expected to size hardware/networking/ storage required for project and submit to competent authority during 1-2 weeks from date of award of contract. The requirement of necessary licenses required for the hosting of the web sites at S.D.C. will be provided by the Application Service Provider. However it is clarified that these license are not to be procured by the selected Application Service Provider. 3.5 Content Translation of English to Hindi and vice a versa Application Service Provider will be responsible to do the translation of English content into Hindi Language and Hindi Content to English. Application Service Provider will be responsible for the translation work in coordination with the each district and the each district will need to cross check to ensure correctness of the content translated. District official of each district will coordinate for the proof reading. The final approval of the translated content will be taken by the MAP_IT by the Application Service Provider. 3.6 Content Population of Hindi & English Language Application Service Provider will ensure that each district website has all relevant content. As per the requirements of the concerned district. 3.6.1 Content Collection from each district Application Service Provider will be responsible for collecting the content from each district officials. 3.6.2 Content Compilation 1. Content received form each district will be restructured by Application Service Provider as per GIGW guidelines with consultation of district administration 2. Application Service Provider will provide the Meta data for each content page. 3. Application Service Provider will be responsible for providing description/alt text for images. 4. Application Service Provider will add/update the tabular content as per GIGW guidelines. 3.6.3 Content Integration Restructured content will be integrated/ uploaded into the newly developed each district websites as per user requirements. All defects found during review, acceptance testing shall be fixed to the satisfaction of the designated officer. 2. The website within the scope of work shall be as per specifications given. In case the whole website or any part thereof is found to be of inferior quality or not performing satisfactorily the same shall be developed or modified free of charge immediately. 3. All the expenses (stationary, postage, transport, accommodation etc.) shall be borne by Application Service Provider for UAT. 3.8 Certifications 3.8.1 Safe to Host Certificate for each of the 51 websites from STQC / Cert-in empanelled agency State data center requires security clearance certificate before hosting any website in its data center. Each District websites will be audited by Cert-in empanelled auditor and all the vulnerabilities will be fixed. Upon completion, security clearance certificate from cert-in empanelled auditor will be submitted by the Application Service Provider. All the expenses will be borne by Application Service Provider for cost of Audit, all efforts involved for security patching and coordination required with district officers and Auditing agency. 3.8.2 GIGW Compliance Certificate for each of the 51 websites from STQC GIGW Compliance Audit Certificate certifies that the website is developed as per Guidelines for Indian Government Websites (GIGW); is accessible to people with disability; and is adhering W3C’s WCAG Guidelines. a. Websites should be compliance to GIGW guidelines (Ref. Annexure – 11). Application Service Provider will submit the GIGW compliance certificate from STQC for each district websites to Respective designated officer. b. Application Service Provider will handle the entire process related to obtaining this certificate from STQC. c. Application Service Provider will prepare Website quality manual in Hindi & English (Ref. Annexure –10) for each district website on behalf of District. Coordination with each district officer for obtaining information related to policies, web information manager etc. will be done by Application Service Provider. d. The district websites will integrate with CM dashboard, the hit count will be reflected on e-taal, there will be web services for data.gov.in. 3.9 Training & Handholding Support 3.9.1Training & Handholding support at each district location 1. Proper training has to be provided to Nominated District staff as well as the Nodal Agency Representatives who will operate the websites. 2. Training will be conducted at each district for district nodal officers. 3. All the stationary and Training material, user manuals in soft and hard copy will be provided by the Application Service Provider. 4. Onsite support to district team of officers at concerned district as per requirement through the support duration of 4 years. 5. The RCBC training centers of the Government of MP will be utilized for imparting training. 3.9.10 AMC The Application should provide maintenance support for 4 consecutive years with agreeable maintenance coverage and associated cost (ensuring 100% dedicated availability of minimum project manpower defined in RFP clause 3.9.11; hence we expect that this manpower would be costed for entire project duration including O&M phase). During maintenance period the Application Service Provider will submit a Support System (In Scope) – using SLA monitoring tools and generate monthly report about complaint lodged and resolution time to resolve the problem to MAP_IT concern project team on the first week of the next month. Software solution provider will also submit a performance review report on monthly basis with their own capability. Additionally ASP – application service provider would have to publish performance / data related reports from time to time as demanded by district core teams ( to publish Page 25 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. performance / dashboards at district level) / Nodal agency (to publish performance / dashboards at state level). 3.9.11 Centralized Dedicated Teams Selected Application Service Provider will be required to provide dedicated team as per team structure given below for 4 years for ongoing enhancement, maintenance and management of district web sites (ensuring 100% dedicated availability of minimum project manpower defined in RFP clause 3.9.11; hence we expect that this manpower would be costed for entire project duration including O&M phase) Application Service Provider will have to arrange its own infrastructure for the team within acceptable distance from the department location for smooth coordination with the department team. 3.9.11.1 Minimum required team Structure at HQ The following team will be stationed at Head Quarter up to the Go-Live period and also be available during 4 years O&M phase post Go live . However, successful bidder/ ASP (application service provider) is free to deploy additional manpower to meet the service level requirements and adherence to the scope of work of the project, if he thinks appropriate. But minimum required manpower should by default be part of project scope and hence commercials. 3.10 Scope of maintenance support 1. The O&M phase for such new district would commence from the date of production deployment of this website and span for 4 years as for original scope of the project. Contract in such case would be modified by adding addendum/annexure PBG would be defined based on commercials for this additional project scope. In event of new district being incepted post completion of original O&M phase of 4 years ( post Go live) , Nodal Agency would consider paying 10% additional cost to ASP – application service provider for such additional work. 3.11 Deliverables 1. Bidders who score a Technical bid score of 70 or more, would be qualified for the financial bid evaluation process. 4.3 Method of Evaluation: Only the bidders, who score a Technical bid score (Tb) of 70 (Seventy) or more, they will qualify for the financial bid evaluation. After the Technical evaluation, the evaluation committee will evaluate each of the Technically Qualified bidders’ response on the basis of technical and commercial parameters. The weightage of the technical and commercial parameters will be in the ratio of 70:30 respectively. For calculation of the combined Technical and Price Score of all bidders, following formula will be used: Total Score = [(Technical Score x 0.70) + ((LP/OP x 100) x 0.30)] Where LP is the Lowest Price offer of the Technically Qualified Bidders and OP is the Offer Price of the bidder being evaluated. Pre-Bid Format The proposals should be submitted in two parts as mentioned in the following sections:‐ 5.1.1 Pre‐Qualification (PQ) and Technical Proposal Along with other documents, following documents shall be a part of PQ and Technical Proposals: ‐ A. Client Reference list (similar domain as per the requirements in this RFP). M. Permanent Account Number (PAN) from Income Tax authorities of bidder along with certified photocopy. N. Service Tax Details of bidder. O. Other documents as mentioned in the Eligibility Criteria section of this document. Technical Presentation: As a part of technical evaluation the PQ qualified bidders would be invited for a technical presentation before the evaluation committee the purpose of this presentation is to facilitate committee members to effectively comprehend the bidder’s capability and compliance on technical evaluation parameter. In the technical presentation the bidders are expected to demonstrate the approach, methodology, team composition, training plans, adherence to time lines, and strategy including of O & M phase. After the technical evaluation is completed, Nodal Agency (MAP_IT) shall specify the date, time and location for opening the Financial Proposals, if there is a variation in the aforesaid dates as mentioned in the table. Evaluators of Technical Proposals shall have no access to the Financial Proposals until the technical evaluation is concluded and the same is approved by the appropriate committee. 5.1.2 Commercial Proposal The commercial proposals should be submitted as per the format of Commercial Bid as per Annexure 9. 5.2 Bid Security (EMD) & Security Deposit a. The bidder shall furnish a bid security (EMD) of Rs. 15,00,000/‐ (Rs Fifteen lakh only) in Indian rupees in the form of a Demand Draft or Bank Guarantee issued by a Scheduled/ Nationalized Bank in favor of MAPIT Bhopal payable at Bhopal. EMD is to be submitted offline at MAP_IT office, after submission of bids online, and before opening of bid. In case bidders representative is willing to participate in bid opening process, it is advised to bring original EMD/DD before opening of bid and submit it directly to Tender Opening Committee offline. b. An envelope containing EMD to be super scribed as “EMD for RFP for Design Development and Maintenance of 51 Districts website of MP”. The envelop is to be submitted physically at MAP_IT office State IT Center 47 A , Arera Hills Bhopal Madhya Pradesh before the time of opening of bid. c. The EMD shall be valid for at least 80 days in case of DD and 180 days in case of Bank Guarantee from the date of submission of proposal. No interest shall be payable on Bid Security under any circumstances. d. Unsuccessful Bidder’s Bid security shall be discharged or returned within 30 (thirty) days of expiration of the period of proposal validity prescribed by the Nodal Agency (MAP_IT) or after awarding tender to successful Bidder. The successful Bidder’s EMD shall be discharged upon the signing of agreement by the Bidder. f. The Bid security will be forfeited at the discretion of Nodal Agency (MAP_IT ) on account of one or more of the following reasons‐ i. The Bidder withdraws its Proposal during the period of proposal validity ii. Bidder does not respond to requests for clarification of its proposal iii. In case of a successful Bidder, the said Bidder fails‐to sign the Agreement in time. g. The bidder have to submit the requisite Performance Security/Security deposit @10% of the total value of contract in the form of Bank Guarantee or DD shall be valid for a period of 3 months beyond the date of completion of all contractual obligations of supplier. 5.3 Compliance & Completeness of Response Bidders are advised to study all instructions, forms, terms, requirements and other information in the RFP document carefully. Submission of bid shall be deemed to have been done after careful study and examination of the RFP document with full understanding of its implications. The response to this RFP should be full and complete in all respects. Failure to furnish all information required by the RFP documents or submission of a proposal not substantially responsive to the RFP documents in every respect will be at the bidder's risk and may result in rejection of its proposal and forfeiture of the bid EMD. The RFP Document is not transferable to any other bidder. 5.4 Signing of Communication to MAP_IT All the communication to Nodal Agency (MAP_IT) including this RFP and the bid documents shall be signed on each page by the authorized representative of the bidder and authority letter should be attached with the bid. 5.5 Proposal Submission The bidder is responsible for registration on the e-procurement portal (www.mpeproc.gov.in) at their own cost. The bidders are advised to go through the eprocurement guidelines and instructions, as provided on the e-procurement website, and in case of any difficulty related to e-procurement process, may contact the helpline number 18002588684. The Bidder shall submit the proposals online as described below- a. Proposal that are incomplete or not in prescribed format may be rejected. b. The PQ and Technical Proposal and the Financial proposal should be submitted only through the e- procurement Portal. c. The financial Bid should be exclusive of all taxes and inclusive of all related accessories, Driver Software, Operating Manuals, Forwarding, Freight, and Page 35 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. Installation charges at sites and Warranty etc. Price shall remain fixed for a period of project duration from the date of Notification of award. d. Conditional proposals shall not be accepted on any ground and shall be rejected straightway. If any clarification is required, the same should be obtained before submission of the bids. e. Bidders are advised to upload the proposals well before time to avoid last minute issues. f. The bid has to be submitted only through online through www.mpeproc.gov.in website. No physical submission of bids would be acceptable. 5.6 Amendment of Bid Document At any time prior to the deadline for submission of bids, Nodal Agency (MAP_IT) for any reason, whether at its own initiative or in response to a clarification requested by a prospective bidder, may modify the bid documents by amendment. Any such communication shall be posted on w w w . e p r o c . g o v . i n a n d Nodal Agency (MAP_IT) website and bidders are requested to visit the website for updates. 5.7 Bid Validity All the bids must be valid for a period of 180 days from the last date of submission of the RFP for execution of Contract Agreement. However, the quoted rates should be valid for the initial/ extended period of the contract from the effective date of the Contract Agreement. No request will be considered for price revision during the contract period. 5.8 MAP_IT’s right to terminate the process Nodal Agency (MAP_IT) may terminate the RFP process at any time and without assigning any reason. Nodal Agency (MAP_IT) makes no commitments, express or implied, that this process will result in a business transaction with anyone. This RFP does not constitute an offer by Nodal Agency (MAP_IT). 5.9 Disqualification of bids Nodal Agency (MAP_IT) may at its sole discretion and at any time during the processing of tender, disqualify any bidder from the tendering process if the bidder has: i) Submitted the tender after the prescribed date and time of submission of bids. ii) Made misleading or false representations in the forms, statements and attachments submitted. iii) If found to have a record of poor performance such as abandoning works, not properly completing the contract, inordinately delaying completion, being involved in litigation or financial failures, etc. Page 36 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. iv) Failed to provide clarifications related thereto, when sought. v) Conditional bids will be summarily rejected. vi) Applicants who are found to canvass, influence or attempt to influence in any manner the qualification or selection process, including without limitation, by offering bribes or other illegal gratification, shall be disqualified from the process at any stage. 5.10 MAP_IT’s Rights to Accept/Reject any or all Proposals Nodal Agency (MAP_IT) reserves the right to accept or reject any proposal, and to annul the bidding process and reject all bids at any time prior to award of contract, without thereby incurring any liability to the affected bidder or bidders or any obligation to inform the affected bidder or bidders of the grounds for Nodal Agency i.e. MAP_IT’s action. 5.11 Bid Prices The bidder shall express their bid prices using the Commercial Bid Format provided in the bidding documents as Annexure 9. All costs and charges related to the bid shall be expressed in Indian Rupees. Prices indicated in the Price Schedule shall be entered in the following manner: ‐ The Prices quoted by the bidder shall remain fixed during the entire period of contract and shall not be subject to variation on any account. A bid submitted with an adjustable price quotation will be treated as non‐responsive and rejected. The prices quoted by the bidder shall be in sufficient detail to enable the Purchaser to arrive at the price of the services offered. 5.12 Contract Finalization and Award Criteria The notification of the award shall be followed by signing of the agreement. The signing of agreement will amount to award of contract and bidder will initiate the execution of the work as specified in the agreement. At the same time as N o d a l Agency ( M A P _ I T ) notifies the successful bidder that its bid has been accepted, Nodal Agency ( M A P _ I T ) will send the bidders the Performa for contract, incorporating all agreements between the parties. Within 15 days of receipt of the contract, the successful Bidder shall sign and date the contract and return it to MAP_IT. 5.13 Performance Security The Bidder shall at his own expense will deposit within Fifteen (15) working days of the date of notice of award of the contract or prior to signing of the contract, whichever is earlier, an unconditional and irrevocable Performance Bank Guarantee Page 37 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. (PBG) or DD from a Scheduled/nationalized Bank acceptable to MAP_IT, payable on demand, for the due performance and fulfillment of the contract by the bidder. This PBG/DD shall be for an amount equivalent to 10% of value of contract. All charges whatsoever such as premium, commission, etc. with respect to the PBG/DD shall be borne by the bidder. The PBG shall be valid till the end of three months after the expiration of contract period and should be in the standard format prescribed by Reserve Bank of India. No interest will be payable on security deposit. 5.14 Prices Price shall remain fixed for entire period from the date of Notification of award. There shall be no increase in price for any reason whatsoever and therefore no request for any escalation of the cost / price shall be entertained. Price shall be exclusive of all taxes. 5.15 Discounts, Levies, Freight etc. The Bidders are informed that discount, if any, should be merged with the quoted prices. Discount of any type, indicated separately, will not be taken into account for evaluation purposes. The Bidders should also take into account all levies, freight, insurance etc. The price quoted should be inclusive of all levies, freight, insurance etc. Freight, levies, etc. of any type, indicated separately, will not be taken into account for evaluation purposes. 5.16 Language of Bids All Proposals, correspondence and documents related to proposals, shall be written in the English language. Supporting documents and printed literature furnished by the Bidder may be in another language, provided they are accompanied by an accurate translation of the relevant passages in English language. 5.17 Late Proposal The bidder will not be able to submit the proposals after final submission date and time is over. The physical document of proposal, as described in RFP, received by the MAP_IT after final submission date and time of proposal prescribed in the RFP document may not be considered and the entire proposal may be rejected. The EMD of such proposals will be returned to the Bidder. 5.18 Modification & Withdrawal of Proposal The Bidder is not allowed to modify its proposal subsequent to the final submission of proposals. The Bidders cannot withdraw the proposal during the period between Page 38 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. the last date for receipt of proposals and the expiry of proposal validity period specified in the RFP. A withdrawal of proposal during proposal validity period may result in the forfeiture of its EMD from the Bidder. 5.19 Resolution of Disputes MAP_IT and the successful bidders shall make every effort to resolve amicably by direct informal negotiation, any disagreement or dispute, arising between them under or in connection with the contract. Any dispute or difference whatsoever arising between the parties to this Contract out of or relating to the meaning, scope, operation or effect of this Contract or the validity of the breach thereof, which cannot be resolved, shall be referred to a sole Arbitrator to be appointed by mutual consent of both the parties herein. If the parties cannot agree on the appointment of the Arbitrator within a period of one month from the notification by one party to the other of existence of such dispute, then the Arbitrator shall be nominated by the Secretary, Law Department, Government of Madhya Pradesh (“Law Secretary”). The provisions of the Arbitration and Conciliation Act, 1996 will be applicable and the award made there under shall be final and binding upon the parties hereto, subject to legal remedies available under the law. Such differences shall be deemed to be a submission to arbitration under the Indian Arbitration and Conciliation Act, 1996, or of any modifications, Rules or re-enactments thereof. The Arbitration proceedings will be held at Bhopal, Madhya Pradesh, India. All legal disputes are subject to the jurisdiction of Courts at Bhopal only. 5.20 Termination A Party, without prejudice to any other remedy for breach of Contract, may terminate this Contract in whole or in part by giving 30 days advance notice; if the other Party commits a material breach of the Contract and fail to rectify it after being granted a reasonable cure‐period to rectify the defect. In the event of termination, MAP_IT shall pay all amounts due from its side for the products delivered and services performed by the Bidder till the date of termination. The Bidder shall continue performance of the contract to the extent not terminated. 5.21 Force Majeure The Bidder shall not be to liable for forfeiture of its performance security, liquidated damages, or termination for default if and to the extent that its delay in performance or other failure to perform its obligations under the Contract is the result of an event of Force Majeure. For purposes of this Clause, “Force Majeure” means an event beyond the control of the Bidder and not involving Bidder’s fault or negligence and not foreseeable. Such events may include, but are not restricted to, acts of the Client Page 39 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. in its sovereign capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions, and freight embargoes, act of god, riots, strikes etc. If an event of Force Majeure continues for a period of ninety (90) days or more, the parties may, by mutual agreement, terminate the Contract without either party incurring any further liabilities towards the other with respect to the Contract, other than to effect payment for goods/services already delivered or performed. 5.22 Notices Any notice given by one party to the other pursuant to this contract shall be sent to the other party in writing or by email or facsimile and confirmed in writing to the other party’s last known address. A notice shall be effective when delivered or tendered to other party whichever is earlier. Page 40 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. 6 Bid Evaluation 6.1 Bid Evaluation Committee The Bid Evaluation Committee constituted by MAP_IT shall evaluate the tenders. The decision of the Bid Evaluation Committee in the evaluation of the PQ and Technical and Commercial bids shall be final. No correspondence will be entertained outside the process of negotiation/ discussion with the committee. 6.2 Overall Evaluation 6.3 Bid Evaluation Committee will evaluate and compare the bids determined to be substantially responsive. It is Bid Evaluation Committee’s intent to select the proposal that is most responsive to the project needs and each proposal will be evaluated using the criteria and process outlined in this section. PQ & Technical bids shall be examined by the Bid Evaluation Committee with respect to compliance, completeness and suitability of the proposal to the project and only the bids which are in compliance to the requirements mentioned in the RFP shall be considered as technically qualified. Total bid evaluation: Only the commercial bids of those bidders qualified in the PQ & Technical evaluation shall be opened. Commercial bids of the other bidders will not be opened. The evaluation shall be strictly based on the information and supporting documents provided by the bidders. It is the responsibility of the bidders to provide all supporting documents as listed in Forms necessary to fulfil the mandatory eligibility criteria. Evaluation of Pre‐Qualification and Technical Proposals Pre ‐ qualification bid documentation shall be evaluated as under: 1. The Bid Evaluation Committee will check if the bidder has deposited the EMD along with the PQ and Technical Proposal and the same are found to be in order. 2. The documentation furnished by the bidder will be examined prima facie to see if the Company’s capacity, skill base and other Bidder attributes as claimed therein are consistent with the needs of this project. 3. MAP_IT may ask bidder(s) for additional information, and/or arrange discussions with their professional, technical faculties to verify claims made in bid Page 41 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. documentation. If the bidder fails to submit the additional supporting documents, the PQ bid shall be rejected. 4. The bidders’ PQ and technical proposal proposed in the bid document shall be evaluated as per the requirements specified in the RFP and adopting the evaluation criteria spelt out in this document. The Bidders are required to submit all required documentation in support of the evaluation criteria specified (e.g. detailed project citations and completion certificates, client contact information for verification, profiles of project resources and all others) as required for technical evaluation. Bidder is required to submit documentary proof of either Purchase Order/Agreement/ Completion Certificates, detailing Scope of Work, Timelines, etc. or relevant documents. MAP_IT reserves the right to take the decisions of whose commercial bids are to be opened. 6.4 Commercial Proposal Evaluation 1. The Commercial Bids will be opened, in the presence of Bidders’ representatives (Maximum two for each bidder). The Bidder’s representatives who are present shall sign a register evidencing their attendance. 2. The Commercial Bid of only technically qualified bidders will be opened. Those technically qualified bidders shall be termed as Substantially Responsive. The decision of the MAP_IT in this regard shall be final. 3. The name of Bidder, Bid Prices, Discount, etc. will be announced at the meeting. 6.5 Commercial Bid Rejection Criteria 1. Incomplete Price Bid 2. Price Bids that do not conform to the Tender’s price bid format 6.6 Notification of Award to the Bidder Before the expiry of the period of validity of the proposal, the MAP_IT shall notify the successful Bidder in writing by registered letter or by fax, that its bid has been accepted. The Bidder shall acknowledge in writing receipt of the notification of award and will send his acceptance to enter into agreement within seven (7) days. 6.7 Award of Contract A contract will be awarded by MAP_IT to the responsive Bidder whose Bid conforms to the requirements and represents the best value to the project, price and other factors considered. Evaluations will be based on the Bids, and any additional information requested by the MAP_IT. Page 42 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. 6.8 Signing of Contract The signing of agreement will amount to award of contract and bidder will initiate the execution of the work as specified in the contract/agreement. If the bidder refuses to accept the award within one week and disinclines / or neglects the signing the contract agreement and does not offer to sign the agreement immediately after one week of receipt of letter of intent and does not sign the contract agreement within a fortnight, the MAP_IT may forfeit the bid security of the bidder. 6.9 Discharge of Bid Security: Upon the successful signing of the agreement, MAP_IT shall promptly request the Bidder to provide performance security. On receipt of the performance security, the bid security will be released. 6.10 Performance Security 1. Within 15 days of notification of award, the Selected Bidder shall furnish performance security equal to 10% of bid value, valid up to 3 months after the date of completion of the project term that includes 4 years maintenance period after ‘Go Live’ of the project. 2. The proceeds of the performance security shall be payable to the MAP_IT as compensation for any loss (es) resulting from the failure of the Bidder to meet out its obligations under the Contract. 3. The performance security shall be furnished in the form of an unconditional and irrevocable and Bank Guarantee/DD for Contract Performance of the sum equivalent to 10% of the contract value in a form and manner acceptable to the MAP_IT which would remain valid until such time and be renewable as may be stipulated by the MAP_IT. Page 43 of 66 Request For Proposal – Design Development and Maintenance of Websites of 51 districts of M.P. 7 Payment Payment shall be made against Invoices duly certified by MAP_IT official. All taxes deductible at source, if any, at the time of release of payments, shall be deducted at source as per current rate while making any payment. Payment would be made as per the following schedule: ‐ % of Total Contract Value 25% Milestones After submission of requirement gathering documents by ASP Approval of same by MAP_IT. 25% Design submission and approval. 24% Completion of UAT 10% Go Live including security audit. ** 16% Amount would be paid for 4 years Maintenance & Support services in 16 equal quarterly installments (would start from the start of first months of Go Live Certificate). **The Co-Hosting at SDC would be completed post security audit. The STQC compliance is to be completed within first three month of operation and maintenance phase or as per actual time required by STQC. 8 Service Level Agreement The purpose of this Service Level Requirements (hereinafter referred to as SLR) is to clearly define the levels of service which shall be provided by the Application Service Provider to the MAP_IT for the duration of this contract. 8.1 Category of SLRs This SLR document provides for minimum level of services required as per contractual obligations based on performance indicators and measurements thereof. The Application Service Provider shall ensure provisioning of all required services while monitoring the performance of the same to effectively comply with the performance levels. The services provided by the Application Service Provider shall be reviewed by the MAP_IT that shall: a) Regularly check performance of the Application Service Provider against this SLR.
